    • @urgreatestenemy3044
      @urgreatestenemy3044 Месяц назад +1

Not really true if a person violates a policy they can be removed from the property.
Take the policy of, No Shoes, No Shirt, No Service, where there is no law that a person must wear a shirt and shoes it is in the buildings health code and any violation of the health code can result in you being trespassed from the building.
Now, where the courts have declared that filming falls under First Amendment protection, there are limitations to those protections you can be limited due to Time, Place, Manner restrictions.
For example, outside a library is a traditional public forum we can exercise all our rights to hold a protest yell and hand out pamphlets and reading material and solicit but inside is a different story.
In Kreimer v. Board of Police of Morristown, NJ, an important court opinion addressing a library user’s right to enter and use the library, the court held that because public libraries are a limited public forum, constitutional protection is afforded only to those expressive activities that are consistent with the mission and purpose of the library. A public library is only obligated to permit the public to exercise rights that are consistent with the government’s intent in establishing the library as a limited public forum for the purpose of receiving information and accessing the library’s books, programs, and online resources. According to the Kreimer opinion, other activities, including activities such as photography, filming, petition-gathering, assemblies, and public speeches, may be regulated by the library using reasonable, viewpoint neutral, time, place, and manner rules.
Brown v. Louisiana, (1966). A library is "a place dedicated to quiet, to knowledge, and to beauty." Its very purpose is to aid in the acquisition of knowledge through reading, writing and quiet contemplation. Thus, the exercise of other oral and interactive First Amendment activities is antithetical to the nature of the Library. These arguably conflicting characteristics, at least in a First Amendment sense, support our conclusion that the Library constitutes a limited public forum, a sub-category of designated public fora.21 See Brody v. Spang, at 1118. We thus adopt the reasoning of the United States Court of Appeals for the Second Circuit in Travis v. Owego-Apalachin School District, 927 F.2d 688 (2d Cir. 1991), where the court held that a limited public forum "is created when government opens a nonpublic forum but limits the expressive activity to certain kinds of speakers or to the discussion of certain subjects.... In the case of a limited public forum, constitutional protection is afforded only to expressive activity of a genre similar to those that government has admitted to the limited forum." Id. at 692 (emphasis supplied).22 Hence, as a limited public forum, the Library is obligated only to permit the public to exercise rights that are consistent with the nature of the Library and consistent with the government's intent in designating the Library as a public forum.23 Other activities need not be tolerated.
The Supreme Court established three different types of public forums in Perry Education Association v. Perry Local Educators' Association (1983): traditional, limited and nonpublic.
Limited and nonpublic fourms can limit the use of the public space to its designed purpose, and can even reasonably restrict or limit a person's first amendment rights.
Courts have ruled that filming is subject to Time, Place, and Manner if the place is a nonpublic or limited public forum filming can be restricted.
The debate is filming an expressive activity can a camera alone be expressive this is debatable, the courts have ruled that filming does fall under an expressive activity because it can be used to express someone's viewpoint and can show bias, we all have see the news is biased and can sway people's opinions.
Libraries also have policies that the American Library Association (ALA) have put in place and a libraries Bill of Rights, this the the ALA'S position on privacy.
"Privacy is essential to free inquiry in the library because it enables library users to select, access, and consider information and ideas without fear of embarrassment, judgment, punishment, or ostracism. A lack of privacy in what one reads and views in the library can have a significant chilling effect upon library users’ willingness to exercise their First Amendment right to read, thereby impairing free access to ideas. True liberty of choice in the library requires both a varied selection of materials and the assurance that one's choices are not monitored.
The possibility of surveillance, whether direct or through access to records of speech, research and exploration, undermines a democratic society. One cannot exercise the right to read if the possible consequences include damage to one's reputation, ostracism from the community or workplace, or criminal penalties. Choice requires both a varied selection and the assurance that one's choice is not monitored. For libraries to flourish as centers for uninhibited access to information, librarians must stand behind their users' right to privacy and freedom of inquiry."
So because libraries are limited public forums they can put limitations on our First Amendment rights because freedom of press is part of the First Amendment they can put limitations on our right to film and our right to free speech.
So where filming in a nonpublic or limited public forums violate no laws it can still violate a policy and the courts have ruled that a public building can make policies and have the power to enforce those policies by removing anyone unwilling to obey them.
Where you fall on this debate is none of my concern but I believe it is important to know your rights and just as important to know when and where your rights can be limited, our rights are not absolute and there are limitations to them so it is important to know of those limitations.

