He can be tried federally as he was in the process of committing a federal crime of entering this country illegally. He needs to be tried and put on a federal death penalty case.

You don't restrict someone's breathing like that unless you intend to kill them. The prosecutor said that Ibarra killed Laken BECAUSE she was fighting him and was resisting his attempt to SA her. But him setting that cup of alcohol down, immediately restricting her airway, dragging her into the woods tells a different story. Ibarra set that drink down rather than tossing it into the woods because he planned to SA and kill Laken and then go back and finish his drink. He absolutely deserves the death penalty.

Each state has it's own penalties for every crime. Some states have the death penalty while other states don't.
