In CA (and likely in other states as well), the Statute of Frauds ("SOF") requires that all real estate agency or brokerage agreements be in writing and signed by both parties. Failure to comply with the SOF renders the contract invalid. [Cal. Civ. Code. 1624]. Verbal contracts do exist, but not in this context.
