    I don't understand why it isn't a felony for violating the order. They should at least get 10 days in jail.

      I know I’m California and can qualify as a misdemeanor or a felony and the maximum punishment is four years in state prison and 10k fine . Check your states penal codes for Parental Kidnapping!

    My best friend had 77 police reports of his daughters mother not showing up. He would call the non emergency line and have the police show up to where the location was and get a report with the court order in hand. He got his daughter at the court date.

      What do you mean he got his daughter at the court hearing? Did he get sole physical custody?

      @@RASAAH777 he was awarded full custody at the hearing. Her mother was also put on child support. He never fought or argued with her. He just texted, showed up, got a report. Over and over again. When they went for a review after three years. He asked for full custody, with those reports the judge granted him just that. It was supposed to be only for a year but he’s had his daughter this whole time.

      @@hustlengrind8833 That’s what the father of my child and his mother try to make me look unfit higher to having custody order. I was supposed to have my daughter today for Mother’s Day and the father of my child did not follow through with what we planned as per court order

    I have a court order to see my son every week, I have sent emails and also used an organization to help be a mediator to make the visits possible. It’s been 4months an no reply. Until last week the opposing party threatens me with contempt and says I’m the only reason my son hasn’t seen me. I dot. Really have the Attourney fee to pay but decided to miss my mortgage payment this month to pay for the Attourney I know it’s a long shot but I’m praying I can win time with my son again….     I’m glad I found this video. I’m in Oregon. The mother of our child is in contempt. I haven’t been given my parenting time as written in the order of the courts. I checked off every box you just listed she is in contempt. I got an attorney today. I filed the contempt motion myself to save money. The lawyer was ok with that. I just need her help in the courtroom not with the paperwork. Thank you for this video. Sharing this information for free. People pay thousands for what you just shared.

      @@stunna9010 Justin lost custody of his kid. His wife proved to the court that he was a junkie. He had track marks all over his arms, legs and buttock. He wanted to see his kids only to pay less child support.......sike!! I lied!!

      Shes hit the wall. I’m going to enjoy destroying her in this case. If not, I have her work and home address and know where she frequents and so honestly in the end, I will win regardless 😎. These things affect your personal life and their professional lives. Until it affects their personal lives and they stand to lose in a major way they won’t stop. The best weapon against tyranny... is tyranny. Whether by affidavit or 2nd Amendment, I’m not losing this case lol. Unfortunately these people won’t stop until it gets real for them. Until they come home to a front door open and they know they locked it that morning, they will feel immune to what they’re doing to Black Fathers. I and many like-minded Fathers I’ve met are willing to go places they simply won’t and can’t. If it comes to it this is how you have a guaranteed win. Self preservation is everything. The point at which it becomes apparent to them that it is in their best interest to be fair and respectful and to back off of Good Men is when you get justice. Unfortunately to make that happen sometimes this stuff has to come home with them. It’s easy for them to leave it at the office. As Fathers we don’t have that luxury, so you have to reciprocate that and make your remedy akin to their survival, professionally and otherwise. Self preservation rules the world. This is a paycheck for them. So It’s fitting to make them pay for everything they do to you, one way or another.

