This is pretty much my life. Finally got her served with the papers I can’t wait until I finally get some rights to my son.
    Update:
Got the response, she only wants to give me two days basically while she's at work from 7:30-4:30 on tuesday and wednesday. No overnights not fair at all. Pretty much just babysitting him
We have a Court date on March 2 im preparing for
submitted my financial disclosure and completed the COPE class required by the courts today.
Update 2: went to zoom court and judge ordered 3 days a week visitation. The judge was cool and I finally had my first full day with my son.

@@justinthematrix You have to stress that:
-She's not allowing parenting time which is abusive towards the child
-She cannot work with you on an equal footing and will not see you as an equal parent (won't inform, communicate etc.) Not putting the kid first.
She's not looking out for the kid.
With someone like that you will have to request Orders in writing and have them enforceable. It's going to be a while before things are made right. Pack your patients. It's a slow game.

Interesting. My child's dad meets all of these criteria. Haven't seen my daughter in three months. When he took her from me the first time for a month, I got her back and she was asking me "where mom??" he then came over for a visit and hopped out of my bedroom window with her. I ask to see her daily, or even for a picture and he won't give me any of it. Thankfully yesterday I was able to get an address of where he is to have him served. This made me feel a lot better. I know I'm doing everything right. He wasn't an active part of her life until I moved to the city he lives in in order for him to be in her day to day life. Ended up biting me in the ass but I had to be able to say that I tried.

    • @freakishlypeculiar
      @freakishlypeculiar 2 года назад +9

@@raboc7702 I got her back after 5 months. At the temporary custody hearing, (via zoom) Ex mentioned a "suicide attempt" that happened years ago while I was suffering from Post Partum Depression. I have not ever made an attempt since. So the judge started yelling at him asking when all of this happened and if it was recent and he could not answer with the truth. The judge then told him to be quiet and asked me to clarify what's been going on and to address what my Ex was talking about. So, as it turned out, my mic had me speaking in slow motion. Judge then has Ex speaking for me in court because for some reason, my Ex could hear me but the judge could not make out what I was saying. Judge then ultimately granted Ex full temporary custody because of my issues with my mic and him having no idea what was really going on. Fast forward several more months, we went back to court and I was able to explain everything. Judge granted 50/50. My ex did not get in trouble for withholding or any abuse done to me during and after pregnancy. Despite me showing documented proof of his abuse towards me, the judge pretty much said we're too poor to go to trial and granted 50/50 custody in April. "Co-parenting" has been a nightmare. Almost immediately after the decree was signed, Ex got locked up twice. Once for a misdemeanor Domestic Violence Simple Intimidation and then again shortly after his release, for Felony Domestic Violence by Strangulation and again for first degree kidnapping of his girlfriend (the felonies were dismissed). Mind you, our three year old was in his care during both arrests and has witnessed him be abusive to the girl. Now CPS is involved and are telling me to withhold or I will get in trouble for Failure to Protect while my court order still says 50/50. I have tried to take him back to court but he to this day will not provide me an address (he was homeless/jobless upon his release from jail) So I am going the long route and trying to take the necessary steps to have him served again to Modify custody. I've done a 15 min session with the courts lawyer through the ask a lawyer program and pretty much laid out what's been going on mainly because I am paranoid about losing custody for technically breaking a court order and she too has told me to withhold. So that's where I'm at rn. Have daughter 100% of the time, have zero help with childcare and still trapped in this city. I would still like to move back to where I have actual family support.

Been at it for years without an attorney and I have gained much respect for the task a lawyer has. It is a stressful process when you don’t have an attorney. My only hope is that the courts understand that I have been filing documents for years and fighting to have more time with our children. I pray for the parents that fight to be a part of their children’s life. I see why most parents don’t want to deal with the stress of not knowing how to fight this battle in court. Most parents just leave and abandon the whole situation because it can become unbearable. Till this day I fight and will continue to do so until I am given sufficient time to be a significant part of our children’s life. I encourage parents to be as cordial as possible when in these types of battles and find a way to get along for the children’s sake. May God intervene and help families in distress.
    Thank you for helping families

