I'm wondering if the bylaws require owners to have insurance on their units. The damage would then not have to be borne by the plaintiff. I can't imagine that insurance would not be mandatory as to avoid this sort of problem.
sometimes bad things happen to good people - yeah judge but bad things usually happen to bad people and that plaintiff was not a good person because he knew all along that it was not the defendant's fault , and u can tell that by the way he reacted to the verdict , with no surprise at all .
I don't believe the plaintiff. I think he was lying about a lot of stuff. He also tried to make it seem like the defendant did something awful by going to the apartment and asking the tenant, can he see the damage. The plaintiff was just looking to get some free 💰. I knew he wouldn't win the case.

Do you even own a home or an apartment? If you can find a plumber to make an emergency call at about midnight, fix the problem, then come back a couple days later to fix a separate issue and then have someone else come in and fix the ceiling drywall or whatever they use in a bathroom and then tape/mud/sand and paint everything to match for less than $1500.- then have at it. That is not an unreasonable amount of money at all.
Whether it was right over the tub or the whole bathroom, no one wants random, wet drywall falling into their home. Especially if it's somewhere I could've been standing or taking a shower.

It is common in all condos that if the cause of the damage to any unit starts from within the walls, the condo picks up the tab. The plaintiff needs to get a copy of the bylaws.
Again, if defendants would be awarded missed wages for foolish lawsuits being filed against them there’d be a lot less and the courts could move a lot faster…but that would reduce work for the lawyers and judges that the US pumps out like crazy
You're not seeing the opportunity for viewers to learn to avoid the same mistakes. In this case neither party had insurance. On auto accidents litigants who fail to take photos are reminded that their "cell phone isn't just for selfies and naughty photos". Lot's of other lessons learned on TV court.@@eisbeinGermany
Actually there are consequences for bringing a "frivolous lawsuit" inlcuding monetary, contempt, etc. This Judge is an arbitrator so she can't send you directly to jail but she can report a litigant to police, CPS, IRS, etc. She has also awarded lost wages many times. This case was not deemed "frivolous" even though the bylaws vindicate the defendant. Don't feel sorry for him because 1.) The show pays him a $300 appearance fee. 2.) He didn't have insurance on his property which is a mistake because it's not expensive.

There's nothing wrong about what he said. I had my bathtub replaced & floor re-tiled about 6 years ago. They didn't replace the fan or the ceiling either.
That's so stupid because if a pipe breaks from another unit and causes damage to a different unit, figure that owner that caused the problem would be held liable.🤦♂️

That makes 0 sense. If you’re in a parking garage, the floor below your car breaks and your car falls on someone else’s car, are you going to assume liability and pay? NO, because the floor breaking had nothing to do with you, and there was nothing you could have done to prevent it. That’s what insurance is for and the plaintiff should have had it 🤷♂️

At 8:48 the Judge reading the bylaws: "the owner (plaintiff) is liable for repairs unless there is neglect or negligence". The defendant wasn't negligent. It's the correct verdict.

insurance often has exclusions too. not every repair is covered.
