Family Court Judge Search Case Update- Judge Defiant Under Oath

  • Today we filed a motion for summary judgment in the federal civil rights lawsuit against Family Court Judge Louise Goldston, arguing that she should be denied judicial immunity, as well as foreclosed from even arguing at trial that her actions didn’t violate the Constitution. In other words, the jury trial in her case should be limited to the issue of damages only. It’s unusual for the plaintiff in a lawsuit to file such a motion, but in this case, not only were her actions caught on video, but also already declared by the West Virginia Supreme Court of Appeals to have been unlawful and unethical.
    On March 1, 2022, I finally had the opportunity to take Defendant Goldston’s deposition, which marked the 4th time she has testified under oath about the matter, by my count. The first several times she testified in her judicial disciplinary proceedings, when she was still facing possible suspension by the Supreme Court, she admitted that she made mistakes and acted unlawfully, and that she had violated multiple canons of judicial ethics. During her deposition however, with threat of suspension behind her, she was completely defiant, testifying that she is essentially above the law; that she doesn’t believe she did anything wrong; that the Supreme Court was wrong; that the disciplinary authorities engaged in a conspiracy against her; that she doesn’t regret threatening to arrest Mr. Gibson; and that she might even “do it again.” You really have to read it to believe it, which is why I’ve also attached the transcript of her deposition, at the link:

      Hate to break it too you, but you are worse than cops. Pay cash money for your land? doesnt stop cops going on it. What are you going to do? move them our of your property? that gets you shot. Argue with them about your rights? that gets you arrested. Ignore them? that gets you arrested. Cops will do whatever they want and you can not do anything to stop it. Guess we just have to rely on the people that work with and pay them to keep them acountable.(they dont have any reason too)

      the only thing you left out was judicial immunity is is an even bigger problem they should be held to a much higher standard and all immunity needs to go if there is grounds for a criminal charge then the d.a. must be forced to pursue those charges failure to do so should be grounds for dismissal

      @@lkayh In there *personal* capacity, even public officials should be give the full protection of the constitution. However in their *official* capacity I'm fine with them getting much less in the way of protestations. And if some officials are aren't fine with that; they can resign, were better off without those ones.

      I mean if anyone has an excuse for their participation it would be the police that entered a house after a judge ordered them to, and gave permission.... basically the same as a search warrant, however the judge appears to have over stepped her authority knowingly... it takes so little to get a legal search warrant that it's ridiculous we have police that just don't bother and do stuff like the creepy cops case... break in without any reason and without trying to get a warrant, trying to hide their crimes by disabling security systems... kicking in a window air conditioner... that's all stuff burglars do and is evidence that they were burglars and not police acting within the law.

    At first, I thought she was just ignorant, but that's definitely not it. She's so scheming, calculating, and deliberate that she's dangerous to the public.

      These Judges are certainly not "Ignorant!" Their Jobs involve the Law and Constitution all day, every day. They know what they're doing is illegal and Immoral but they do it anyway! Why? Because they believe that they're above the Law, that they're "Untouchable" and that everyone, the litigants, the bailiffs, The Clerk of the Court, The Police, absolutely everyone involved in the case before them .......Needs to follow THEIR RULES and not the Law! Now that's some EGO! Unfortunately because of their power and authority, most of the people involved with these Judges don't want to "rock the boat" and explain to these Judges that their actions and rulings are illegal! Just imagine a Police Sergeant refusing to obey the Judges orders because they know that the order is breaking the Defendants Constitutional Rights....... the Sergeants job would be over! Questions to be answered and trouble in front of the Court! It's disgusting! This is just one of many of these Judges! The Real outcome of these Judges is......... "the public have no Trust or Faith in the Judicial System!" The Judicial System isn't Just, True, Unbiased and Non-partisan, it's Immoral, Unjust, Unethical, and Ego driven by warped, dangerous Judges! American Justice isn't seeking the truth or working out the Right from the Wrong, it's about Money, Judges and their Egotism!

      you know what it is Michigan MaxedOut, that beautiful Judge knows how to get "shite" done and when people aren't playing by the rules or the law (thee was an agreed to, signed 4-page documents (by both parties) agreeing to what was Matthews and what was the ex's). He was playing his game and that WOMAN judge kicked his ace and beat him at this own game -- she got back what is rightfully property owned by the ex (in this case) that Matthew wasn't giving her after years of waiting. She should be heralded because if Matthew had it his way, she'd been out on the street with nothing after abusing her for 20+ years. I'm so happy that she is proud of what she's done and I am proud of her. End of story.

