Great information Christian! You're 100% right that it's tough to be a landlord at this point in time. One thing that I've noticed is there isn't much spoken about "material breach's" regarding tenants. I have a tenant who had her boyfriend move in and did not notify me or ask that he be included on the lease. My understanding is that after a certain period passes they automatically become a tenant even though they have not signed any lease agreement. The other point you mention about not allowing access to the property is again another material beach. I'm not too sure how this applies but every attempt (24hr. notice) that I've made to enter my property...in my case a battery replacement on the smoke detectors/Co2 dectectors the tenant last minute says they are sick and cannot meet. So, just a few things to watch out for when trying to access your property. Thank you for all you do!
Received email that I've been approved for Rental Assistance....It stated how much the Landlord will be receiving & the time period when he'll be receiving the funds....5 - 15 working days. The process took exactly 58 days to get approved from when I'd applied... 211+ United Way!

You should have been notified when the tenant applied, if the tenant gave them your contact info (which he was supposed to do). It could have been a notification via email. If the tenant receives the rental assistance, the tenant has 15 days to turn over the funds to the landlord. You can call the hotline to let them know that you did not receive the funds and they should work with you to get them. If you are going to evict for nonpayment of rent, then you must apply for rental assistance. All other at-fault and no-fault reasons do not require applying for rental assistance.

Landlord can not evict for non payment for before October or in April 1 2022 for non payment but between the months of October- March 31 landlord can file an unlawful detainer. Do you know of that to be true.
I called and was told since my property is in LA County my tenant cannot participate and the LA County funds are depleted, this sucks. I guess it's not for all of California !
I am very disappointed in LA and their rental assistance program! Towards the end of the video I show this very thing with an LA property...hopefully that was just the first round of funds and more are coming from the second stimulus bill.
@@nicolejanssens2165 Be sure to discuss forbearance with your lender...they may still be open to it depending on where your loan is. Obviously that doesn't solve things, but can help with the cash flow crunch.
I had a similar experience in Granada Hills, CA. I made several calls to Housing is Key. I was then referred to a local program and was told the program is closed, there are no funds...... and that I could check back which I did again the beginning of July. My tenant owes a lot in back rent for 10 months. She did just pay the full amount for July.
Hello, my case worker said she was approving the money and I should get it. After two weeks I called up and found out that it was under "review". It was my tenant who first contacted them for rent and utilities reimbursement. I logged in to there site and filled out my landlord info. With problems from the tenants side and some difficulties using there site, I first talked to my case worker about a month later. My tenant first denied he owed $7000. In my case it took time to bring the whole application together. Every landlord is going to be different. I'm now almost two months into the process. Joe I hope you have better luck. The people you are going to be dealing with on the phone are just order takers and they really don't give a damn one way or the other. They feel lucky they can pay there rent. Good luck bro

Technically, under the current eviction moratorium in California, a landlord has to keep a tenant even after the lease has expired unless the tenant wants to move out (remember that I can't give legal advice and this should be discussed with an attorney). So if the tenant is staying and the tenant won't be able to afford rent in the months ahead, then I would say request it.

My husband and I have unemployment. We had to get transfer to a county rental assistance because where we live wasn’t used for housing is key. We got denied because they said we currently make over the median income. We have been paying full rent since we had started receiving the extra $300 in unemployment. I called my case worker and ask why is it what you currently make? I wasn’t getting the $300 the whole time last year otherwise I would have been able to pay. Not sure if you can help.
I applied in the middle of March 2021. My case was about to be closed due to landlord not applying until I reached out to my case worker 3 months later. My landlord didn't want to participate so they move forward with just me. My case has been in QC review for two weeks and no new up date. My landlord asked me to move out. I've been paying him throughout the pandemic and is behind 1 month minus the late fees. The wait and not knowing is stressful.
I was under the impression that the landlord does not need to participate because I know a few people that applied and their landlords just don't want to budge. Their English is not good and they just don't want to get involved. I think mine will be helpful though. If you don't mind, how did they try to reach him. Was it email, phone?
Apologies if you covered this question, I still haven't gotten to the end of it. For tenants who participate, but landlords who are unresponsive when they are contacted, will the tenant be able to get the funds for future rent, having the opportunity to show funds were paid for rent?
If a landlord doesn't cooperate, then the tenant may be able to receive the funds and forward to the landlord. Call the hotline or discuss with your case worker.

