    The Prophetic Hadith states clearly the seriousness and danger of Riba "To devour one Dirham (currency) of Riba is worse than committing Zina (adultery and fornication) thirty-six times." [Ahmad and others].
    Another Hadith reads: "Riba consists of seventy-three kinds of evil, and the least of them is like having sex with one's own mother." [Ibn Majah , al-Hakim and others].
    In the West, specifically in Norway, Muslims can get student loans, where some portion of the loan will be converted into a scholarship if you pass the exams, otherwise it remains a loan. On the loan there is no interest as long as you are a student, but when you have finished your studies interest is added to the loan. Is this loan haram?     Great answer by the Sheikh. Seeing this well educated and nuanced answer on this topic really makes me happy.
    I have seen more than enough videos on youtube by self-proclaimed google sheikh, overzealous young brothers, who throw fatwa left and right and say it's haram haram haram. Really shame.

    If it was like an investment contract it would be called that. It’s called a student loan with APR interest rates usually at 1% which increases each year whether you work or not, you will still owe them money, it’s still going to be applied once you earn at least £22,000 which is literally nothing for an income, so everyone will generally pay unless they work part time for the rest of their life.

    You can pay cash tuition fees, interest based loan is not the only option.

    Like he said this is not a typical loan. Just say u take loans for 3 years. So £9250x3 plus £7000x3 maintanenace loan. That's £48750 plus whatever the intrest but let's looks at £48750 for now.
    Intrest means paying more then what u borrowed.
    Now just say ur earning £30000 a year which is £3000 more then the threshold so 9% of £3000 is £270. £270 x 30 years is £8100. So ur still not paying intrest. It doesnt even cover what u borrowed. Intrest means borrowing from a lender and repay above the original amount. Ur nowhere near even paying what u borrowed.

    It is 100% haram. If you borrow X from the government and told you have to pay back X + Y then that Y is ribba. There is no loophole around it. Student loans have interest.

      @@GP-eq3gh I went to uni it is not as great as people think it is. Many people end up doing casual unrelated jobs after their degree whilst being thousands of pounds in debt. Not worth it. Get a skill or an apprenticeship and start work. Then learn How to work toward building passive income streams.

    I appreciate there is pressure on Muslims regarding student loans and their policy on usury. Indeed I love the Islamic policy on usury and wish it is mainstream practice in all of society. However unless there is a change in the law for all, to exempt Muslim students from usury in student loans is discrimination. One cannot combine religion with secular activity. If one does then either the UK is all Muslim, or all Christian or all Buddhist for that matter. It does not work, and cannot work. We are to be accepting and tolerant of each other's spiritual belief, but we are all to be under a common secular law. After all be he Muslim, Christian or Jew, all are to observe the same speed limits.

    But what about his: the government gives you money because you are a student. Your study is done in 1,5 year. When you don’t finish your study with in 10 years then you need to pay it back. Is this haram. You only need to pay it back if you don’t finish it with in 10 years

    I know the sheikh. I always admire his work but I am not convinced that student loan is Halal.
    I have not heard any other sheikh saying the same thing. Majority of scholars are against student loans because terms and conditions clearly state that interest will be charged.

    What is the ruling on HECS-Help? They say it’s interest-free, but there is an indexation based on Consumer Price Index (CPI), so they’re ensuring the value loaned is in line with the value of money in CPI, so we end up by paying more each year than originally loaned because they want to maintain the money’s value...I’m saying it’s haram but no one wants to believe me just because their sheikhs said otherwise, just like the sheikh in this video.

    So what if then I DO graduate BUT I DON'T work in the field that the government has "invested" in me (so I study engineering and then I work as a delivery driver). In this case, the government will still take money from you even though technically their "investment" in me failed and that exceed the salary threshold for them to start taking money from me plus interest. Is this then still classed as a "return in their investment" and is it ever possible for the governments "investment" to fail?
    EDIT: Even if I fail uni, I would still have to pay what I loaned plus interest, so is it now then classed as usury?