Child custody/child custody battles - very sad when parents 'fight to get possession' of their children. Children are NOT inanimate objects - they are human beings who share the DNA of both parents. Doesn't matter what the parents think of each other - their children will want to have a relationship with each parent. If you're honest, you'll acknowledge the damage, confusion and devastation that you cause your children when you try to prove that you are the better parent. The only winners are the lawyers...put your differences aside and do what is best for your children. Time goes by so quickly...if you're jerks when the kids are young, then they will cut ties with both of you as soon as they can. 😐

Great video! The judges don’t have time for bickering and false allegations. I had a custody battle during my divorce to determine child support. I had my Dr sign a document saying I was unable to work at that time for an illness and my x husband’s attorney tried to rebuttal that with “Do you walk your dog???”
I guess he thought I was going to say of course I do!” But I really didn’t walk my dog because she was a 120 pound Mastiff. But I’m glad I saw where he was going with that. Very smart to be prepared! Have everything in writing! Dad’s.... get a report card, school photos, hand outs from their Christmas concerts, photos of baseball or ballet recitals, dates, times definitely years! Make it easy for the judge! Save the jealousy , false allegations and your x paying for his new girlfriend’s boob job! Please,,,, talk to your friends about that over a coffee! Not in the courtroom!

This video help me a lot. My story is so sad, because i met my daughter when she was 5, because the mother had put a retraining order on me, when I was 17 and she was 15. Over the 13 years my daughters Mom and her aunt and her grandmother been putting me thru the most stress.
I love my daughter I never harm her, I went to parent class that the courts send me to. I even had got full custody at one point, and I kept my daughters family around, I would never keep her away from her family. In July 2021 I let her spend time with her family and I never seen her again. They said she went to the police and lied I hit her. I never hit. Even writing this to you is making me so depressed. Yes They are even saying I touch my daughter witch is not true. They called Child protection service on and even DHS. Now they have a temporary order on trying to keep me away from my daughter. I miss my daughter: I wish this wasn’t like this. I even gave my rights up because I’m tired of fighting it’s to much I just lost my mom last year, it’s to much. The story even went viral. The aunt post it on fb of my daughter crying, I got death threats and everything, it’s to much. I can’t even afford a lawyer so I’m going to court alone on 1-11-2022

I’m 16 years old and right now my mom has custody of me, but I want to live with my dad. I haven’t told her yet, but I’ve told my dad. I really want to live with my dad and he’s a good man, good job, good education, and has great manners. My mom I’d say is very spiteful and childish, she always forces me to take her side even though she’s wrong most of the time. One time she even slapped me because I didn’t take her side. At her house, there’s always someone yelling whether it be my mom or my older sister. It’s very frustrating living with my mom. My dad makes more money than my mom so the child support I guess helps her. Would the judge allow me to live with my dad if I want to? Is there a way to do this as fast as possible like just going to the courtroom and telling the judge I want to live with my dad?

At 16, you are luckily old enough to have a few choices legally!
Some of your choices are dependent upon the State you live in, but the first thing you can try is to ASK your Dad to petition the court for full custody of you. Without this, nothing will change (legally). It's the appropriate jumping off point, because the two of you will need to strategize together to make this transition successful.
You can call the courthouse yourself (family court division) and ask for a 'guardian ad litem'. This is a person dedicated to YOUR best interest. They aren't on your Dad's or Mom's side or paid by either one of them! They are just for you and given by a judges in situations like yours where an agreement can't be reached between the parents. They exist to protect YOU.
Another way you can go is to petition the court yourself to become legally emancipated. Emancipation means you are no longer legally controlled by your parents, but YOU now make the adult decisions that affect your life.
I believe there are other legal choices too, but I think I gave you a good start here....do your research and and make a phone call to your courthouse ASAP.
Keep in mind that each of these choices brings a set of legal requirements you will be responsible for. It will take time, especially in this pandemic. Also, there's bound to be some hurt feelings. You need to be ready for that and NOT REACT in any way that could jeopardize the courts ability to see you as an adult. You are going to have to be strong and smart.
I wish you well. It can't be easy in your situation, but you aren't without resources. Standing up for yourself and your rights and desires doesn't make you a bad daughter or love your parents any less. It just makes you a strong woman and ultimately, that should be any parents goal: a strong daughter that knows her worth, advocates for herself and sets healthy boundaries!
We can't always get what we need from our parents. But nothing is stopping us from getting what we need for ourselves! Good luck. 🙂

