The Employer's Defence in an Employment Discrimination Case

- If you are an employer faced with a discrimination based claim pursuant to the Employment Equality Acts there is a defence provided for in the legislation itself.
The employer’s defence is set out in section 14A dealing with harassment and sexual harassment.
This video also looks at the burden of proof in these claims and how it shifts from the employee to the employer, if the employee can show facts from which a reasonable inference can be drawn that discrimination occurred.

If the employer fails to investigate a complaint of discrimination, does this failure to act becomes discriminatory?
Perhaps, but it depends on the circumstances. Maybe the complaint was frivolous and vexatious. But an employer would have a have a difficult time explaining why there was no investigation, even a cursory one.

What about a protected class approach upper management and HR in good faith about a complaint of discrimination, then the result was adverse action and punishment and firing?
I was so desperate to work not knowing I'd be treated differently,on top of signing a contract. I don't see any employees (team ) during my shift they get replacement with agency work alongside me. Staff onsite with me put me under pressure but manager/supervisor turn a blind eye (out of office ) Unless visits from the higher ups. To put it short I feel like I am slowly being forced to leave. I hate the treatment I get but I can't guarantee a job straight away and this all clashes with homelife, which was also bad to confide with work with my situation.
