  • Hello everyone, not mad... just a little bummed that I received a copyright strike on my channel. Not blaming anyone; I should have known better.

    It sounds like the issue is that since it was the very first performance of the song, it wasn't even copyright registered with YT, so there isn't an option to just block, so PC had to issue strikes in order to take the videos down.

      Yup, it sounded to me that PC had no choice. PC may not the best publisher and not doing enough to market BAND-MAID, but they also don’t tend to block reaction videos. I understand and respect their decision.

    Well, at least now you know it's safer to react to their official videos from their official channel. In Japan, fan cams are a big no-no unless specified.

    I see many people got strikes for the fan cam, too bad. There is a full fan cam for The Warning portion of the performance, and so far, it's up now. I guess we'll see.

      Yeah, Pony Canyon has otherwise been fine with fancams, but this was a brand new song that was likely written and studio-recorded just one or two weeks ago!

    You are 1000% correct about BABYMETAL's publisher. They don't play around when it comes to any unauthorized content. I know because they issued me my very first copyright strike this year over a BABYMETAL fancam I uploaded of their first Canadian concert in over 7 years. I did request a retraction on their part via the contact email RUclips provided, but I never heard back from them. A 7-day takedown notice would have been the nicer path on their part which I would have immediately complied with, but instead they decided to give me a strike.
    Bottom line, don't mess around with BABYMETAL content if you value your channel.

      That's why I made the hard decision to no longer feature BM on my channel, as much as, I enjoy their music. Just not worth all the hassle.

    A couple reactors have sent emails asking for strikes to be retracted and a promise that the video would not be re-upped.

    Hi, Allan. Nice to see your outlook on the whole thing. You’re reasonably disappointed but also understanding of the situation. It's a situation that originated from one person's honest mistake, and it's not worth blaming anyone.

      I chose to be optimistic that once the official video and album is released that they would remove the strike, we’ll see.

      @@FilAmConnections The strikes are implemented by YT and are automated anytime a publisher requests a video removal. There is no possibility of a strike being lifted early unless you hack the system.

    If this is a business decision on Pony Canyon's part, I don't get it. They've already uploaded most of their catalog to the main channel. Plus, as you mention, they are already extremely generous about reactions, even re-postings in a variety of forms. I understand that the song is unreleased, but the fancams are crap and will not deter anyone from purchasing the album or listening to the official release. Is it that they fear someone else can register the digital ID of Show Them and then the "owner" can block Band-Maid's version (which seems insane)? I literally don't get any of this.

      There's not that much to get. Companies have convinced themselves that information isn't free, that they can control who sees or spreads it, and that they have a right to. (When the reality is that copyright is basically a favor we're doing for artists and it was never meant to provide total control, just limit the worst abuses.)
      PC has generally had a light touch when it comes to Band-Maid reactions, but in this case RUclips wasn't going to do anything for them and the only tool they had was a sledgehammer - so given a choice between that or doing nothing, they picked the hammer. And then all the brainwashed, thoughtless, boot-slurping denizens of the internet decided that this was somehow the reactors' fault because they should have known better, or something. Which is funny, because the same denizens commenting obviously have no problem watching reaction videos, even though their claim to fair use is rather thin.
      Ultimately all of this will probably blow over. Was it an overreaction by PC? Probably. Will it scare off a few reactors from making Band-Maid videos? Maybe. Will that affect Band-Maid's growth and revenue in some subtle, indirect, impossible-to-measure way? Who knows. Will it really matter a year or five years from now? Probably not.

      @@chrisbergsten1429 Good points. Still doesn't make sense to me, but I'm probably naive to think business calculus had a whole lot to do with it. It feels more like a knee-jerk or power move. Anyway, everyone's going to survive and thrive, including the reactors who got dinged. Today, we're all like "WTF's up with PC?", but in a few weeks we'll all be happily buying and reacting to the new release.

      It seems insane because it is YT comment section myth.
      Copyright Law:
      "When is my work protected?
      Your work is under copyright protection the moment it is created and fixed in a tangible form that it is perceptible either directly or with the aid of a machine or device."
      That being said, I would 100% take down a crappy cellphone recording of my unreleased work. That's all PC is did. The strikes are YT policy and procedure that I'm sure they don't care about.

      ​@@FilAmConnections Time goes fast. I do have original content, but almost every time I upload the video I get a copyright claim. But it is ok. Thanks 😁 I will get almost nothing, but I don't care, cause I earn money playing mostly classical music and teaching a bit.

    The most important thing for you to do is to file a request of retraction, pointing out that you have not been the origin of the copyright breach but the source that you have been referring to, which was published as a result of poor compliance processes by an employee of one of the copyright holders. Very likely Pony Canyon choose this kind of "nuclear bomb" strike to stop the unauthorized distribution of the material as fast as possible. There's a good chance that PC will not go further but consider retraction because disputing your request and many others will require quite a bit of work form their side.

    some bands live in the past... they have no idea how many people know their work through videos like this... do you know how I discovered BABYMETAL? It wasn't through any official marketing where they spend millions of dollars... but through a 30 second video of a drummer commenting on this band...

    My personal view is that it seems short sighted from Pony Canyon. I know that many people agree with Pony Canyon. But I always think if it was left to them then the explosion of interest in Band Maid and Japanese music in general would not have happened but for reactors and let's face it some unofficial video of the band. However at least you know you are not alone as everybody was punished. Official release of a thirty second clip and no news of any future release other than the music being released on Band Maids album means that once again Pony Canyon miss the surge in interest. I buy the official CDs and DVDs and it is expensive especially with carriage and postage. It is what it is but stopping money going to the bands in the long run as once this interest dies down the instant hit will be gone. Would I buy an album on the back of a thirty minute clip. Doubtful. Still they will release it for streaming on their official site once the time comes. But again is that better for the bands than it is for the company.

      But I think you sort of made Pony Canyon's point: The unauthorized release of a new song created a premature surge of interest before they were ready to release the official recording or music video or cash in on it. I mean, the full song was already on the internet before they were able to publish the edited teaser video! It becomes anticlimactic if everyone is already distributing the song before they can offer it for sale digitally or say “Coming soon!”.
      You're criticizing them for not announcing news of any future release, but keep in mind the song was probably written and recorded just a week or two ago when the Warning arrived in Japan-not enough time to have a marketing plan in place. For all we know, they may have just laid down the tracks but it’s still in the production stage!
      As Allan mentions in this video, Pony Canyon has been VERY open to allowing Band-Maid songs to be reposted, reviewed, and remixed on the internet-and not just the songs themselves, but also overseas fancams and recordings from their Blu-ray releases and online okyujis. The fact that they only draw the line at distributing an unreleased song seems reasonable to me. I don't think any creator would be happy if the same thing was done with their work (For example, imagine if someone finds a recording of a new reaction video and posts it on their channel before the reactor can post it on their own channel.)

      @@archaeopteryx981 These points are well made and true. Problem is by 'punishing ' those that posted it and reacted to it. Pony Canyon has halted the enthusiasm. The release of a possible live video was never mentioned. Many of us paid for the live distribution of the Yokohama concert. They then released many videos from that concert. So we could argue our money was wasted if they released many of the songs officially anyway. I repeat the argument. The wave has gone which leaves a puddle of enthusiasm.
