GlaxoSmithKline (GSK) Fined $3 Billion

  • "Last week, GlaxoSmithKline agreed to plead guilty to criminal charges and pay a total of $3 billion to resolve allegations pertaining to several other drugs, the illegal marketing of them, and the obscuring of clinical data from the FDA. "Today's multibillion dollar settlement is unprecedented in both size and scope," Deputy Attorney General James M. Cole said in a press conference.
    The investigation unearthed at least a decade's worth of physician kickbacks, fraudulent marketing, and various other kinds of legal (and ethical) boundaries breached, though this kind of behavior seems par for the course across the industry: Last year, Johnson & Johnson, pleading guilty to bribing foreign doctors, agreed to fork up $70 million in fines. As of April, Bristol-Myers Squibb has been subpoenaed by the SEC (likely for something similar), and Merck, Eli Lilly, GlaxoSmithKline, and AstraZeneca have said they are also cooperating with investigations, according to the New York Times."

    This story illustrates why any meaningful healthcare reform must severely curtail the influence pharmaceutical companies have over doctor's decisions. When doctors are basically bribed to peddle drugs on behalf of the drug companies, they are no longer doctors who heal, but drug dealers who dispense medication for the purposes of increasing profits, regardless of the consequences to the patient.

    Ironically: The FDA often states that certain drugs are not to be used to treat certain ailments. You missed the entire point of why GSK is being fined $3 billion.

    Usually advair is prescribed for moderate persistent asthma, according to the standard of care. What were you taking was ventolin/flovent, which is for mild persistent asthma. Advair is approved for moderate persistent asthma, which is one step up from mild persistent asthma. The difference between advair and your combo is that it switches out ventolin (short acting beta agonist) with a longer acting beta agonist in salmeterol. Advair contains flovent.

    About 2 years ago, I had a really bad case of pneumonia and I also have asthma. I was prescribed advair and was told not to take my usual asthma inhalers (ventolin and flovent) with it. Hearing this, I am a bit outraged. If it is for MILD cases of asthma, I do not think a person with asthma that has pneumonia should be given advair. Especially being told not to take my regular inhalers..
    We are always told to trust our doctors.. I guess they can be corrupt as well.

    As a medical student who is already a strong misanthrope, I find this sickening. On the other hand, if I was a doctor in USA, I would want to collect as much money as I can, before some patient files a lawsuit for psychical damages or some sh*t like that.

    This report is of vital importance... at least to me personally. Because of not being informed my child died because he was prescribed Advair. He was just twelve years old at the time. There were other and safer medications on the market at the time for his condition. We (his parents) were not informed of them. This occurred in 2005.

    No. This isn't true. I worked for a psychiatric hospital for two years. You wouldn't believe the number of drug rep's that would come. We'd see at least one per week that was exclusively for LCSW's and social workers. The doctors got multiple visits. One of the doctors had almost his entire office filled with free stuff and he only can into the unit one hour a day.

    Speaking as a former employee... I can at least tell you that most of the company isn't like that. I was a scientist... I was part of the team working on Advair for several years. We were doing the work to help people.... never getting chances to "get filthy rich." (That was disgusting...) Scientists don't get to go to big shindigs like in the video. If Advair helps you, take it. Your health comes first... and... generics will be out eventually.

    Government is standing in the way of competition in this market and many other markets, so gov't provides PATENT protection, gov't provides FDA barriers to entry, FDA trials that include not just 'safety' but also 'fitness to purpose' trial cost hundreds of millions of dollars.
    Gov't protects these companies that push all these drugs and gov't creates the Medicare and Medicaid gov't payment programs so that the patients do NOT care about costs and about actual usefulness of their treatments.

    We really have to be our own health advocate and do research on what drugs are prescribed to us. Show that research to another doctor and get a second opinion. It's vital that we understand that health care is a for profit business where money is put above the well being of people so that we stay skeptical about what we are told.

    I was "diagnosed" ADHD as a small child and was drugged up for years and none of the medication ever changed my behavior. I was on quite a few different meds, often 3 or 4 different meds at the same time. I turned 16 and took myself off all the meds and have never looked back. I'm almost 30 now. This happens to quite a few other kids and adults as well. They get brainwashed into believing that they need these meds to function when in reality they do not. All so big pharma can cash in.

