Military members are US government property. How can they sign a contract with a civilian without the contract being approved by JAG or their commander? Also, the state nor the military never disclosed all information and laws pertaining to the contract at the time of signing. This makes the contract void. All contracts must have full disclosure at the time of signing.
if she is working and you are not at the time of seperation you can request spouses support but keep in mind if she dose get any portion of retirement not only it puts the spouse in upper inome tax bracket the one who works of course the deductions is based pay so if your retirement pay at the base levell not after tax level he or she will get 50 precent only if the two of you were married for 20 years total but if the divorce takes place in a no fault state he or she gets nothing and it must be stated in the divorce decree that the spouse is seeking alomny or retirment pay nothing is automatic alot of folks think it is a automatic thing it is not besides retirement pay is barley nothing anyway it is in most cases half of active duty base pay or officer base pay minus taxes

This is really a state dependent issue, adultery in a no fault divorce state could have no bearing on who gets what. Alimony vs retired benefit are two different issues but, in this case you being retired the court could determine that she is owed a portion of your retirement. But you should definitely find a lawyer and seek that professional assistance. Anything less you are putting it all at risk, unless you and her choose to divorce amicably and do it yourself. Or find a way to prove she married you in bad faith against the rules of immigration but thats a stretch.

If SM is already been retired, you are not entitled. If you are married to SM, (as you mention for 10-years) while he or she was serving you are entitled to the 10-year time on prorate basis. For medical coverage purposes call the VA, you may be entitled to some if you are low-income, not remarried, and listed in the survivorship benefits.

But Army is telling her their have to take away her BAH unless their legally separated. Just need more info. Her Sergeant talked to my son and told him they should work things out because she can’t be staying in the barracks. WTF What if she doesn’t want to return? This is not true at all, I have been married for over 20 years. there are no laws that protect the spouses, it is up to the active-duty member, it doesn't matter who is your lawyer. and before your divorce, your nasty husband or wife will find another one that has half a retirement from another active-duty member. There is no justice, do not leave your jobs, do not make sacrifices for them, you will watch your kids in pain and getting psych treatment, you will get calls from your fellow military spouses ( some of mine were Airforce officers and even lawyers) " can i come to your house my husband hit me".... the list goes on... There are no benefit, not even the GI bill for the kids, i am paying. Stay away from anyone who is military.

My sister in law was not aware of the 20-20-20 rule at the time they divorced but her husband did and left her apparently with no benefits other than 42% of his retirement but nothing else.She does not have access to the commissary, or any benefits such as VA home loan. When husband dies so does his retirement, but you can go to VA and apply for death benefit for spouse retirement

You are NOT entitled to any of his disability pay.
Sounds like you wanted a cut from his disability pay. You are not entitled to that, that is considered separate.

Title 38. VA Disability is only for the service member. Former Spouses are not entitled to anything from VA Disability.