      This guy isn't wrong, and it isn't just black families... Guys! If you are watching this video you're a good dad! You're trying to find direction. The court doesn't care, the judge just wants to hurry through their calendar, and the lawyers are just collecting cash. Who the fuck gave the court the right to decide the best for your children?!? Look, I'm a man who knows the mother of my kids loves them, but she is nuts. Her mother was bat shit crazy and even though she loves our kids she doesn't know how to, but its all she has. I don't know how some people afford to even fight in court, most of us are ignorant when it comes to credit and how to afford 4k retainers when living week to week. Women get free attorneys, they just say he called me stupid and now im emotionally damaged, and they get help from domestic violence centers.. but if you are a man who is beatin by his wife, guess what nobody is going to help you. There isn't any resources for men, only women. I dont understand why a simple divorce and 50/50 custody seems so irrational to so many. I shouldn't need to hire an attorney, im already paying court cost, the judge should be able to listen to what I have to say and not in lawyer talk, they get paid well enough to do a good days work, and the real right thing, also only judges who are parents themselves should even be considered in a family matter. If you dont have kids yourself you don't know the undying power of love for them you have that tears apart your insides when they are stolen from you and kept from you. Makes it worse when you have been through the courts, fought and lost. and then the plaintiff doesn't follow the order and the local law enforcement says they don't want to get involved in a family matter... Man just to be able to be a daddy, tell my kids i love them every night, teach them everything I know, help with homework, be there every time they need you is and has been one of the most difficult things iv ever had to do, and not because I cant, but because the system has made it so easy for all those rights to be kept from me when the mother gets vindictive.. Im not down to go and attack any lawyers or judges or anyone because of this bullshit, I just want it to stop. It needs to change, 50/50 should be default unless one parent is proven unfit. you should have to fight to prove someone is unfit, not have to fight that you are. If someone isn't a good parent it would be an easy court case... Ma'am that made this video, by chance you read this comment, I just ask myself, if you truly care about fair parenting, what are you doing to change the bias culture of not just Georgia, but of our country. I hate people want to make this about just black fathers, this is happening to all of us, I work 40 a week, dont drink, dont smoke, dont do drugs. Being a dad was my vice, and probably they were my only weakness. No man, of any color should be denied his children.

    I have a contempt action in play now. My s/o will come to the exchange place weekly but will not leave the exchange area after the child gets out of her car and comes to mine. She records the entire event every time. My child will come to my car , refuse to get in, and walk back over to my ex's car. Sometimes 15 or 20 min aftrer showing up at my car. My ex says the court order doesnt say leave the area. The order says that I pick up after school from the school. My ex would normally not be there if it weren't for COVID-19 and home-school. Her bringing my child to the exchange place (school) , then sitting there recording the events tells me that she is staging and /or condoning my child not getting into my car at exchanges. My ex, after letting my child re-enter her car will then leave the exchange area and that's it. No exchange made. Every week for two months this has been happening and I have 2 more months to go until the hearing. This is alienation , interference with parenting time/ custody etc. but will the judge do anything?

      That is messed up. See if you can go for sole custody so that you can avoid that future non sense. Im thinking i need to go for sole custody if this is how they act.

      Make sure you are recording also and making notes about what happens at each exchange.

      You could also install a camera in your car and make sure you have very good audio with a wind screen to reduce background noise. You may want to have a third party photograph both of you amd make sure their phone has GPS turned on to prove you were at the exchange place.

    Good luck with the judge actually enforcing contempt let alone your custody order. Had 17 contempt charges against my daughters mom. She kept her from me for 8 months. I was not allowed to call also. Judge made me drop all charges and threatened to hold me in contempt. If your a father prepare to have your "rights" constantly violated, and be prepared to pay thousands of dollars for a court order tgat nobody will enforce.

      I would gladly share my case with you. Im in pennsylvania, not georgia tho. And no facts were left out. Thats truly what happened. My attorneys know it also and have fought for years. Ive went to the judicial comittee of pa and all got thrown out because of the tender years law. I wish i was kidding but sadly im not

      Mine she eliminated me for 9yrs, I’ve been paying SC and when I filed contempt, they thrown it out and made me file modifications. WTF? I have evidence of chasing her for 10yrs. Fuck the LAW.

    I live in indiana and my sons father hasn't let me see my son in long time and I pay my support. I can't call off work because I'm a single parent and have my daughter to care for. He has custody but he keeps him from us and I've had enough. I've had to call off work nd I'm getting ready to drive out there now to file thank you

    Yes I needed this because my case in nc is crazy. There’s a lady that no relationship to my grandchild trying to get this baby. She is in contempt of all orders and she really insane. And the laws down here are behind in time. How does a child just be given to someone who’s not the parent???

    Also tip the coParenter app allows you to track/check in your location...track finances allows you to make agreements, talk to a live coach or mediator etc .. great app

    I just served my sons dad for modification
    He’s violating court order
    Keeps kids on school days and child has learning disabilities, won’t sign child’s passport
    Keeps him extra days and keeps changing his weekends and ruins my weekends if I say no it’s my weekend he will threaten me 😶

    Thank you for sharing. My husband's child mother took their child to Costa Rica (during a pandemic) and refuses to tell him when she plans on returning from Costa Rica. It is frustrating because she hired a lawyer and the lawyer is telling my husband that he can no long as her or his 12 son when they plan on returning from Costa Rica.

