China sentences Canadian to death for drug smuggling

A Chinese court sentenced Canadian Robert Lloyd Schellenberg to death for drug trafficking on Monday, January 14. The case further escalates China’s diplomatic conflict with Canada following the arrest of Huawei CFO Sabrina Mengin Vancouver in December 2018.
Canadian Prime Minister Justin Trudeau expressed extreme concern about the Schellenberg case, accusing China of “arbitrarily” applying the death penalty.
Schellenberg was initially detained in 2015 for smuggling methamphetamine into China and was sentenced to 15 years in prison and fined 150,000 yuan (US$22,000).
The 36-year-old former oil worker appealed, maintaining that he was framed.
In the unusually swift retrial, the Dalian Intermediate People’s Court determined that his first sentence was too lenient.
The retrial was ordered only last month, just weeks after Canada arrested Meng Wanzhou, a top executive of telecoms giant Huawei.
The death sentence now must be examined and ratified by China’s highest court.
There are also cases pending against two other Canadians arrested in China on charges of “endangering national security”.
He should have just gone to china and surprise chinese girls by speaking fluent mandarin and upload it on his youtube channel and he'd be getting millions of views and making money like how all the white guys are doing that now

I live in Canada and I will be honest. This guy knew what's coming. China's laws are their laws. Canadians shouldn't be telling them what to do. Smuggling drugs is a serious crime all across Asia and around the world.

Alot of people know that East Asia and Southeast Asia has one of the strictest laws about Drugs. If you get caught, you would likely to die.

China routinely sentences Chinese nationals to capital punishment for drug smuggling, which is a severe crime. 3 Chinese people were sentenced in November the same year. Them not sentencing this guy to capital from the get go was a show of foreigner favoritism and leniency, which they put aside at retrial.
I think they were referring to the retrial part. Originally it was going to be 15 years then suddenly they did a swift retrial and it became the death penalty.

For those guys wondering why China implemented such a restrict law against drug. There is a long history of shame, slaved, slaughtered history that all started with drug. Hundreds of millions families suffered from drug and we finally realized it has to be stopped

Glazed Donuts the Chinese wants her back due to a matter of face and honour, and to prove to the Chinese elite that China is able to protect them. On the other hand this helps in keeping Chinese capital inside China as people will stop investing in foreign countries. It is also a good story to keep the Chinese public’s attention away from the trade war.

This guy Robert Lloyd Schellenberg is no saint. He deserves a stiff sentence. He has had a long history of doing drug trafficking since 2003.
In 2012, a Canadian judge Neill Brown told Schellenberg he was lucky for being a Canadian before sentencing him to two years in jail for possesion and trafficking of cocaine, heroin, cannabis resin and methamphetamine. He promised the judge he would change to get a lighter sentence but never did. Soon after his release, he did it again in China.
Even his own father cut off relationship with him for his repeated drug offenses and criminal history. He just never learned.

He was let go easy to reflect on his actions and change but he clearly doesn’t seem to care about his actions and the effects he has on others. There's a case last year when a Malaysian flight attendant was caught red-handed smuggling millions worth of heroine into Australia and sentenced to a mere 9 years behind bars in Australia. To a certain extent it certainly ruined her life, but boy was she lucky to be caught in Australia and not her home country Malaysia, otherwise she'd be hanging by the noose before long most definitely.

You cannot complain about penalties of not following the rules in another country. You travel there and broke their rules. Thankfully they have strict rules it help keep their country cleaner than others.

Agree, in my country it's pretty well known that these drug dealers give these stuffs to youngsters in a form of candy to make them get addicted, they they will start selling them once they've got addicted. Which prompt parents to tell their kids to not accept things, especially food, from stranger. Poor kids who live on the street tho, they're the easiest target. Most of them hv parents with little to none education bg and probably living a harsh life themselves, so... yeah...

Because it is. The guy was originally sentenced to 15 years, but they changed the sentence to Death on appeal. With the current row with Meng Wanting, it's not illogical to draw connections.
I'm Chinese, he won't really die because most death sentences get a reprieve, but he'll probably be in prison for more than 20 years

Don't understand why people are feeling sorry and pleading for a career drug trafficker whose actions have ruined lives. He should have known the risk in a country with a tough stance against drugs.

@wy123 no, never did drugs either. However, I had an associate who passed away from taking coke that contained small amount of fentanyl and that caused his death. Everyone was telling him to stop doing coke, he didn't listen. He wasn't forced to take the drug, yet he went out and got it himself. Now he's dead. Selfish person, leaving his kids behind, his brother who can't get over his death, and many other people that were really affected by this. So, my conclusion is that drug addicts are selfish.. period.

The Office of Enforcement Operations and the foreign country make the final determination on a Treaty Transfer. Several factors will determine whether or not an inmate is eligible, examples include:
The inmate must be a citizen or national of a foreign country having a treaty relationship with the United States. In the instance of inmates who claim dual citizenship, it will be the responsibility of the inmate to provide proof of citizenship or nationality for the foreign country.
The inmate must not be committed for a military offense.
*The inmate must not be sentenced to the death penalty.*
*The inmate must not be committed for a political offense.*
Mexican inmates who are serving a sentence exclusively for Immigration Law Violations are not eligible for treaty transfer consideration, unless the sentence is absorbed by another current sentence and the time served to date is equal to or greater than the sentence imposed for the immigration offense.
Mexican inmates must not be serving a life sentence.
The inmate must have at least six months remaining on his current sentence at the time of his request. (Certain countries may require a longer period).
Which is pointless anyways since U.S. doesn't have a PT treaty with China.
Follow the law of the land. Just because smuggling drugs sentence in Canada is 3 months or suspended sentence, that does not mean the world has to Follow
