Because Emma beat Evan that night and the police obviously had clear evidence that Emma was the aggressor and abuser that night when they spoke to both Evan and Emma when she was arrested the police documented a bloody nose and bite marks and the police representative that spoke to TMZ and gave statements about this matter also confirmed that Emma was the aggressor and abuser that's why they wanted Evan to press charges but Evan refused.