    The court order says that I have rights to visit with my daughter every other weekend. I was visiting with my daughter faithfully for 8 months straight until her father told me that my transportation can no longer bring me to pick up my daughter anymore . He said that the judge signed off on something he wrote or his lawyer wrote for him saying the person that takes me can no longer can bring me to get my daughter . So he knew how hard it was for me to get back and forth to see my daughter with him living in another city. And after that I wasn’t able too see my daughter for 8 months because he stated that the lawyer or judge signed off on a some paper work . I was trying to video chat with my baby tons and tons of times but father refuses every time and said that the reason why he went download it is because he don’t use it. So he also didn’t allow me to visit with my daughter because she didn’t want to come back with me. That’s because he wouldn’t allow her to video call me in between time I tried and tried to keep in contact with her yet and still nothing so I went to the court house on 07/25/2023 I asked is there any agreement or any type of court order saying that my transportation can no longer take me to get my daughter but they couldn’t find anything stating what he had said.

    I’m in Texas :( I’m the custodial parent and he took off with my son. He’s done this for 3 years to me. I haven’t seen or talked to my son in 3 years now. I’m still trying to fight for justice. My son is 10 years old now and I can’t find a attorney that will take my case :(

      Most State legislatures would prefer that you stay or be married before making a child. Laws regarding you seeing your children are based in your failure to marry or stay with the person you made a child with. The government is only making laws to account for alternatives that shouldn't have happened in the 1st place. They prefer that you marry and then have a child and do all you can do protect your marriage. I'm not taking up for America, just letting you know that certain laws are made because you and the mother of your child couldn't figure it out.

      You can, but you don't want to tie up law enforcement with this. Take a time stamped picture or purchasing something to gain a receipt allows law enforcement to focus on other things. Also, most won't do an incident report on this. It's their choice.

    The judges have way to much power! Need to be 50/50 automatic! Like KY. Their should not be any jail time 4 contempt in divorce matters on any temp orders! Only until a JURY have looked at all the evidence! This change needs to go on the Ballot! 4 the People to decide!

    Be nice if the judge made my ex pay my attorney's fees. I haven't had our kid since last December. Takes me to court because they doesn't feel sorry for" me anymore. They want more money for them and supervised time for me. Saying i "abuse" our child. They mention a specific day, which they called the police for a wellness check(which i recorded) police found nothing wrong, cop even said "oh it's one of THOSE calls" rolls his eyes and left. My ex is the vindictive type.

      Judges normally do order Attorney's fees if the offending parent is found to be in willful contempt. Keep in mind that an of Attorney's fees is discretionary. I've had people tell me that they were denied Attorney's fees and didn't have an Attorney! I know it seems like common sense, but if you don't have an Attorney, you can't get an award of reimbursement of Attorney's fees in a contempt case.

    My ex just recently filed a motion with domestic relations court to hold me in contempt for only one child, we have two children together. He stated in the motion that I have restricted or denied visitation and calls. The kicker is he pled guilty in criminal court for attempted child endangerment in regards to the same child. The judge ordered him to take anger management, two years probation, and supervised visitation. After that hearing his contact with the kids stopped until right before he filed the motion. He missed both kids birthdays during that time. No calls saying I'm at the police station or calls in general for months. Once he filed the motions he is now calling the children and texting them. I believe our parenting plan needs to be revised. But trying to hold me in contempt while I'm about to give birth is crazy. Also in the divorce decree we were supposed to follow a phased in system due to the pending charges at the time. I have requested days and times to see if it works with our schedule for months.

      You are absolutely correct about needing to modify the parenting plan. In a situation like that, it would behoove you to file immediately, but if he has not completed the transition period has ordered, you may have a good defense.

    What exactly is a OPEN visitation with 48 hr notice to the other parent?
    If every request is denied for 7 months except one time for 1 hr, would that be in contempt?

    Let person A violated a temporary court order and person B filed a motion. However, before the hearing date, the temporary order got dropped or changed by another one. What would the situation be like?

    Impractical judges don't enforce till the 3rd 4th or 5th contempt each time you loose valuable time with your child best thing to to is to modify for a court ordered email so the times they miss can be confirmed other than that fathers get used to the target on your back in juvenile court.