At around the 11:30 mark, you mentioned that the landlord needs to fill out the 15 day notice to pay or quit. I’m the landlord and my tenant is refusing to sign up because they might miss out on income insurance. They owe $650 for June and all of their July payment so far of $1900. She’s claiming she will pay. Should I or do I need to serve her the 15 day notice immediately?
Yes. First serve the new one time notice due before the end of July. Then the 15 day notice with blank declaration. And serve the 15 day and blank declaration again in August and September if they miss rent in those months, too.
Hi Christian, I have a question also re: if I need to send the notice . My tenant owes me $13,000! (for a 10 month period) I have made several calls attempting to get rental assistance from both State & Local programs. She did pay full rent this month. I sent her an email that I need to understand what her payment plan is going to be. I am currently not looking to evict her. Any insight would be appreciated.
@@ojoyful1 You do need to serve the eviction notice to get a payment from the state or county. It is simply for paperwork reasons. You can let tenant know this and that you are not planning on evicting. Tenant will be absolved of rental debt as well.

Thanks for watching and for sharing! The good news now is that a landlord can get 100% of back rent if they cooperate (versus just 80% like before)...so most landlords are cooperating. If your landlord won't, then you may actually be able to get the funds sent directly to you and then you can forward to the landlord.
Probably shouldn't reapply, but definitely see if you can get an update if they have a hotline for the program. Also try entering the property address at housingiskey.com (I show how in this video) and maybe you can also apply for state funds and those will come through first.

As of right now, the tenant needs to apply as well. If you're terminating tenancy so that you can move into the property you and your tenant can still apply.
I called for the Los Angeles program because My tenant stopped paying in May. I was told that I should have applied earlier. I had to explain to them twice that my tenant just stopped paying rent in May 2021 so there was no need to apply earlier. They also have no idea when funding will be available again. I'm so done with this mess.
No you can definitely file first...in fact your landlord doesn't have to cooperate. If the landlord doesn't cooperate and if you're approved, they can send the funds to you and then you can forward to the landlord.
If tenants don't comply, then potentially you'll be able to move forward with an unlawful detainer in October. Make sure you get the proper notices to the tenant as required by AB 832.
Is there a limit to how much money the government will pay. My situation, i just started to rent the house my parents own. The house is in Silicon Valley near many hi- tech companys, so in the past therenters have been paying over $4k for a basic house. Most people will not pay the high rent when they no longer have to commute to work. My parents have not given me any formal eviction notices, fearing it will hurt my credit. Instead i have paying only what i can and racking up a debt to them.
Haven't seen a limit referenced for the state program, but some local programs have had a limit. If applying to the state program, as long as there is a lease, it's legitimately owed back rent, and the tenant is eligible, then the rent should be covered.

Since you're subleasing, then probably not, but you can either call the hotline and ask or try applying. It may help if you have a lease between you and the subtenant and if the management company knows...

Tenants break 1 year lease after 4 months last Sept and their employer is the Co-signor. They abandoned the 2+1 apt leaving all kinds of personal property and did not return all the keys & mailbox key. They admitted that they had others living in the apt since there was a bed left with drapes hanging from the living room ceiling, thus, subletting, a violation the terms of the lease. The "INITIAL Security Deposit Statement" was mailed (apt address) and emailed to both tenants and the Co-Signor within 21 days. The tenants refused to pay the initial balance due. After a couple of months we contacted the Co-Signor and said he would have to consult with his attorney. It took 6 months to rent the apt. The "FINAL Security Deposit Statement" added the 6 months rent due. The Co-Signor acts like he does not understand that he is liable for the entire debt. I wonder if ERAP will also be including the additional 6 months rent due.

Two questions. Why does the landlord have to have a company name? There is no company name and what does the landlord do if they never filed a W-4 because this pandemic was the start of having renters & as you can imagine everything went bad.
I'd try calling their hotline to discss...my guess is that you can use the landlord's name under company name, if it's a required field. Do you mean a W9? That can be filled out at any time...

