      @@Titadang24 If you have nexus in Florida, whether physical presence or have passed the economic threshold or both, you do need to get a sales tax permit for Florida. It's a state-wide permit, so you don't need to worry about getting a county-specific permit. That being said, selling strictly on marketplaces like Etsy and eBay means that you don't have to collect and remit sales tax, but you'll still need to file $0 returns.     Another great vid Kexin! When you mention that your clients usually use a date in the future to start collecting....Let's say for instance that you get in Shopify a notification asking you to start collecting sales tax in Jun 15th 2024...what date would you recommend to use to start collecting when applying? Thanks for your help.

      You HAVE to register for a sales tax permit BEFORE you start collecting. When you register, you need to use the date that crossed the economic threshold. Then, that is the date you'll use in Shopify. You may be responsible for some uncollected sales tax, but that's better than either collecting sales tax illegally (w/o a permit) or sticking your head in the sand and ignoring it.

If I'm based in Florida, but sell my fax services nationally, would I only need to register to collect taxes in Florida, or would I need to register for each state (seems like a mission)? I would think the payment gateway would automatically charge the appropriate sales tax to each of my customers during signup, based on their billing address/location?

    I was asked what kind of Sales tax account do I want whether it is Corporate income tax or Business Occupation tax. My question will be which sales tax account is more suited and beneficial for a small scale LLC .

      My answer will be depends on an individual performance. I have seen that some corporate income accountants are all around player, who can pick any tax law up and process fast. I have also seen a Quickbook bookkeeper can understand sales tax law and process faster than 20 years sales tax veteran. For a small business, you need a somebody , who has a basic knowledge of sales tax compliance. If you want more tax expert, then look for tax person who has 3-5 yrs sales tax experiences.

    Hello. Loved the information in your video. I have a question. I'm an Florida LLC owner and I'm the the only person listed on the LLC. I plan on selling soap products on my own website. Without knowing any better, I registered with Florida Department of Revenue as an C Corp. I don't know if that is correct or not. I'm sure you'll have to ask some more questions before you are able to answer this for me. 😊

    So how much can I charge the state for the added cost of doing business as the states collection service? Or, is there a business tax write off for the registration, managing, and transferring those taxes to the state?

      Some states give you a vendor collection discount when you file the return on time. And all of the registration and filing cost can be categorized as business expenses which will reduce your taxable income.

    Hello,
    I am filling out my application and the application walks you through a list of multi-answer questions. I've come across this question in the purchases in sales and use tax section and it is confusing and not sure what option to choose.
    My business model is going to be dropshipping.
    The question im stuck at now is:
    For each of the business activities listed below, select all that apply to this location. If none of the activities apply to this location, you must select none of the above in order to continue.
    Option 1) Purchase items to use in my business without paying Florida sales tax to the seller at the time of purchase
    (such as from a seller located outside Florida)
    Option 2) Applying for a direct pay permit to self-accrue and remit use tax directly to the Department
    Option 3) Applying for authority to remit sales tax to the Department for independent sellers or distributors (see Rule 12A-1.0911, Florida Administrative Code, for more information)
    Option 4) None of the above activities apply to this business location
    Any explanation for these options and which one should I choose based on my business model?

    This video is such a life saver! Thank you! I'm in a weird situation myself. I am mainly a drop shipper and I myself do not meet economic nexus in Florida but since my supplier does, they are requiring me to provide a FL certificate or they won't ship there. The only two options sounds like I need to admit to Florida that I have made 100,000 in sales there or claim my supplier is a market place facilitator which they are not since they do not collect taxes on my behalf. I assume that I would just claim to have hit economic nexus in FL then so I can fulfill my supplier's requirement to get the certificate? I am just worried about possible liabilities of making those claims. Thank you for your help!

      Well, the only liability for registering for a permit in FL is you'd have to start collecting and remitting on all your sales there. But it sounds like you can't sell there at all if you don't because of your supplier's policy. And you can register in FL without claiming you've made $100,000. Just put how much you're making.

    Thank you for this informative video. If I have not yet made a sale and don't know what day a customer will buy something what date should I put for date of first Florida taxable activity? I want to get my sales tax id and input it into Shopify before selling

      You only need to register for a FL sales tax permit if you have nexus in Florida. Nexus can be economic if you've passed the sales thresholds ($100K in gross sales) or physical if you have a physical presence in the state. If you do have a physical presence, then the date you put is the day you open your business.

    Is this the same as a stated ID tax (Not a EIN), if you are hiring employees in the near future? Does Florida require that? Everything I search about it only mentions FEIN, and EIN comes up. Nothing about a separate State ID Tax Number.
    I am single member LLC registered in Florida. This is my first year operating and using the EIN officially.
    What happens if you don't do this and just file taxes with your regular accountant?

      Sales tax and income tax are NOT the same thing. Income tax is something you pay out of your income. Sales tax is something the customers pay with their orders, that you then remit back to the state.     hey there, im very new to this and am very confused.
    I live in florida and started a shopify shop using printful as my drop shipping company to print and ship my shirt and sticker designs.
    i wasnt expecting to make any sales but i made about 3k sales in a couple days and im panicking on how to register and file everything properly.
    I'm terrified im already screwed but i cant find anyone to help me. its difficult for me to process information and im due to be in a cancer hospital soon for a procedure and just wanted a simple way to help raise money for my health.