    I think most people misunderstood because they didn't pay attention to the conditions he ASSUMED were set at 8:10. Had he said as another condition, for example, "Interest accumulates even though the student is not earning money", Undoubtedly, he would have said that taking the loan is Haram. But based on the conditions he mentioned, assuming those are the only conditions, it is clearly an investment despite it being called a loan.

      What people need to look at is the Shariah definitions. What constitutes as what within Shariah. I myself have no knowledge on Shariah compliant finance and transactions. We all need to look more into that under the supervision of a knowledgeable ustdath In shaa Allah.

      I used to able to pray sunnah fard and voluntary with ease. As soon as I took out a loan, my relationships with my friends and family especially my mother started to destruct and my ability to worship began to diminish, it got to a point where I stopped praying all together and I even shaved my beard, these are things I would have never considered doing prior to the loan. I heard Mufti Menk say that a person who eats interest, his thoughts become possessed by the devil and other scholars say ALLAH wages war with those who eat interest. 5 years later I'm only just starting to pray again but I can barely make the 5 fard and sunnahs are too difficult and as for my relationships they seem ruined beyond repair. Insha Allah Allah forgives me and restores my life.

      @@iboxkhan5599 Brother, ik you might be going through a tough time, but please remember this, never despair or feel like your lord has abandoned you. Remember that as long as your sincere with your repentance to Allah, he will most definitely forgive you, and he is al ghafur, and the most forgiving, for you to say he isn't is a direct insult to him. Allah gives and forgives and we get and forget. For me personally I'm still deciding whether or not to go uni and after watching lots of talks on RUclips, I dont think i would be going:(
      Insha Allah he makes it easy for you, and keep smiling, never despair, Allah will forgive you, and keep praying to him, and beg him to help you and guide you and he will for sure. May Allah make it easy for you ameen. We're all struggling in one sense or another, your not alone.

    Guys I'm not going to UNI yet but get my Student Loan on MARA which has no interest helped buy a Muslim who recommend me take it,
    I haven't went to UNI yet but i already applied for the course and Pay my Money
    Is my Loan that has no zero Interest i take (MARA) is still Haram :(

    If I rob your home and say that I'm just lending money does that mean I'm lending money and does that make it halal me calling it lending rather than robbing?
    And people come and say he never said robbing is halal he said lending is halal. What kind of a nonsense is this?
    Sheikh Haitham admitted that Omar Suleiman from America came up with this notion as he is an expert in Islamic finance. What credibility does Omar Suleiman has? Loan is loan, Riba is riba, stealing is stealing end of story.
    These so called scholars need to go, Sheikh Haitham, Omar Suleiman, Yasir Qadhi. They are trying to change the religion of Allah SWT to please people. They should fear Allah SWT and repent.

      Omer Suleiman says a conventional mortgage for a house is not permissible as it is not a necessity.

    The loan is not an agreement of investment. Additionally, neither can an investment be halaal if the profit is fixed. Moreover, in most cases degree is a waste of time. A Muslim can work many jobs without any degree. The degree is not farz. Thus, student loan or any kind of loan is haraam. Allah knows.

    In new zealand our student loan has interest of it BUT if ure working in new zealand the loan becomes interest free and it is written off aslong as you are working in new zealand. You will need to start paying interest if u decide to work overseas for over 6month. But otherwise the loan is interestfree. Is this halal or haram?

      For as long as it is interest free it should be halal but I have no proof. I just know that interest is what makes the loan haram. But as soon as it requires interest from you it becomes haram so maybe avoid it in general just to stay safe and way from it.

      If so i would contact scholars and research the way to move on. try islamqa and visit your local mosque to see about what can be done.

      This confused me as well but I think it's about the intention and not the name. For example, ginger 'beer' isn't actually beer and is not alcoholic so is technically permissible to drink.

