Which one is correct? can you please specify, I plan to file myself AAO appeal as my immigration attorney screwed it up for me.
Both are correct, it says the same thing. In an appeal you can not add evidence about facts before the original filing date. You can include evidence you had not submitted previously but that evidence cannot refer to something that happened before your priority date . So imagine you had an award you did not provide evidence for in your original submission (but was obtained before the I-140 was filed), then you CAN include that evidence. If the award was granted after you filed your petition, you CANNOT include this evidence in an appeal

Hi… my case was reopened for reconsideration yesterday before decision, uscis received my RFE response 24th January, but yesterday my case change for case was reopened for reconsideration, do you know what mean case was reopened for reconsideration? Thanks 😊
Only time will tell! Unfortunately USCIS notifications sometimes are hard to interpret. Hopefully it is a good indication that they will issue the decision soon (positive I hope!). good luck

no sé que es IOE. Pero si hablas de eb2 NIW, ahora mismo están tardando entre tres y seis meses en resolver casos I-140. Evidentemente, situaciones específicas pueden variar

Hi Oscar, we received a denial notice yesterday, but the reason provided is not acceptable. They claim we didn't respond to their request for additional documents back in 2022. However, I have proof in the form of a photo of an online update from USCIS indicating they received our documents before the due date. The due date was Feb 15, 2022, and the online notification showed they received the documents on Jan 18, 2022. We plan to appeal our case, but do you foresee any chance of success? Have you encountered these types of errors before?
i think we in the same boat. my fiance visa was denied. it dont make sense for me to appeal since after all additionl evidence for them to give me waiver they did not consider pandemic and taking care of parents as valid reason to meet the beneficiary. i think its better for you to apply for a new application since the appeal cost more than the regular application. its 675usd the real question is how soon can we apply for new fiance and spouse visa after the 33 days appeal time frame passed.
2nd question is, If the baby born right after the approval of EB-2 case, how can share the details of baby passport and and how to pay her visa fee for EB-2