    Mom got served to not leave the county. Mom moved 4 hrs out of state and hasnt let me see or talk to my kids in 33 days. Court hearing coming up. Mom is now being a narcissist spreading around I sexually abuse my kids. Which isn't true. She moved for a Boyfriend. What are some things you've seen from Judges to fix this issue? She got my kids out of school and moved away from family they grew up to. She's been ignoring mandated mediation who will do abuse screenings as well.

    What if I have primary physical custody and the mother is in another state and refusing to give me the child? She made claims and Filed a protection order, it got dismissed, still refused to give the child back and then made the same claims with dfcs which is a jurisdiction issue and I think a court order overrides dfcs since dfcs shouldn't be able to get their own court order based on jurisdiction but I don't know. I want to drive the 1400 miles to get my kid. She's missing school. Police here told me to go up there and show the law the papers. It's just an issue of getting the law to enforce it since it's a civil matter. Hate to make the trip and not come back with my daughter.

    I thought this video was very informative. I am in the process of filing contempt now. I have the paperwork that was drawn up by an organization I paid. Are you guys able to help me actually file and serve the other parent? I don't live in the the state where my son is, but in our parenting plan it states I am entitled to having contact with him via phone/facetime. She has changed her number and does not allow me access to him. I have not seen or heard from him in over six months. She only emails me one liners when I ask to see him "he is doing well". What can I do?

    May I ask if I can file for contempt of court order? My ex husband took the phone(the phone I pay for and I gave to my daughter to use so we can freely communicate with each other) for 10 days now. I didn’t know that he confiscated the phone until the 8th day, I texted and calling my daughter and I didn’t get any response until I found out on the 8th day that he took the phone without informing me or asking me permission to take it away. I’m in VA and they’re in HI. The court order says I have a freedom to contact my daughter at anytime(except if she’s at school) everyday if I want to. And for him taking the phone away, it’s like he took away my daughter and I’s right to communicate with each other. Is the alienation? Do you think I can file for contempt of court order against my ex husband? Please answer me. Thank you

    Hello, I am in Pennsylvania and my child’s mother has kept my child from me for all of COVID. With that said, she is now trying to take his Auxiliary Benefits from my, just recently decided, SSDI case. She is in contempt of our shared custody order and is claiming to be the sole custodian of him. That is a lie. She is sole custodian because of deceit and tricks. She has lied and manipulated him since the day we separated and she still is. I don’t even get to speak to him on the phone. He has one, but I have not heard his voice in a year. Do you have any advice?

    What if they are using a “gray area” in the order, by order stating reviving parent pick child up from school but other parent is saying because there is no school anymore(due to virus) they withhold ?

      There should be a time on your parenting plan. We are currently in uncharted territory with the Covid 19. I would recommend using the same time school with recess or resume as the time. The Judge would expect common sense to be exercised and make sure you always place conversation in writing so you can show the Judge. I hope this helps. Without reviewing your parenting plan, this recommendation would be just a general recommendation. Make sure it doesn’t go against anything that’s in the plan.

    Very good advice. My ex denied me visitation recently. He has also refused to use Our Family Wizard which is in our court order. I have complied by using the program, but he never reads any of messages. Is a Motion to Enforce or Motion for Contempt difficult for a pro se litigant to prove. I have the order, certified mail I provided him notice, but he never responded. In response I submitted an interference with child custody with the police officer. I spoke to an attorney who told me that I can actually go in front of the judge and present the evidence as it is not difficult. Is this valid?

      Lisa Jones, Thank you for your question. I recommend getting an Attorney. It doesn’t have to be me, but you need an Attorney. If you’re in the State of Georgia, your ex has not been properly served based on what I read above. You must serve someone in Georgia with a Sheriff or Private process server. Your case is subject to dismissal if he’s not served. It doesn’t matter that he’s aware of the proceeding, he has to be properly served. He can always acknowledge service, but there needs to be proof of service. Lastly, it’s a motion for contempt. A motion to enforce is a different proceeding which doesn’t apply here.       Let me clarify. I want to file a motion for enforcement because he denied me visitation and refuses to follow the custody order. I have not officially filed any of the motions with the court yet. I was just curious if it is difficult to file the motion in court and have him served. The attorney I spoke with inferred that it was not very difficult to file a motion to enforce in the court. I hope I was able to clarify.