    Her changing her testimony, does Perjury come into play? It's amazing how many crooked Judges, Prosecutors & LEO's there are, unfortunately i've been on the wrong side of just such people...Even when they know you're innocent, as long as they believe they can get a conviction, they don't care if they're ruining someone's life, they push on.

      Perjury is almost never prosecuted. It’s very rare and only arises when trying to bolt on as many things as possible.

    This holier than thou Judge likes to use the term “contempt of court” a lot. She still doesn’t think she did anything wrong. Unbelievable. She is the definition of contempt of our judicial process. Caught on film and Supreme Court of WV confirmed it was illegal but still saying she did nothing wrong. The arrogance is so thick it is hard to breathe. I read the entire deposition. Thanks for posting it.

    Even if this(corrupt ) judge is found to have broken the Law, her PRIVILEGE will allow her to probably retire and they’ll be NO penalty for her CRIME. She will get to WALK off into that beautiful sunset with her middle finger pointed at the Law & the citizens that she’s supposed to represent’s. This is how it goes when we have this small society of people who think they’re above the rest of us. All we can HOPE is that your client will paid out a large SUM of money and the ExWife can’t touch any of it.

    I work as a lawyer and I appear regularly in court, so I know that it takes genuine courage for a lawyer to represent a client in a lawsuit against a judge.

      I am studying to take bar exam and this judge has violgated federal law and the civil rights act and has made a mockery of our constitution. We need to overturn terry v Ohio and also remove all qualified immunity from cops proscuters and judges, if they are charged criminaly they should go to jail and then also be sued civily.

    “We believe that the imposition of a censure, rather than an admonishment, adequately recognizes the seriousness of Judge Goldston’s conduct. Such sanction, coupled with the $1,000 fine will fulfill the disciplinary goals of preserving and enhancing the public’s confidence in the ‘honor, integrity, dignity, and efficiency of the members of the judiciary and the system of justice.'”

    If the defendant was not acting in a judicial capacity, then her entering the house was a break in. Criminal statutes apply. She should be charged with the crime.
    But you forgot there's law for special people and there's law for the rest of us.

    Imagine family court judge telling you. He is the law. Then proceeds to do things so inconsistent...the friends of the court personnel indicate they have no ideal why or what this judge is doing and this is not the process they utilize.
    CORRUPTION IS EMBEDDED.

    So long as anyone with power in the justice system enjoys any form of immunity the law in practical terms does not apply to them. While immunity served a purpose at it's inception, it has clearly been warped far beyond its intended scope and purpose. This applies to judges, city/state officials, and police at every level.

      Judges need some form of immunity to do their jobs, or else they could be sued by the loser of every case in their courtroom. In fact, government officials need some form of immunity to avoid suits over every personnel decision or public works contract. Remember, it is our money that is used to defend these cases, and our money that will pay for any judgment against the officials.

I get a LOT of people can't envision a middle ground, but it is there even if you can't recognize it. What we have now doesn't HAVE to exist in it's current form. I'm probably speaking to the wind since most people that immediately go for the most extreme counterargument to have a point generally don't listen very well.

      Immunity should NEVER be allowed for anyone who has ever wielded judicial, prosecutorial, or enforcement powers within its framework. Immunity for these people would only serve one purpose, and that is to allow them to operate outside of the law.
      Plain and simply, there would be no other purpose for this type of immunity.
      It is absurd that we allow this sort of fraud to masquerade as justice.

      Immunity only serves ONE PURPOSE, and that is to allow one to escape accountability for breaking the law.