@aegisranger Can you be removed from a library if you are speeking too loud and disrupting others is it not our right to free speech and them removing you unconstitutional?
Where you have the freedom of speech that right can be limited in both types of speech and volume of speech while inside a library.
As I said where you fall on if the policy is or isn't unconstitutional, it is important to understand both sides of the debate.
I simply lay out why the library can have and can enforce a no filming policy. I'm not saying the policy is or isn't unconstitutional, until the court removes the no filming policies in libraries or make clear that filming is restricted in libraries I can not say if it is or isn't against our constitutional rights.
As it stands many libraries across this country have no filming policies the reason they can enforce those policies is because the courts have ruled that they are limited public forums.

    • @thefirm9746

@@k.k.9571 I've seen quite a few, including the many videos where the auditor took the ride or did the walk of shame and threatened to take everyone's pensions, and then didn't take anyone's pensions. And I know the law better than you. I've been successfully litigating First Amendment disputes in state and federal courts for more than three decades. Don't give you limited public forum "nonsense" because it refers to protests and timeframe? Are you dense or something? Who the hell taught you that horse crap? Do you really think that RUclips videos featuring some uneducated ex-con or unemployed activist is going to give you an accurate education on the law? First Amendment jurisprudence is a full semester in law school.
Have you not noticed, in your extensive RUclips research, that when auditors post humiliating videos where they are dissed and dismissed, or even arrested, and they threaten to sue everyone, they never post an update bragging about their triumph in court? Do you not wonder why that is?
Johnny Five O (John Paul Olsen, Jr) was arrested at the Santa Barbara Public Library in February 2020 and charged with 3 misdemeanors - two trespassing charges and an obstruction charge. His fans bombarded the library and police department to try to get the charges dropped, but they went forward. He fought the case, filed a bunch of motions, but after losing all of them, he eventually asked the judge for a diversion program under California Penal Code § 1001.95, which allows the judge to set forth terms, conditions, or programs that the judge deems appropriate based on the defendant’s specific situation, in lieu of jail time or probation. After completion the diversion requirements, the defendant can have his case dismissed. Johnny 5-0 was a good boy and completed his program, and his case was dismissed on May 15, 2023. He posted only one update video in which he said NOTHING whatsoever about the progress of his criminal case.
Most of the time, a library is held to be a nonpublic forum. See Crowder v. Hous. Auth. of City of Atlanta, 990 F.2d 586, 591 (11th Cir. 1993). Even if found to be a designated or limited public forum, the outcome is the same unless a rule that restricts First Amendment activities is "irrational" or viewpoint-based. "Libraries have traditionally been used for individual study" so when a Library's policy restricted expressive use of the premises to persons who "furthered the library's educational and artistic mission", it was perfectly constitutional because it is not a traditional public forum. Concerned W. v. Lafayette C. Oxford P.L., 699 F. Supp. 95 (N.D. Miss. 1988). See also Faith Ctr. Church Evangelistic Ministries v. Glover, 480 F.3d 891, 907-908 (9th Cir. 2007) [ban on worship services in library meeting room upheld; because of meeting rooms, library is held to be a limited public forum; government did not intend for the forum to be open for indiscriminate use. ] See also Crosby v. South Orange County Cmty. Coll. Dist., 172 Cal.App.4th 433, 443 (4th Dist. 2009) (recognizing that community college had not established its library as public forum). "Thus, the District 'may reserve the forum for its intended purposes . . . as long as the regulation . . . is reasonable and not an effort to suppress expression merely because public officials oppose the speaker's view.'" (citing Perry, 460 U.S. 37 at 45) See also Spreadbury v. Bitterroot Pub. Library, 862 F. Supp. 2d 1054 (D. Mont. 2012) (patron can be banned for speech that is disruptive and intimidating, but not illegal). See also Brown v. State of Louisiana, 383 U.S. 131, 142, 86 S.Ct. 719, 15 L.Ed.2d 637 (1966) (upholding the government's significant interest in maintaining the peaceful character of a library as “a place dedicated to quiet, to knowledge, and to beauty”). See also Kreimer v. Bureau of Police for the Town of Morristown, 958 F.2d 1242, 1262 (3rd Cir.1992) “[A]s a limited public forum, the Library is obligated only to permit the public to exercise rights that are consistent with the nature of the Library and consistent with the government's intent in designating the Library as a public forum. Other activities need not be tolerated.”
Now, OF COURSE, if the library doesn't prohibit it, you can record. If state or local law allows it, you can record. If someone says you can't record, and someone higher up says you can, you can record. But if the library has a rule against using a camera inside the library, and you think the First Amendment is going to save you if they don't back down, you may be in for a rude awakening like Johnny Five O. Because the jury won't be told that some RUclipsr said you can record and the cop in his video agreed. You won't even be allowed to testify about that. The jury will get instructions based upon the actual law - the stuff you think is nonsense.

God bless the first lady that tried to give you money......i know she'll have a special place in HEAVEN when that time comes, i can't often say this , but the cop was respectful, so kudos to him. hopefully the lady in blue and her friend, and the security guard, and the lady that came out after him, LEARNED SOMETHING!