      Document all communications and missed dates including there excuses. Contact your local DA to aid you in enforcing the order become best friends with that DA keep there number and email info on stanby at all times and send copies of your order in advance. If he continue to violate the order even after warnings from the DA! Then you will have more potent options to pursue your goals. . Fyi im not a attorney just 13 years of getting fucked my the family court system in maintaining access to my children . Good luck .

      You don’t necessarily file a contempt action for that. However you could modify the visitation, and perhaps seek sole managing conservator and have visits at your discretion.

    Here's my problem I have no way to contact him he's changed his number moved without giving me the address. So I have no way to contact my son at all. He's supposed to let me know his doctors if he have sports games anything. He has completely cut me out of my son's life gone completely against the court order. I haven't been able to see or talk to my son in 4 years.

      Do you have a visitation order in place when it comes to seeing your children? If not, try to find a "pro bono" lawyer that can help you with this if you don't have the funds for it.
      I'm a male and going through almost the same situation although she never straight up said, "I'm going to mess up your relationship". She's doing that on her own while claiming our child is distressed because I'm taking her to court.

    It's the same in texas but my sons father took him and moved and denied me parental rights. The lawyers told me it would cost me 25 I to start a contempt case and I've not seen my son in 6 plus years because his father is a pos sob and I have 4 other kids I cant justify 25k taken away from them just for one.. any ideas?

      Um I understand how you are feeling because I myself was a alienated parent. lets be real here okay if you haven't seen your ids in six years then you just wont be seeing them. my younger child was 4 years old I have not seen her throughout her up bring. My older daughter found me at age 18. Those first 2 months were good being around her but she was not the same as i remembered her. There were times she was loving and we had some good laughs spent the days together. She stayed with me those 2 months until her boyfriend came into town.It was the last time I ever saw my daughter face to face. When she moved with her boyfriend to another state. We were in contact once in a blue moon. Whenever she call or facebook me it was wanting money! My daughter had her problems on top of her bringing up things before the divorce happen. My daughter admits she helped her father lie in return she got whatever she wanted even Disneyland trips! I stopped talking to my daughter for awhile. When she was 23 years old she contacted me again. The contact was off and on despite everything she told me. I still helped her out when I could do it. as for my other child I will never see her again in life. My older daughter told me her sister believes what they told her about me. Foxes farm I'm sorry about your situation. I have been there and my visitations stopped my ex-spouse moved then the parental alienation took place.my advice to you is to move on with your life. It wont be easy but everyday will get better.

    I have a daughter that is 16 haven't seen her since March. It's court ordered by the judge. The grandmother claiming it's covid 19. The last time I talked to my daughter was July 26 and I haven't seen her since March. My daughter said she wants to wait till covid 19 is over but I honestly think the grandmother is holding my daughter against me. What do you think I should do? I tried to call no one is answering my phone calls nothing it's getting frustrating.

    Good info. What happens when you’re a mother who is trying to honor the days the other parent has come up with but fails to meet their end? There are excuses and even no call, no shows on the agreed upon days. Sometimes the communication comes in later in the day before pick up time. Since you cannot force a parent to honor their side, this isn’t a case of keeping the child away from the other parent. Then when my schedule changes due to extracurricular activities, the manipulative parent has an attitude. I wrote them to even talk about modifying and keep a day that works. A dull response and voluntary ignorance. So what to do? Just go back to court. I’ve done my part.

    I went to court to get visitation to my daughter. She is 16 now. The grandmother has custody of my daughter. She was bringing her to me every other Sunday for 2 hours, but now she is claiming due to covid 19 that I can't see my daughter and my daughter is saying she wants to see me after covid 19 is over. It hurts this has been since March. Recently I talked to her July 26 on phone. I only spoke with her a couple of time's this year but never saw her. They are avoiding my phone calls now and not responding back to me. What should I do?

      If you have a Court Order, you should still be able to see your daughter. You should file a contempt if you're not being allowed to see her. Court Orders should still be followed. Even when the shelter in place order was active, there was a provision that specifically stated that Court Order visitation should still take place.

