Alpha probably is the greatest story teller in RUclips history. Been following since 2017, and I still get amazed by his delivery and framework of sharing his experiences.
This is a complex situation, but if I had multiple streams of income and this was one of the items which was getting sued, I'd be doing the same thing Alpha did 😁

One of your most informative videos. I was also sued for naming issues back in 2005, by the Philadelphia Phillies for a menswear store I opened on 3 floors on the corner of 59th St and Third Ave in NYC. They have in house attorneys and can go on forever in court. They sent me a whole book of documents, not just a letter. I also called their attorney directly. Patent/Trademark attorneys are not cheap. I guess I need a video on this as well.
Use the term ( ULTRA FRESH ). ultra is much better than super.

I was told by a CEO that trained me “ your not in business until you get sued”. He also told me if I right then make your competitors bleed. This advice is not for everyone but for those who understand it was the truth.

I would of applied for the trade mark of super fresh for smell. And then told them for a royalty fee you will let them use your trademark

What they gonna fight for if that can't get trademarked? I guess you never asked your attorney? The publicity would have been Golden to expose their dirty business practices and their shitty product.

This is a good product and I like using it.
My suggestion: If the deodorant container has a pressure sensitive label as the method of decoration and you don’t have a ton of inventory, simply change the name to “Ultra Fresh” and take the money you would spend on litigation and upgrade your packaging design and pressure sensitive label material. (Maybe hot stamp or screen print the labels on a pressure sensitive film). It will make the product look amazing, and help drive sales. Whatever you do, good luck!
Start a counter suit for triple in respect to what you would be sued for.

You can go with any generic description "forest fresh", "morning fresh", "fresh dew"... Everything would work. Also, you can add "0% Al" to tagline, something like this:

How could you make a trademark of the words "Super" and "Fresh". That's actually ridiculous just like making a trademark of word "Piano", "Air", "Cooking" etc and suing people around. The words Super and Fresh are not unique and can't be owned by someone. That's a violation of the whole logic idea so they should be sued by the humanity for doing such a stupid thing undermining the idea of the world.

My day job is as a patent and trademark attorney - all that extra language in the letter is boilerplate for a trademark C & D letter. You are right that the attorneys are the ones that win. SUPER FRESH will be difficult to police. BTW like the watch

I would’ve changed the name after I sold all my stock pile, then the new product coming out have a new slogan. Now, as an off topic Alpha: I just placed my 1st order from Pete & Pedro (2 Fresh deodorants, Desperado body wash, hair scrubber & ball powder). IMHO: the packaging was pretty sub par from being a customer of Tiege Hanley. Does it matter?… eh, maybe not but not even having a branded Pete & Pedro box and only receiving a plain old generic white box is, well- pretty lame. Would it kill you to slap a sticker on the damn box to step it up a notch?
the word super fresh should not be trade mark.. I have said this and others and this company should not get the trade mark..

Bought the deodorant. Love it. Everything else I was using was giving me redness in the pits. Just 1 day is all it took to clear it up after switching

10 years ago I would have done what Alpha did. Today F anyone trying to step on me, is my personal feelings that the more you allow people to get away with something like this the more they would do it they would feel entitled and that is something I don't tolerate. But everyone is different.

I'm not a lawyer. I went to paralegal school for about a year. I didn't even become a paralegal. I won't go into the details but I decided to drop out. Tuition was expensive and it wasn't in my favor to succeed. I decided to let go and let God handle it. Vengeance is for the weak. Forgiveness is for the strong. I'm still trying to figure my life out but I'm hoping for better days. 🙃
I learned a hard lesson with cops. My neighbor called the police because he thought my stereo was too loud. I told him where to go, so he called the cops. Ten minutes later, there was a knock at me door and two cops were standing on my porch. They asked to come in and the BIGGEST MISTAKE I'VE EVER MADE was letting them in. Once inside my house, they saw my martini sitting on my desk, accused me disturbing the peace, cuffed me and dragged downtown to the jail.
DO NOT EVER OPEN YOUR DOOR TO THE POLICE UNLESS THEY HAVE A WARRANT! Once you let them in, they can legally do anything they want! I spent the night in jail and when the judge saw my case in civil court, I told her my stereo was too loud and my neighbor called the police, etc. She rolled her eyes, told me the case was dismissed and it would not appear in my records and fined me $25. I moved out of that house the next day!