Depends on the state you live in whether slapping is abuse or a legal form of punishment that will decide if mom can or cannot get in trouble legally for a slap i don’t know the entire situation either and children shouldn’t be involved in adult matters anyways so parents on both sides shouldn’t be a talking to their child about their adult issues it sucks that kids even have to worry about this stuff

I live in the state of Texas and I just recently filed for joint custody because I be having my daughter half the time. My normal days are Monday through Thursday and she has my daughter Friday through Monday morning. She hasn't let me see my daughter in two weeks, she got upset with me for 2 reasons because recently things went sour on my job that I had been on for 6 years and I asked her could she go on half with me to pay her auntie for keeping our daughter every week and she refused. So on my days to have her I took my daughter to my mother whom lives 3 hours away to keep her while I find a job. She and her mother came and got my daughter from my mom and I haven't seen her going on 2 weeks. I called I text and I also had the police come out and do a welfare check. So I filed a petition for joint custody and her lawyer called and said I beat him filing a petition. I don't have any money for legal representation what should I do when we go to court?

I paid child support for 21 years in NY. The first thing I told my lawyer when I moved out was keep me out of court. That's the last place you want to be. I wrote a support check each week from day 1. It took over 3 years before I was before the judge. My lawyer did a great job. By that time I had already established a track record of paying each and every week. Of course she wanted more money. The judge awarded her another $25.00 per week. Keep recipients for every dollar you spend on your child. You will need them later. Do not be in a hurry to to get before a judge. It will cost you money. Pay every week like I did. What's the hurry? All the judge sees everyday are fathers that don't pay. In your case you will have been paying from day 1. Your the good guy. Stay out of court. If the lawyer tells you different. Change lawyer's. No matter what your ex will blame you for everything. Get used to it. Your kids will be fine. That's because your paying each week. At some point she will want to remarry. Let her hire the lawyer. Whats the hurry? That costs money. I didn't divorce for 6 year's. So what! Didn't cost me a dime. Remember. Don't panic. If you get served papers. Hand them to your lawyer. He will push that court date out a long way. They can't garnish your wages without a court order. That's your lawyer's job. Don't panic. Keep paying each week. Let the time slip by. Don't be the fool that's in a hurry. Every time she calls her lawyer it costs her money. Not you. The first thing the lawyer will ask every time. Is he paying support? Of course you are. You have every receipt. He will call your lawyer and that costs her more money. She will get tired of that real quick. I love the idiot lawyer's that tell the woman that the husband's always pay the lawyers fees. I never paid a dime towards her lawyer. I didn't hire him. She did. She spent thousands and got nothing in return. That's because I paid from day 1.

I assume you mean interrogatories and if you haven't been advised that this is not okay then the Judge will when you get to the Final hearing. Deposition is an appearance to be deposed/asked questions. Interrogatories are questions sent to you where you send written responses. It's impossible to cover all of the many different fact patterns, but if you're in court about this now, that tells me that the biological father filed a Legitimation case (which tells me he's pursuing a relationship. There is nothing wrong with step parents, but in Georgia the Judges do not like when step parents are called mom and dad over the biological parents. No one is taking away from step parents, but this is well known with custody attorneys that this is not accepted by Judges. Best of luck to you and make sure you follow your lawyer's direction.

It's an 1,100 mile drive one way. She has fought every attempt for him to be a part of the kids lives, She has told the kids horrible lies about him and his family ( me), She has made false allegations to the court, CPS, the police, Doctors, counselors, therapists, friends and co-workers. Also Parent B doesn't drop off or picks up child to school , stepparent does all the time or occasionally Parent A4. Can a Parent A lose custody if they try to take child's out of school during Parent's B custodial time, because Parent A wanted child to attend a school that went against their school agreement.5. Can custody be awarded to Parent A if Parent B doesn't make reasonable decisions about child's future or doesn't try to be involved in making decision on child's future because they are always too busy, but still refuses anything Parent A proposes.7.Can Parent A get primary custody if Parent B doesn't spend their custodial time with child at all because of working late on weekdays8. Can Parent A get custody if Parent B suffers mental illness( depression, borderline personality disorders, bipolar etc...)and even though Parent B is not on treatment or going through a crisis the mental illness still might be affecting decision making or being impulsive when upset and/ or uses marijuana(not medically ) to self medicate in a state where marijuana laws haven't kicked in yet.

