Current players don't sign anything, they are part of the National Basketball Player's Association, when 2KSports, or any other company, purchases the rights to the NBPA license for the year, they are able to use all of the players within the NBPA. 2Ksports doesn't add those more recent teams because they pretty much cap themselves out financially on the teams that they do have, it's a lot of extra players to pay when you think about it. As for deceased players, some type of Power of Attorney to their estate might sign something? I mean plenty of dead celebrities continue to make money years after their deaths, it's up to somebody to handle likeness use.