The distribution has been painfully slow! By September 15th, each area is supposed to have a system setup to be able to track the status via phone or online.
I called that (833) # today and was told at this time they are unaware of when the applications for 100% will open up and that they are not sure if we as tenants will have to reapply but they were able to confirm with me that the landlord did refuse the 80% and that I was definitely covered by the 25% but they couldn’t give me info on the 100% their so confusing. I’m guessing the landlord might’ve known there would be a better program than the 80% that that’s why they rejected it.
So I logged in after the landlord refused to comply with the 80% program. All it says is, Landlord Opt-Out for Application. So I am assuming one has to apply again. Or what happens next ? Thank your for you advice and help the knowledge is so extremely helpful.
The state program can take several months for approval and then several more weeks for payment. Keep checking the portal and you can try calling the hotline.
Question: my ex wife moved out 2 years ago. Never removed from lease. Gov requested her income. Landlord not willing to remove her knowing divorce took place but willing to participate in rental assistance. What should I do?
Wow! That is a tough one. I'd try calling the hotline to see if there is a workaround in this situation. If not, it sounds like it would be best for the landlord to remove her name. I understand that he wants to keep her on in case he needs to go after you guys, but he's more likely to get this rental assistance money than anything by going after you. Good luck!

You need to get a really long cable and dig a trench...run the cable in the trench and connect to your nahbors cable box via a T split connector. Then crimp the other end and use a copy decoder you can find the program online but you will need a raspberriepie.

When the landlord fills out their portion of the application, he or she will have the choice of check or wiring into account to receive funds.

I called my case worker and ask why is it what you currently make? I wasn’t getting the $300 the whole time last year otherwise I would have been able to pay. Not sure if you can help.

I applied in the middle of March 2021. My case was about to be closed due to landlord not applying until I reached out to my case worker 3 months later. My landlord didn't want to participate so they move forward with just me. My case has been in QC review for two weeks and no new up date. My landlord asked me to move out. I've been paying him throughout the pandemic and is behind 1 month minus the late fees. The wait and not knowing is stressful.
I was under the impression that the landlord does not need to participate because I know a few people that applied and their landlords just don't want to budge. Their English is not good and they just don't want to get involved. I think mine will be helpful though. If you don't mind, how did they try to reach him. Was it email, phone?
The current law, AB 832, allows the money to go to you directly if the landlord won't cooperate...discuss with your case worker.

Maybe, but you'll probably need to show some sort of lease. You'll want to try calling the hotline to discuss.
Apologies if you covered this question, I still haven't gotten to the end of it. For tenants who participate, but landlords who are unresponsive when they are contacted, will the tenant be able to get the funds for future rent, having the opportunity to show funds were paid for rent?
If a landlord doesn't cooperate, then the tenant may be able to receive the funds and forward to the landlord. Call the hotline or discuss with your case worker.

If the tenant will cooperate and apply for assistance and is eligible, then they can potentially receive funds even though they have moved out.
What % tax does the landlord pay for rent relief?
It would be taxed as regular rental income for the landlord.

At around the 11:30 mark, you mentioned that the landlord needs to fill out the 15 day notice to pay or quit. I’m the landlord and my tenant is refusing to sign up because they might miss out on income insurance. They owe $650 for June and all of their July payment so far of $1900. She’s claiming she will pay. Should I or do I need to serve her the 15 day notice immediately?
Yes. First serve the new one time notice due before the end of July. Then the 15 day notice with blank declaration. And serve the 15 day and blank declaration again in August and September if they miss rent in those months, too.

(for a 10 month period) I have made several calls attempting to get rental assistance from both State & Local programs. She did pay full rent this month. I sent her an email that I need to understand what her payment plan is going to be. I am currently not looking to evict her. Any insight would be appreciated.
@@ojoyful1 You do need to serve the eviction notice to get a payment from the state or county. It is simply for paperwork reasons. You can let tenant know this and that you are not planning on evicting. Tenant will be absolved of rental debt as well.

One tiny thing... I'm disappointed to see that what to do if landlord opts out of process. Please anything you can add would be so much appreciated! I'm so scared and burnt on the unemployment nightmare I'm scared to apply before I know exactly what to do bc last time I was flagged and currently have sat in limbo for more than a year. Thanks for watching and for sharing! The good news now is that a landlord can get 100% of back rent if they cooperate (versus just 80% like before)...so most landlords are cooperating. If your landlord won't, then you may actually be able to get the funds sent directly to you and then you can forward to the landlord.

