Entitlement is an ambiguous term because it has more than one definition. If you pay into SSA, you are entitled to receive your Social Security checks. However, politicians use the second definition - receiving something you did not earn or pay into. Unfortunately, SSA has parts that encompass both definitions. So, when the politicians decide to do away with SSA, those of us who payed into it may very well lose our retirement because politicians conflate the two definitions.
Awesome comment! Thank you!!
I pray for everyone in the Yucantan that they remain safe during Hurrican Beryl 🙏
Just wait till they get to the Ninth Circus Court 🙄 I'm waiting for them to rule that non-citizens are eligible if they pay into the system.
Non-citizens can already receive benefits if they paid into the system and they are here legally.
It's ironic that most individuals have the impression that it's mainly Latin American immigrants who fall under this. Here on the northern border the majority of such cases that we see are Canadians who legally worked in the U.S. and paid into SSA now claiming disability benefits. And the big hindrance in many of these cases is that they have returned to Canada, where health records are even more difficult to obtain (SSA needs a "current" HIPAA release in the U.S. but the laws are more complicated in Canada) and in which SSA has no examiners to perform physical and mental CEs (I've seen cases of Canadians travelling from Toronto, ON to Buffalo, NY for a CE). Can you imagine what jurisdiction/circuit these cases are to fall under with a patchwork of judge made regulations?
The SSA has been making efforts to make decisions both uniform throughout the country, and in order to balance case loads amongst differently staffed DDSes, to distribute cases so as to decrease one of the true legitimate complaints against SSA Disability, undue processing time. However, there are already decisions made in federal district court that are binding only for certain circuits e.g. AR 97-4(9): Chavez v. Bowen on the Ninth circuit. Some of these have comparable but not identical rulings in other circuits. Overturning the Chevron doctrine is no doubt going to fragment SSA decisions and hinder this effort to "load balance" the processing centers.
If social security would be left for people who worked and not be given to welfare and disability had its own funding there would be plenty for retiree's to have meds, glasses and dental
Sigh...SS is not given to welfare recipients. That is a different fund.
Yes disability is an insurance program.
All of that is already in place for many decades.
@@Savannah-ed4rvlove my disability checks 💯
@@penelope5500 yes they are changing it. SSI is becoming a new welfare.
Great commentary thank you
A lot of people lost their jobs during covid due to Chevron Deference because OSHA COVID-19 Emergency Temporary Standard on Vaccination and Testing required employers with 100 workers or more to establish, implement, and enforce a written mandatory vaccination policy for Covid-19 for their workplace. OSHA used the Chevron deference as the basis for its authority to mandate the experimental vaccine to these private-sector workers. This should NEVER have happened.
Do you think the pharmaceutical companies would have made different rules?
@@MyGovExpert No I do not think they would have made different rules. Pharmaceutical companies are career criminals. They have too much power in Washington. My body my choice, something we hear all the time, should not only apply to abortion.
@@Roxy-qn3myIt's never "My Body My Choice" when it comes to public safety.
@CBDguitar if you want the toxic jab it's your right to take it. It should not be forced on anyone.

I was denied my Ex Husbands SS and we were married 15 years. They said my Retirement from the county is too much. I am 67 and I only get $43 per month in SSI. IS this accurate? I also was granted SSDI, but I never got ANY MONEY for SSDI. PLEASE ADVISE! Thanks

All the rich should pay the same as all others.
@@susanplants9310not sure how your comment applies to this woman’s situation?
Sounds like a bad case of government pension offset.
How is this a step forward? Back to the 1890’s we go!
....yup
I don't think that there are any in the federal bureaucracy who see overturning Chevron as a good thing. Frankly, having judges make laws is unconstitutional. I would expect some group to actually appeal that to the Supreme Court. Secondly, judges are experts but in the law. Even there many judges have a narrow field of experience. Do any family lawyers ever become federal district judges? It's probably rare. And I've never heard of an ALJ for Social Security (there are ALJs in all sectors of the federal government) become a federal district court justice. The tendency is for most of the federal judiciate to have backgrounds in criminal prosecutions and in corporate litigation. No one keeps actual track of it, but I've heard estimates that there are between 1,000 and 5,000 MD-JDs who practice law. And the few that I've known have definitely been rather C grade physicians. Not one has had a background in neurology, orthopedics, or physiatry which is what these days makes up the bulk of the SSA disability claims.
You’ve already answered the question, who decides when the Federal judge gets it wrong. The Supreme Court!
So I retired in 2023 at age 63, started taking survivor’s benefits on my diseased ex husband this year ( married 12 years), just wanted to be sure I can switch to my own at FRA (as it will be more) thanks for all your talks!

Social Security actually told me to call back when I reach full retirement age because I took my deceased ex husband's which was slightly more. They said mine COULD be more by then and I am allowed to switch once.
Maybe things will be better than when every person in Washington wants their hand in it!
Any chance IRMA will be changed regarding selling a home (profit) and wrongful death settlement awarded by court? Neither are result of earnd income…Just your thoughts….thanks Ed 😊
Hey, what is the website for social security to apply or set up account online
Ssa.gov
You need to talk about Project 2025 and the republican plan to end all of these plans.
Just a little correction on your statement that judges pass laws. Maybe you didn't actually mean to say that but only Congress can pass laws, and then they are sent to the president to be signed. Judges can only interpret the law and make a judgment on the lawsuit.
You are correct. They will decide regulations. Thanks, Ed
Wow seems easy to lose heart 💜

65 soon, recv. Deferred retirement from gov., 9 ss credits short...HELP for Medicare coverage. 😢

.Gov has known for years about the massive number of Boomers that would be retiring. The agencies have nobody to blame but their own process. VA is going through the same thing. It will take years for the agencies to regain any level of competency seen in the past. Staffing and service will be terrible for years.
If the Agencies had control over their budgets, everything would be fine. But unfortunately, they do not. Politicians make all those decisions..

Look into ABLE accounts. Funds in an ABLE account generally do not affect eligibility for federally-funded, means-tested benefits like Medicaid, SSI, MAWD etc.
As it should be. Judges will adjudicate the law. This will force congress to fix (or simplify) the laws.
Unless one political party agrees with the decision and then nothing will get done?
To receive widow's benefits, would you also have to be married for 10 years?
No

I have been receiving ssi since 2008...I have Medicare advantage and state Medicade and my
Medicade pays my Medicare premium... every year when we get our cola raise will that eventually stop paying the medicare premium? And I really want to get a part time job..what do I need to know? Do's and Don'ts?
Call Medicaid customer service and ask at what maximum income you could report that they would stop paying the Medicare premium. They have an income table. The limit is online without calling them at their website. Search words would include the name of your state you live in and receive Medicaid from, and the word Medicaid and the word income limit.
That information should also be on your State's DHS/HHS website.
Supreme court made the new immunity ruling retroactive for Trump so I guess retroactive is based on their whim
I never got officially married and I worked for him keeping house so now my social security is 500 month... how is that fair? Some people just don't get married.
