A few times a week I watch live court cases from Michigan. Most of the time everything goes smoothly but on occasion the defendant doesn't show up. Sometime they reset the time for another hearing. Ultimately a bench is issued and the person eventually picked up and brought to jail and sometimes they make bail which is a nominal amount of a couple thousand dollars or less. It is stunning to me that the prosecutors in this area of Michigan do not want to prosecute most cases and they will dismiss some of the most serious charges like DUI and change it to a driving while impaired. Seldom do I ever see them actually want to go to trial. This might be because they don't have enough assistant district attorneys or prosecutors to do the job but in any event it's stunning to me that people can get away with crimes. In one instance I saw a case where someone was charged with stealing from a big box store. The judge mentioned before the case that these cases in many instances cost the system about $2000 to prosecute and the penalties don't even begin to approach that amount. Most of these cases could carry a jail term but at $137 a day to incarcerate someone, it makes them think twice about filling the jail.