    I work in government procurement, and we have all sorts of ethical requirements.No free lunch. We can accept nominal gifts only, like coffee mugs with a logo on it. This makes sense. What doesn't make sense is lack of guidance for doctors. Drug companies, who can tell how much a doctor is prescribing of their drug, are have no restrictions. It's not unusual for the salesman to bring in a food spread for the office to share valued over $100. And don't get me started on freebies for politicians.

    Being a pharmacist and member of TYT nation, I want to state that the reason people died from Advair is because it is not meant to be used during an asthma attack, instead it is meant as a maintenance drug to reduce the chances of an asthma attack.

    This makes me sick! The fact that doctor's would put their pockets before the health and safety of their patients real need is repulsive. I am not blanketing all doctors but the ones who do participate in these fringe benefits should be exposed!

    It's even worse. The company got fined 3 billion but that comes out of the company money, not out of the money of the executives who bribed the physicians.
    If the FDA said that the drug could kill people, I think they should charge the executives with accessory to manslaughter or something along the lines. Throw them in a state or federal prison. The next time an executive hears that one of this drugs could cause harm I want him to scream "No, I don't want to go into a prison shower with Buba!"

    Though Ana gave her testimony that it didn't work for her, the report isn't about whether this drug works for those who actually need it. This report is about how they pushed doctors to prescribe it for off-label usage though the government distinctly denied their appeal to do so. It's about what happens behind our backs. It's about giving people something they mayn't need that can cause unnecessary side-effects while treating nothing and lining their pockets with cash.

    The unfortunate thing is that most of our (American) Physicians have had no ethic's for a long time. I was treated better & cheaper in Thailand and China while traveling last year then I've been treated by these money grubbing American Physicians. I remember my grandmother dying in a hospital bed 12 years ago. There was nothing more to be done for her but the specialists continued to come to make that extra buck off a dying woman. Shame has been lost in this country only to be replaced by greed.

    I take two different SSRIs, neither of which I have near the balls to try and quick because of the infamous discontinuation effects they're said to cause. I and others like me will most likely be on their medications for life because of which, it's almost impossible to discontinue paxil completely once your on it. I have no pity for GlaxoSmithKline and I believe everyone who is stuck on their medication should be financially compensated as most of us went on them before the risks were well known

    In addition to the fines, GSK must also undergo intensive federal monitoring of its activities for 5 years. GSK has changed its executive compensation program to permit the company to recoup annual bonuses and long-term incentives from executives if they, OR THEIR SUBORDINATES, engage in misconduct. GSK may recoup monies from executives who are current employees AND those who have left the company, and sales agents are now being paid based on quality of service rather than sales targets.

    Since corporations are people, GSK should be arrested and tried for fraud, as well as the injuries and/or deaths that resulted from said fraud. If found guilty, GSK should get a long prison sentence. If corporations want to be treated like people, they should be treated like people in every respect, including serving time.

    *sigh* I used to work for them. We scientists didn't get big pay like that....No big fancy trips anywhere ... I guess 'cause we weren't doing the selling. We were just working... trying to discover new meds. I got in the business to help people. OH well... the whole situation is very sad.

    I'm very upset to hear this. Now I'm conflicted because Advair helped me with my asthma. I need it to prevent my asthma from getting worse but I also don't want to reward bad behavior.

    Actually, the fines are just a part of the overall settlement. GSK is now subject to 5 years of intensive federal monitoring of its business and research practices, and has been forced to substantially change its executive compensation and marketing practices to ensure their sales reps aren't incentivised to promote the drugs for unapproved uses.
    Btw: World-wide, GSK made ~$9B in profits last year on the strength of sales of dozens of unrelated products, so $3B is a fairly punitive sanction.

    Do you understand anything about the human body and its immune system?? The anti-biotics were to prevent an infection in your gums, no bacteria got into the wound or some did and were destroyed by macropaghes/white blood cells. This meant that you didn't end up needing the anti-biotics, but you can't tell that beforehand.

    I was given a weight loss tablet by the gp. Ended up in two comas with massive damage to my body, my pancreas, was fed via tube in stomach and at 36 have been too weak to hold a baby. No lawyer will take on my case even after being raped and not being told about tracheostomy. Can’t even ask a question without a lawyer.