My child’s father wasn’t involved. Didn’t want to be in my sons life for 2.5 years. My boyfriend has raised him since he was born and his first word at 6 months old was dada. He knows my boyfriend as dad and did it on his own. 2.5 years old his bio showed false desire to be in his life and is demanding he calls him dad and my son refuses to.

I understand this can be hard, but if his actions have changed and he's showing that he wants to be a Father, give him a chance to be. I think it's great that your boyfriend has stepped in to be a Father figure, but the Judges here in Georgia frown upon children calling someone other than the Father "father" when there is a father. Again, I completely understand your position.

@@TerriHerronLaw I agreed with everything except for this point. I do believe a child should know who they come from, but anybody can be a biological father . Top be called, "Dad", is an earned title. If a woman's husband (and I say husband, NOT boyfriend) becomes the one filling that "Dad" role because bio dad doesn't want to, then that's bio dad's decision and that will be something he will have to deal with the rest of his life (this goes for both sides). Any state can frown upon that all they want, but it depends on the relationship in household. No state can control that.

@@ericmalone4032 I totally agree with you! The five mistakes are based on child custody cases. So, this video would cover Dads who are trying to be part of the child's life. If bio dad has abandoned his interest, then so be it and let step dad step in and be called dad, but if there's an active dad, I think it's disrespectful for someone else like mom's boyfriend or even husband to be called dad, but only if bio dad has abandoned his opportunity. That's such a special title to me! Thanks for your comment. I love to see things from different perspectives and especially from the viewer's perspective.

jessknotty that is something you can bring up, but depending on the situation the Judge may give it little weight. If the person was arrested 7 years ago on a charge that has nothing to do with the child being harmed it would likely not carry weight. Also, when it comes to temporary protective orders, they can be granted for one of the parties but not the child of the parent feels likes the child has not been harmed or threatened. My niece has been through hell for almost 12 years. Dad hates mom and is spiteful towards her with every movement that he takes with his child. Now the child is hurting and doesn't want anything to do with dad. Its heartbreaking to see the pain this child goes through. He is told he is a kid his feelings don't matter. He is told he is the way he is because of mom. Mom pays for everything. And you are so correct. The children will always see the truth of who their parents are and which parent takes care of them.

Loved everything about this except when she said not to let a child call a step-parent “dad”. I think that is 100% up to the child as to what they want to call a step parent. I understand not letting them call a new boyfriend dad but come on. I grew up in a divorced household, and my mother re-married to a man who was more active, involved and supportive in my life than my biological father. They were together for 13 years. I called him by his first name, and my brother called him dad and I see nothing wrong with that. He was a huge part of our childhood, and helped us in more ways than our actual father could. Nothing about having a step father and being able to call him dad has to be confusing as long as you communicate effectively with the child, and let him decide what they would like to call them.

As always, I welcome well thought out comments and questions and let's be honest, this is not one. If you're new to our channel, please review our website and other videos to understand why we mainly speak to the fathers. In the State of Georgia, if a child is born out of wedlock, the Father has no legal rights and no custody rights. Therefore, most of the experiences from our firm is from the father's perspective and we also give moms' perspectives as well. When you understand the video in the proper context, you understand why we address certain things the way we do. Also, some of the tips reference and apply to both parents. That being said, you've obviously not seen our brand video to hear my story and why I fight for fathers. I would encourage you to watch that. Lastly, there are plenty of videos that address what you need in youtube world. I would advise that you find your tribe and let them impart in you, because if this video doesn't answer your question or fit your spirit, don't waste your time. Quickly find your tribe and best of luck to you in finding the answers you definitely need right now. These videos are not consults, if you have specific facts, just pick up the phone and request a consultation with one of our top Atlanta child custody Attorneys or ask your question in the comments so that I can make a video addressing your concern. Sounds simple right? It really is that simple. Freedom to choose is an awesome thing. Try it!