      Mustafa Khan Mustafa Khan but when you are able to pay the loans your still paying for more than they initially gave you which is Ribba, and whether you get hold of the money In the first place or not, it’s is still on your name and linked backed to you, at the end of the day it’s interest whether you believe it or not and it’s one of the biggest sins in Islam so be careful

    I’m initially from Australia and moved to the UK for university. I had to self pay the 30k tuition. I managed to do this by working 2 jobs before I arrived which paid 50% of the tuition and the the rest was paid by evening jobs and a bit of support from family. I’d advise to go through the same route..it’s a gap year to be independent and make your own money. Don’t rely on your parents if you don’t come from a rich family

    If we take student loans, we are not eating up Riba. We are given a fixed amount of money which does not increase with time. The government, however are, as long as you are between a certain age and earn even a decent salery.
    Therefore, surely the haraam is only on the government for forcing its poorer citizens into a position where the government eats Riba off of them? There is no other reliable way of going to university, which may be crucial for a person in persuing the life they need to live.

      @@khanali5421 You still owe them. You agreed as well. Islam takes the matter of debt very seriously and warns against it and urges the Muslim to avoid it as much as possible. The Messenger of Allah (peace and blessings of Allah be upon him) said: “Whoever dies free from three things - arrogance, cheating and debt - will enter Paradise.” Narrated by al-Tirmidhi (1572); classed as saheeh by al-Albaani in Saheeh al-Tirmidhi.

In most countries, operating grants and research grants from the government, and money from endowments cover more of the university budget than tuition.       ​@@staas1737 those are all fine, but you cannot make the haram halal. you can do those things, but you might have to sacrifice, you might have to work harder than everybody else to get to that point. But it's for the sake of Allah, and that is the Jihad. you'd rather go to the bank than go to Allah and make Dua'a and put your trust in Him Alone? What does Surah Fatiha say, we recite it at minimum 17 times a day. Is it in Riba we rely on? NO it is Allah who we rely on Alone!
      Further if you want to be a doctor and engineer then you would have worked hard in high school and gotten scholarships to pursue these degrees. And moreover, degrees don't mean what they used to. The market is over saturated with degrees, people aren't finding jobs after they graduate, so now you're stuck with ridiculous debt that you CHOSE to do when Allah warned against it. Allah destroys Riba and increases Zakat and Sadaqah.
      You do realize Riba is prohibited in all three of the Abrahamic Faiths, it's in the Bible as well.. Jews know this, that's why they dont do Riba themselves but charge it on others. And that's what they were doing in Germany before the Holocaust, you could say they were punished for that. Allah Knows Best.

      1. A key difference between a practicing believer and a non practicing believer is the practicing one is constantly trying to repent and improve himself, so he may be forgiven. All humans are prone to error and evil acts. Even the prophet Musa (p) killed a man in a fight, committing manslaughter.
      2. You can fool the Prophets (p) as they were mere men - nothing more than messengers. The angels could also be fooled as they also do not know nor see everything. Allah is the only one you will never ever fool, as he knows even every thought before we think them.

I went to college when I was 17 and drop out at 18 for allah and I see so much blessings. Allah cleared my debt and interest without me having to work at all. OBEY ALLAH AND HE WILL SUFFICE YOU. it takes time tho allah will test you.

      @@aaminah8385 The differences stem from the circumstances that some people state they are in, since necessity permits Haram.
      no scholar that i know of has stated it is halal outside the necessities.
      these necessities are death(the fear of it if the loan isn't taken), grievous harm or extreme poverty. *where no other choice is available*
      A university degree doesn't fill any of these criteria, and any claims that certain people make regarding student loans not being haram because they are not "standard" riba are false since the contract itself is haram regardless of it's outcome.
      you may not like what i say but this is the stance of all scholars on this issue.
      only you know your circumstances so my best advice would be to contact an actual scholar (no offense to sh.haitham we all make mistakes) and explain the details.
      وَمَنْ يَتَّقِ اللَّهَ يَجْعَلْ لَهُ مَخْرَجًا * وَيَرْزُقْهُ مِنْ حَيْثُ لَا يَحْتَسِبُ وَمَنْ يَتَوَكَّلْ عَلَى اللَّهِ فَهُوَ حَسْبُهُ. { الطلاق: 2، 3 }.
