  • The plaintiff purchased a car from the defendant. She says the check engine light came on as soon as she got home, and then she found out the car needs a new transmission and hybrid battery. She claims the defendant refuses to take the car back or pay for repairs, so she’s suing for her money back. The defendant argues the check engine light came on because the plaintiff put cheap gas in it. He says he doesn’t owe her anything.

If the system allowed salespeople, cryptocurrency sellers, traders and others to sell their products and get away with it if people don't get contracts to get rich .....     I have a 2006 hybrid with 210K miles on it. I've never used premium gas. The check engine light has never come on and I've never had any problems. AND the tech at the dealership said that regular gas is fine. I'm calling BS on this scammer of a "car salesman."

      I've owned Acura cars for the past 16 years, they all require premium fuel. I've put regular fuel in my first 2 when I couldn't get premium fuel, the check engine light never came on, but both times it drank that gas like it needed water and was stranded in a desert it also did not have as much power. This happened in my last 2 TSX cars, they normally got 30 mpg and with regular i was lucky to get 15-18 mpg. Contrary to what some people believe, the manufacturer is Honda but those drive tranes are not the same as Honda cars, but that hybrid didn't need premium fuel, anyone putting premium fuel in a car that doesn't require it is wasting money.

      Correct. I put 365,000 miles on a 2001 and never had one problem with it. But I bought it from a dealership and not some street corner salesman.

      Its literally in the owners manual that the 05 Accord is designed for 87 gas.

      You can get a car without any major problems for $1,500. The key is to have the car looked at prior to handing over the money and taking possession of the car.

      I bought my son's 2001 pickup truck for $1500.00 and it has ran great for 2 years. Put 87 in everyday. Just know what to look for.....

      This comment hit different, I will never understand why people buy cars with over 100k miles and expect no issues. Especially if it isn’t a car known for lasting that long like Chevy, GMC, Toyota and/or Honda.

      She kept trying to push the whole "I said 'I hope I'm not buying a bad car' and he said 'No the car is great!'" as if that's proof. She didn't do her due diligence. When you're in court, your need paper, not just words.

      Shoot! I paid 2200 for my first car and drove it for 5 yrs only ever replacing the blower motor, outside of oil changes, and breaks 2.5 yrs in. That's only one, out of many used cars I've bought for no more than 2,500. It takes time and patience when buying a used car. You have to do your due diligence or live with regret.

    I bought my first car for $600. A 1990 Buick Regal GS with over 220k miles on it. Started everyday and ran until I sold it 2 years later. Didn't put a dam into it besides regular maintenance items.

      That was back when cars were quality. I just had a 08 GMC Yukon xl that ran until 275k miles. Just got rid of it in 2023.

    He definitely rolled back the odometer. So he sold the vehicle under false pretenses and submitted signed documentation to the government with the wrong mileage. That is FRAUD and would negate the sale. JM should have either given her time to prove it. This can easily be done by looking up the VIN online. Takes 9 seconds on carfax. If JM didn't wanna wait 9 seconds she should have kicked the case back to the real courts.

    It amazes me how so many people don't know that lemon laws don't apply to used cars...in most cases. That law is meant for new cars, it would be insane for them to apply to used cars, you have no idea what has happened to a used car...a car fresh from the factory on the other hand, should be in immaculate condition.

      @LightThatCigar in this state (Louisiana) lemon laws only apply to a used car within 1 year of the original delivery date, which almost never happens, the original owner typically still has the car within that time. I just bought a new car 2 months ago in Texas, I was given lemon laws disclosures in my owner's manual, just like in my last 4 new cars, my last 3 new cars have disclosures for all 50 states and US territories. None of the states give protection for used cars unless it's under the manufacturer's original warranty, not even California. I had a persistent issue with my first Acura and called Acura and requested a full refund of my car, client relations told me to go into the nearest dealer where they gave me a loaner and kept my car for almost a week to not only fix the issue but go through the car with a fine toothed comb. Please give some examples of when lemon laws apply to a vehicle that is not under the manf original warranty and you'll surely teach me a lesson.

      @@namnack I said in most cases, you should read up on the law, my last 3 new cars provided lemon disclosures for all 50 states. I have no clue what you're talking about, under very limited circumstances lemon laws could apply to used cars and those standards are slim, almost every one of them requires the car to still be under manufacturer warranty, including states like California.

    I just can't feel bad for adults who act so cheap and can't be bothered to take the time to spend $200 for a licensed mechanic to look at the car before you spend thousands of dollars buying it. Loose $200 to check it out or possibly loose THOUSANDS? Seems like a no brainer to me🤷🏽‍♀️ Edit to include: for those crying about no one can spend for a mechanic on EVERY car, i didnt say EVERY car, but a 13 year old car with over 100 THOUSAND miles on it and u dont get it looked at and Buy it anyway ( from THIS suspect shady guy) expecting it to run like new says alot about your way of thinking.

      Theres really no such thing as "bad gas" anymore. That was a thing back in the 80s. Gas stations are heavily regulated now, and the gas they sell is constantly being tested.

    The man lied about the mileage on the car and knew something was up with that car and most people that want a car and it is being sold so cheap they don't bother to go check it out. When a car is that cheap and that old it should be always checked out. The reason he came out laughing it's because he knew that wasn't the original miles on that car or he had tampered with the mileage rolled it back on that car and did not tell her and also he's laughing because he got away with it I would report him and have his license taken away so he could never be a dealer again if he actually tempered with the mileage be careful of the people who you trust

    You would think that it would be common sense to everybody that if you're going to purchase a used vehicle that you either take the vehicle to a shop or bring a mechanic with you before you hand over a dime! Not only that but how do so many people not know that when you purchase a used car the sale is as is and you get no money back unless the person somehow defrauded you or misrepresented the sale of the car, if they did defraud you or misrepresent the sale of the car you would have to actually prove that they did it not just say it.

    I have owned 3 cars that actually require premium fuel, they were/are all Acura vehicles, I've had to put regular gas in them when I had no choice, I have never once had a check engine light come on because of the regular gas. Acura vehicles drink regular octane gas in no time at all and it doesn't have as much power but the engine light won't come on.

    My PT cruiser needed premium I thought too, it did run a little better with it but still sucked. Then my husband and father replaced the catalytic converter and it was a new car! I’m not afraid of hills anymore lol😂.

    Both litigants were completely ignorant. The Plaintiff for not doing her due diligence (and stupidly buying a really old hybrid) and the Defendant for being so blissful as he walked out of court. He's a fraud. Plain and simple.

    my car is 15 years old with 86000 miles toyota corolla and is in perfect condition. i dont know why so many crappy cars are sold in the US. here we look after our cars... I dont see how there are so many bad car sales people. my car is serviced every 9000miles as per the book in the car, all services are stamped and dated for one day if and when I sell it. i intend keeping it for another 15 years

    That’s a lie about premium gas and the light coming on! Rental car companies would have cars with the check engine light on ALL the time. No one who rents a car puts Premium gas in a car even it were told!