    My family court "judge" took my attorney and I in to a common break room before the first day of our hearings, and informed me that he doesn't believe in Alimony? Of course off the record ! Why else would he take us to the community lunch room? The corruption has no boundaries

    You’re my hero. May God bless you and protect you. I read almost the entire deposition. Amazing that a judge thinks she can walk into anyone’s home who is appearing before court and tell them on their own property that they can’t record. This is raw judicial power that’s scary, and then contradicts her own sworn testimony because she’s now gotten past her sanctions with a slap on the wrist because she cried and admitted her mistakes. This is cold, calculating and dishonest. This is the whole purpose of the 4th Amendment, but she doesn’t give a rat’s putooty about constitutional rights.

    Family court has been way out of line for a long time now. But what else could you expect from a "court" that really has no governing rules for us as our civil rights. Yet they can put you in jail or prison, that doesn't make any type of sense.

    Wow. This is the exact conduct of the judge I am dealing with. You should be proud because of this though because the floodgates are going to open with this case.
    I hope she is stripped of judicial immunity because this is where most criminal acts occur and the cost to high to defend against these matters.
    The fact of a judge being changing in morality according to what is offered to her should not be a judge of the people because she can no longer rule fairly.

    Norm McDonald recently passes away. Before his passing he had Judge Judy on his Netflix show. She had some interesting things to say about family court and why she wanted cameras in the court room.

    It's unbelievable what those West Virginia judges are doing. I've been practicing family law in Texas for eleven years and I don't think such behavior would ever occur to a judge to do.

    Even though cases like this are open to the public, not too many people are aware of them. You publishing videos like this dramatically broadens the audience who will be better educated and motivated to take actions to improve the legal system and the accountability of public officials.

    Ok, I’m just a heavy equipment mechanic and have exactly no knowledge of the law compared to a judge. I just spent time reading the complete deposition of the judge you took. She really sounds like she is above the law and her opinions are above all. I can’t believe she is allowed to sit on the bench, but again I have pretty much zero law knowledge and am just a person who twist wrenches ( who am I kidding, I spend more time on the computer looking into the multiple computers on the equipment)

      Laws are written at a 9th Grade High school level - it's a social myth that lawyers judges are Intelligent or extremely educated - their not.
      Only a very FEW are highly educated

    Given her lack of penance, contradictory to her statements to the Judicial Board, could you ask them to review their decision based on her most recent statements?
    Maybe her bosses might change their minds if they knew who she really was when they're not looking?

    It makes me wonder if you were able to make any headway in this case is because your client is in law enforcement and not just a regular citizen. And judging by the way the other judges stood up for her unlawful actions it is a joke when they order you to stand up for the “ honorable judge “ that is entering the court room.     For an earlier posting on the actions of the Family Court Judge's Association, I postulated that other Family Court judges were doing the same thing. Perhaps someone, other than yourself, writing an Op-Ed about this case to newspapers across the state may shake the poisonous tree free of similar low-hanging fruit. Your judge must have learned it from someone else. Like a cancerous tumor, it's metastasized throughout the state.

      Apparently she had been doing it for 20 years. But previously she had been able to claim it was by "consent".
      As in, you are asking the judge to allow you to maintain an active relationship with your children, while Judge Louise Goldston, asks to come and search your house. That kind of "consent".

    The pleadings and the deposition you posted to your website are pure gold. They are well worth reading thoroughly, even if only for the entertainment of seeing how a judge, just like the police, can lie and lie.
    When a cop is caught lying under oath, he is subject to placement on a Brady List, making any future testimony provided by the officer of dubious value. Shouldn't a judge just be completely disbarred for the same?

    Thank you for your work in defence of our rights, and in educating us about the legal process necessary to bring about change. Would it be possible for a knowledgeable person to prepare a template of the procedures necessary to defend oneself so that those whose rights have been violated could sue without the expense of a lawyer?

    This appears to be very simple to me we cannot allow judges to be judges anywhere they're at their judges when they're in the courtroom can you imagine the Tyranny that would happen if judges could just issue orders whenever and wherever they were their powers as judges should not extend past the courtroom

    That is so... broken. How can her latest deposition being the opposite of the previous ones NOT get her in hot water with the discipline folks as she's basically saying she lied under oath previously or is doing so now and thus isn't exactly worthy of judgeship? I'd think "double jeopardy" doesn't exist with such a body?