I do find your states parental status situation interesting.
My comment was meant to highlight the fact that you were infact probably more likley to provide legal consul/aid to men as they are...
Iam not sure what they are. I have never been able to justify the idea that men are worse guardians.
(Previous claim is supported by the fact that women are more likey to take custody in many states and nations.)

My name is Christopher Cruz and I watch your RUclips channel which I have enjoyed and collected a lot of information regarding family law. I want to share my situation with you and your community and get your professional advice.
About 15 years ago I separated from my partner due to our differences leaving my daughter five years old. She kicked me out of her parent’s house and said she didn’t love me anymore. I beg her not to make that decision but was unsuccessful. As soon as I walked out that moment, I had made up my mind not to return and regardless of the outcome, I was going to start a new life. Know, that this decision was made after seeking counseling, we were going nowhere. 3 months later we both find out that she was pregnant and that I was the father. She used that situation to let me know that she wanted to start all over again, but I was completely done with her and was not having it. I didn’t have any feelings for her anymore. Our relationship was very toxic, and it was getting very dangerous, I was already losing control and the last thing I wanted to do was to put my hand on her.
We tried to keep it out of court and tried to have an agreement, but as soon I got with another woman all of that went out the window. There was no written agreement between me and her. She started to use the children like pawns, for example, if I didn’t give her money for child support, she was not going to let me see my children. Everything went down the hill when I lost my job and was not able to provide child support payments. I couldn’t take or see my daughter for a long time, almost 5 months until I decided to take her to court. I submitted all the paperwork and filed it. Skipping all that trial at the end the court removed the child support because I was on food stamps and cash assistance. We had 50/50 custody, share vacation, holidays, and alternate birthdays. She was furious that the Judge had ordered the child support removal.
15 years later, now married and she too. My daughter now 19 years old has moved in with me and going to a community college. My son at 15 years old still lives with her. At times she tries to control my daughter and make her feel guilty that she decided to move in with me. Still, till now I haven’t paid child support, but I have helped her with what my son needs. My daughter moved in with me, I pay for full medical for both and living expenses for my daughter as car payments, insurance, cell phone, and dental, and give her 200 dollars for her personal needs as long she goes to college. The problem that I’m having is with my son. I haven’t been able to do the same for him. But whenever he needs something, we split it in half or she pays for it or I do, just depends on the situation. I now have a total of 5 kids, 3 with my current wife of 14 years and 2 with my previous, we never married.
She lives in downtown LA, and I live in the high desert area, about 1hr, and 45minutes from LA. Due to the travel and time management, I don’t see my boy that often, I pick him up when I can or when he is not busy with sports. But it’s a constant problem with her that I don’t spend the time enough or she says that I don’t love him the same as my daughter. So, it gets me angry, and we get into it again and again.
Now recently my boy is graduating from JR high and wants me to be there, on the other hand, she doesn’t want to see me and that I don’t have the right to be there. Because I haven’t provided for him as much. She tells him that I don’t love him and to see the difference in how I treat my daughter and him. She tries to manipulate him into hating me because she doesn’t want him to leave her as my daughter did. When my daughter was younger, she had set the responsibility of taking care of his brother. My daughter was molested by a family friend, on her mother’s side and had to seek counseling. Also dealing with the situation in her mother’s marriage which also has problems. She moved in with me. My daughter already knows how manipulated her mom is, she does not hold back and tell her how she feels. Only that mom accuses her that she prefers me over her and that she messed things up by moving in with me.
After talking to mom, I stated that it was not fair to my daughter and son that she puts them in a situation where they must choose between us both. It was not fair to them and the only thing it causes is more hurt and trauma. She said that she was going to fight in court over my son and for the back pay of child support, even though the court decided 14 years ago.
My question to you is, is this possible? What can happen and what should I do to prepare? my son convinced her that he wanted me there at his graduation and that he wanted to spend his vacation with me. She was not happy but, in the end, she agreed.
My wife says that I don’t bash their mom or express hate comments to my kids, and they know that I’m not a bad father. That’s why regardless of how she feels toward me the kids still look for me.
I have crazy hate text messages from her, would I be able to use this in court? If we ever had to go back.
What are your comments? Thank you for your time and if you post a video let me know.
    Sincerely,
    Christopher Cruz