Now I can't even talk to her. I know she is 16 and will be 17 June 7. Its just been since March when Covid 19 happened everything went downhill. My daughter and I spoke July 26 for a hour but I called on my birthday August 9 and no one picked up the phone and still no return. They refuse to give me my daughter cell phone number. I only have the house phone and which they screen their calls. Surely they did not go out of town if my daughter is afraid of Covid.

      You don't have to have an Attorney, but if you don't, the Judge will likely only give you make up time which is not harsh enough to deter the offending parent. If you have an Attorney, the Judge is likely to order a reimbursement of Attorney's fees. If the offending party is forced to pay your Attorney's fees because they are held in contempt, they will likely be deterred from continuing the behavior. If you are only granted make up time then they will feel like they got away with the behavior and will continue refusing parenting time knowing that the Judge is only likely to give you make up time because you chose not to have an Attorney. #attorneysfees #contempt

      No. There has to be an order in place to violate an order. However, keep in mind the many courts having standing orders that apply to your case when you file it.

      Yes. Some Judges will not force children of certain ages to go visit. Some will say that the children are not in charge. Some will say that you have brainwashed the children. There was a 14 year old before one of the Judge's in Dekalb County who witnessed his mom being taken away to jail for her repeat refusal to allow visitation. Department of Children Services came to get the child per the Judge's order. The Young man cried and begged that his mother be released or that he be allowed to call an Aunt from Florida to pick him up. Both requests were denied!

    My 14-year-old son has been kept from me for over a year now during this time his father brought him to a firing range and taught him how to use an AK-47 they took photos posted them online the child was suspended from school since that the father has cut off every possible way I can have a connection with my son including not bringing him for visitation not bringing him for therapy and the judge is still allowing it, The school board suspended this child for aggressive behaviors and I am being denied the right to parent my child the Family Court system is absolutely assisting this abusive parent by allowing the child to stay with the abusive parent. I can explain this to the general population they get it they understand it they're outraged by it but you speak with an attorney you go in front of a judge there's nothing we can do he's 14 years old he doesn't want to come to your house as the dad teaches him how to hate

    The fact that joint custody has been awarded to both parents shall not preclude a court from finding that one parent has committed the crime of interference with custody as provided in Section 13A-6-45, or has violated the Uniform Child Custody Jurisdiction and Enforcement Act as provided in Chapter 3B of this title.
    Section 13A-6-45
    Interference with custody.
    (a) A person commits the crime of interference with custody if he knowingly takes or entices:
    (1) Any child under the age of 18 from the lawful custody of its parent, guardian or other lawful custodian, or
    (2) Any committed person from the lawful custody of its parent, guardian or other lawful custodian. "Committed person" means, in addition to anyone committed under judicial warrant, any neglected, dependent or delinquent child, mentally defective or insane person or any other incompetent person entrusted to another's custody by authority of law.
    (b) A person does not commit a crime under this section if the actor's sole purpose is to assume lawful control of the child.
    The burden of injecting the issue is on the defendant, but this does not shift the burden of proof.
    (c) Interference with custody is a Class C felony.

      I been dealing with the same issue with my wife's x boyfriend he's been able to violate the order with only a slap on the hand on top of a extreme biased judge. In my experience I strongly urge you to do research. There's tons of info on how to deal with a narcissistic asshole. My advice get a attorney. If u can't afford it look for low fee or probono attorneys thats available near u. Use his narcissistic ego against the parent wen you create a parenting plan! Make surec its detailed and understood that it will be enforced by the district attorney if violated !!!! Narcissistic people usually find ways to justify violating the order so make sure the order is bullet proof so when the time comes wen you gather enough material to go for contept then go for there head!!!! Good luck be patient be vigilant and especially well informed !!! . Fyi the district attorney contact info should be in the order itself!!! Become best friends with that DA get the numbers and emails asap!!! With extra copies of your order to send to them in advance !!!!!!!

    Hey merry Christmas 😞 we have a new court order from Feb 2021 the courts gave me more time and physical custody of our son he almost 11 years old in July and his dad has been running and not answering door to be served so I had to hire a curator to represent him next month court is Jan 2022 I had to hired another curator last year to represent him as well what can happen next month ?? I’m from New Orleans La I want to be The Domlicary parent because his is not coparenting with me I don’t know our son school address or phone number his dad said he’s not telling me please help me I haven’t seen my kid in almost 2 years!!!