Probably shouldn't reapply, but definitely see if you can get an update if they have a hotline for the program. Also try entering the property address at housingiskey.com (I show how in this video) and maybe you can also apply for state funds and those will come through first.

I ONLY thing is, la city rental assistant doesn't cover other bills, but LA county rental assistant does, on their application, you can report your water, wifi, and all other bills, NOT LA CITY rental program. this is not fair

As of right now, the tenant needs to apply as well. If you're terminating tenancy so that you can move into the property you and your tenant can still apply.

I called for the Los Angeles program because My tenant stopped paying in May. I was told that I should have applied earlier. I had to explain to them twice that my tenant just stopped paying rent in May 2021 so there was no need to apply earlier. They also have no idea when funding will be available again. I'm so done with this mess.

No you can definitely file first...in fact your landlord doesn't have to cooperate. If the landlord doesn't cooperate and if you're approved, they can send the funds to you and then you can forward to the landlord.

What if your tenants refuse to apply but the home owner did apply for it?
If tenants don't comply, then potentially you'll be able to move forward with an unlawful detainer in October. Make sure you get the proper notices to the tenant as required by AB 832.

Is there a limit to how much money the government will pay. My situation, i just started to rent the house my parents own. The house is in Silicon Valley near many hi- tech companys, so in the past therenters have been paying over $4k for a basic house. Most people will not pay the high rent when they no longer have to commute to work.
My parents have not given me any formal eviction notices, fearing it will hurt my credit. Instead i have paying only what i can and racking up a debt to them.
Haven't seen a limit referenced for the state program, but some local programs have had a limit. If applying to the state program, as long as there is a lease, it's legitimately owed back rent, and the tenant is eligible, then the rent should be covered.

Since you're subleasing, then probably not, but you can either call the hotline and ask or try applying. It may help if you have a lease between you and the subtenant and if the management company knows...
I read on the application that it can be a verbal agreement as long as you have proof such as a message or email stating they owe you

Tenants break 1 year lease after 4 months last Sept and their employer is the Co-signor. They abandoned the 2+1 apt leaving all kinds of personal property and did not return all the keys & mailbox key. They admitted that they had others living in the apt since there was a bed left with drapes hanging from the living room ceiling, thus, subletting, a violation the terms of the lease. The "INITIAL Security Deposit Statement" was mailed (apt address) and emailed to both tenants and the Co-Signor within 21 days. The tenants refused to pay the initial balance due. After a couple of months we contacted the Co-Signor and said he would have to consult with his attorney. It took 6 months to rent the apt. The "FINAL Security Deposit Statement" added the 6 months rent due. The Co-Signor acts like he does not understand that he is liable for the entire debt. I wonder if ERAP will also be including the additional 6 months rent due.

Two questions. Why does the landlord have to have a company name? There is no company name and what does the landlord do if they never filed a W-4 because this pandemic was the start of having renters & as you can imagine everything went bad.
I'd try calling their hotline to discss...my guess is that you can use the landlord's name under company name, if it's a required field. Do you mean a W9? That can be filled out at any time...

What happens if the landlord chose no to comply with the SB91 at 80% & you were approved ! How to go with the 100% program will one have to reapply ?
No, don't have to reapply...the landlord should automatically get the difference (assuming there are funds left).
I called that (833) # today and was told at this time they are unaware of when the applications for 100% will open up and that they are not sure if we as tenants will have to reapply but they were able to confirm with me that the landlord did refuse the 80% and that I was definitely covered by the 25% but they couldn’t give me info on the 100% their so confusing. I’m guessing the landlord might’ve known there would be a better program than the 80% that that’s why they rejected it.

The state program can take several months for approval and then several more weeks for payment. Keep checking the portal and you can try calling the hotline.

Wow! That is a tough one. I'd try calling the hotline to see if there is a workaround in this situation. If not, it sounds like it would be best for the landlord to remove her name. I understand that he wants to keep her on in case he needs to go after you guys, but he's more likely to get this rental assistance money than anything by going after you. Good luck!

You need to get a really long cable and dig a trench...run the cable in the trench and connect to your nahbors cable box via a T split connector. Then crimp the other end and use a copy decoder you can find the program online but you will need a raspberriepie.