      First of all, I'm sorry to hear about your upcoming cancer treatment. I hope it is successful and you're back on your feet soon. Also, congratulations on your sales. It sounds like you have some really great stuff!
      Second, don't panic. We can help. First of all, how much of your sales came from Florida customers? Remember, you only need to collect and remit sales tax from Florida customers, not from other states because you don't have nexus there. You do need to register and this video will walk you through how to do it. But don't freak out on the start date either. Your sales are low enough that they don't represent a huge amount in sales tax yet. Decide how comfortable with risk you are. You could either back date to the date when you opened your shop and come up with the money or move forward from here and risk some penalties and interest.

    Thanks for the video. Quick question. I have new multi-member LLC registered in Florida and I'm currently filling out the DR-1 but I'm confused on the employee part. We currently don't have any (just me and my partner working on it) but we will eventually depending on how we grow. How should I fill out this part? Or should I say no and just update it later?

      Hi! Not a dumb question at all! E-commerce sellers collect tax by configuring their sales channel's settings. They only need to collect and remit where they have nexus (physical presence, pass economic nexus threshold in certain states).

    Thank you for your video it has been very helpful. When completing the sales tax permit I’d it asks about projected monthly sales and projected monthly taxable sales. What do you place there? Also do you report taxes monthly, annually, or quarterly? Thank you in advance!

      I would put your estimated amount of monthly sales. If all your sales are taxable, then those two would be the same number. And if you can choose filing frequency I’d definitely choose annually!

    Thank you for your videos. You have been a big help! I am using Shopify and their payment processor including credit cards, Paypal, and Amazon Pay, but do not have direct accounts to those merchant card processors (no account number). When filling out my CA seller's permit application, it asks if my business will be accepting credit card payments. Do I put "no?" ("yes" asks for merchant card processors and account numbers)

    Thanks for sharing this video! It really helps a lot. I'm about to register my sales tax in Florida but I'm using a virtual office address on my LLC. We don't have a physical store, inventory, employees in Florida. Does this count as having a Physical Nexus in Florida if your registered address is located in Florida even if it's a virtual office?

    Hi, I have a bit of a complex two part question here about tax and llc registration. For my llc registration I put down a physical business building as the principal address, a P.O. Box for the mailing and for the managing Manager I put down my residential address which I really didn’t want to do so I’m wondering if there is an alternative? I’m wondering if for the managers address can I use the “real street address” that the post office now gives out (it’s the address of the post office then your P.O. Box number changes to a unit number so it now becomes a regular address for deliveries. Example “1 Applegate drive, unit 246, orlando fl” instead of “ P.O. Box 246, orlando fl”. If not, what about using the physical business building address as the mangers address?
    Now with the tax registration for Florida as an llc where it asks for “Business Officer” information can I use the P.O. Box information or the “real street address” from the post office? (Unsure if this has to match the “Manager’s” info on the llc registration). I know all this information will be public so I’m trying my best 😵‍💫 lol. 🙏🏾 Thanks.

    Thank you so much for your videos; they are great and very useful! My questions are: I have an LLC registered in Wyoming, my fulfillment vendor is located in Florida, and all my products will be sent there. To avoid paying taxes to my provider, I need a Tax Exemption Certificate from FL. However, to get that certificate, do I need to register for Sales Tax in Florida? I assume that having my fulfillment vendor in Florida creates nexus with that state. Also, can I use the Wyoming business information to register for Sales Tax in Florida? I don't have any physical location there. Thank you!

      It sounds like you have physical nexus in FL since your inventory is there. You will need to register in FL. Once registered in FL, you should be able to get the exemption certificate you need. You'll use your business information (wherever that is) to get the permit and exemption certificate.

    If you have a LLC this system ask you then if you are a single Member CORPORATION? S Corp, C Corp or do you disregard if you are just one person? Do we put sole proprietor instead of LLC? And do you then become a business officer. Thank you.

      No if you are not making revenue a lot, leave it alone. Monitor how much your revenue grow in each state. If you see business grows, examine Economic Nexus threshold $100K. Its always better to use future date than past date. You take a risk. VDA or retro opens up a new drama. Registation wont take more than a month so a month ahead future date is good.

      @@ZipporahsCrushCosmetics Since you're based in Florida, you already have nexus, so you do need to go ahead and register. The registration requirement is by the next transaction when you have economic nexus, so use a current date and configure your sales channel to start charging sales tax after you've registered.

    Hi, I am a foreigner and I have created llc in Florida now I going to apply for seller permit certificate but one thing is creating hurdle to understand that where business officer tab detail there are two options one is person detail the other is business officer detail. When we go for person detail they require last four digits of my ein number in SSN tab but when we go for business officer detail then they require ein number so please help me in this regard that should I go for in person option or for business officer...thanks waiting for reply

      Based on your situation, you need to determine whether you will be acting as the business officer or if someone else will hold that role. If you are the business officer, select the "Person Detail" option and provide the last four digits of your EIN in the SSN tab. If you have appointed someone else as the business officer, choose the "Business Officer Detail" option and provide their EIN number.

      That depends. Are you based in Florida? If you are, then you are considered to have physical presence there and you need to register before you start selling to customers in Florida. If not, then yes, you can wait until you pass the threshold.

      If you register online, it should be about 3 days before you can access your permit number.

    Hi, I have a question. I created a link through shopify to sell things that I make and anyone in the US can purchase and sales tax will be collected according to the state the customer is in. I am doing this as a sole proprietor working out of my home. What options am I suppose to choose?

      You shouldn’t need to charge tax to anyone except customer that lives in your home state. And make sure to register before you collect.

      Before you start collecting sales tax, you need a permit first. Otherwise you are opening a can of worms. Shopfy wont remit your tax to states. Its just a tool. Once you have a permit then change Shopfy setting to collect ST.