    GSK sells dozens of products in the US, and various other products throughout the world. the ~$9Billion profit it earned in 2011 reflects worldwide sales of dozens of products, not just what was earned in the US from the drugs and conduct which is at issue here in this settlement.
    Further, the fines are just the tip of the iceburg. GSK also agreed to change several of its business practices, as well as undergo 5 years of federal monitoring of its business and research activities.

    It's the largest health care fraud settlement in US history. The plea agreement also requires GSK to remove compensation based on sales goals for territories which led to this conduct.
    GSK is required to change its executive compensation program to permit the company to recoup annual bonuses and long-term incentives from covered executives if they *or their subordinates* engage in misconduct. GSK may recoup monies from executives who are current employees *and those who have left the company*.

    ok, i ve never taken an anti biotic, rarely if ever take any medicine,(not had a cold in 6+ years) and if for some reason i am ever prescribed a medication, i will research the tits off it. i had a wisdom tooth extracted and they prescribed me anti biotics, a medicated rinse, anti inflammatories, etc etc. and i never took one. everything is fine. anyone that i ve spoken to that ever took an anti biotic has always told me they regret it..

    the thing about Canada is when someone gets a majority then they have the power to do something that is why we are different from america we actually try and change things but when you change things sometime its for the good and sometimes its bad. but the Harper government isn't as evil as you think my dad owns a small business and his policy has actually benefited him.

    Doctor's should not get perks from pharmaceutical companies, they should not be salesmen pushing products. They should prescribe the right drug for the right reasons. As a side note a lot of drugs have black box warnings but are safe to use. All medications have risks, you just have to weigh the risks vs. the benefits. Also, advair is a good drug when used for the right reasons. Advair has improved my mom's quality of life as an asthmatic.

    Actually, there's a lot more to the settlement. For example, it wasn't based on marketing and reporting violations of just the 1 drug Ana talked about, but for about 8 other drugs, and the $3 Billion figure is an aggregate of fines for several different violations. You can read more about it at the Justice.gov website; just click on the "news" tab, and read the news releases in the "Briefing Room". In fact, this settlement is just 1 in pattern of DOJ crackdowns on big pharma.

    No, in 2011, GSK made ~$44Billion in total sales, with a net profit of ~$9Billion. This, after a few years much lower earnings with some quarterly losses, in addition to billions of dollars in losses due to various other lawsuits and fines. This isn't the first time DOJ busted GSK's balls. So, a $3Billion fine -- the largest in history, mind you -- is actually quite punitive.

    Never had to worry about my health being auctioned off to the highest bidder. Free health care ensures docters work for the people rather than for the money. Just SAYING "privatized health care" makes me cringe. I have seen the Canadian system help so many, I couldnt imagine what my life would be like without it! Many of my friends would be poor...

    This GSK settlement is a big chunk of a much larger iceberg. DOJ has cracked down hard on big pharma and other big medical industry players over the past few years. In fact, this particular action is part of a broader investigation of several pharma companies involved in these kinds of business practices, and those settlements are still in negotiation. This info is all detailed in the DOJ news release announcing this settlement with GSK. You can read all about it @ Justic.gov, 'Briefing Room'.

    I used this for 3 or more years, below the age of 18. While I think it did work, or maybe that was due to aging, I no longer use Asthma medicine at all. But I do believe it did degrade my vision. Which I believe was a warning on the product. I still have some empties around here somewhere~

    If you're refering to cannabis then yes it should be legalized. They're talking about prescription medications used to treat medical conditions here. These type of drugs can have very real side effects and if not used precisely as prescribed can cause death. Recreational drugs like pot and alcohol are unrelated.

    My bet is that that Las Vegas show is for the company's sales reps, not the doctors. Doctors do not sell the drugs, they prescribe them. I think it is illegal for doctors to sell the drugs they prescribe. Drug company sales reps can make unbelievable amounts of money and that is what he was talking about.

While you're there, you'd do well to read the other news releases detailing the multiple billions of dollars' worth of fines levied in all the other pharma and medical industry-related legal actions taken by the DOJ.
