This is the response of a guy fed up with all the crap that goes along with just trying to go from point A to B. Constant hassle. Busy bodies and pushy cops. He is responding to the cop in the like. E30 M3 I’ll tell ya I was homeless for about a year with my wife many years ago. We were getting harassed all the time while we were parked behind motels and at park and rides. Cops said we couldn’t sleep there, it happened all the time and we’d have to move. We’d always come back, goes to show you, you can’t even struggle without getting harassed
The wording of the ordinance (in the description above) is telling... The ordinance was written with the intention of keeping a used car dealer from using public street parking spaces with the intention for business advertising purposes. The ordinance does however, allow the new car dealership to park specifically new models on the streets twice a year for a period of three days. Not only is Travis not a car dealer trying to sell his car, he's not taking up space on the city street adjacent to the new car dealership. Evidently the used car dealership the ordinance was spawned for would pretend to be working on the car to maintain the street parking spaces of his choosing to avoid the demand of the new car dealer to move them. It's all about power play and who's who in the township. Stupid resident business bickering gone stupid legal ordinance. And later, other stupid residents (and police) using the bully business bickering gone ordinance like a rock to throw it at harmless peaceful people visiting the public park and campground outside of town. The ordinance is completely irrelevant to Travis, whether he was working on his car or not. Stupid 👮 bootlickers 👢 are the most ignorant 💩 of sheople 🐏.

Bro. My buddies dad owns a Mexican restaurant and when he was working sometimes he would open the hood on his Chevy truck and pull out foil wrapped burritos and YES I ate them. The engine heat kept them nice and warm. Mexican microwave: Chevy truck. Now before you people that have to go around sticking up for everyone else. It's a pretty simple defense, did the officer ever witness you turning a wrench or other wise handling tools or having tools openly displayed in a manor that would suggest you are currently, will be, or have been working on the vehicle? NO! Then all he did was waste tax payers money and engage in fascism by enforcing corporate policy as though it were law. And, make no mistake about it all (99%) of cities and towns in America are corporations. Hence, City Ordnance is a corporate policy, NOT law. Scrutinize the policy, Deposition the officer, Submit your video as evidence, and submit a notarized fee structure to the city for your costs of attending their fascist court and building your defense. Most likely the Magistrate, not a Judge, will drop the issue before you even get halfway through this process.

Did he just give you citation for something that did not happen in his presence and that he did not witness? Is there a city odinance against having the hood of your car open? The cop is kind of stupid. It didn't seem that any of the ordinance applied to what you were doing. Where are the public rules for the use of the park? Were you in compliance with those rules? If not, I'm sure it would be a different ordinance you would have been cited for violating.
Heinze never said he was working on his vehicle. They assumed he was because his hood was up.. Maybe he was letting it cool off after a long day of travel. He wrote a ticket for working on his car with no proof.. Based on an assumption.. I feel safer now
Fact, if the officer didn't see the alleged offense happen in his presence or there isn't enough evidence to infer the offense was taking place then there is no offense.

The ordinance says you can't park a vehicle on the street with the intent of trying to sell it. The repair thing is actually an *exception* allowing you to leave it parked for longer if trying to do a repair. They are completely misinterpreting the law.
Automotive repair ordinances are common. Here in California most cities say you can only only do work in your driveway that takes less than something like two days and there’s some bs like the wheels have to stay on. No work whatsoever on public property.
As someone that is planning on cooking rotisserie chicken in my van wherever I am legally allowed to park, this video offends me the most of all of your videos that I've seen. He literally just got through explaining that you were allowed to use a camp oven just over where the fireplace was, then he was dumbfounded by your statement that you were going to cook a chicken. Who is the claimant? If no man is willing to step forth, and allege that man there has done me a wrong, and loss in combination then there can be no remedy. Courts deal with controversy, don't create controversy. "I am a man( not a person/NAME) wanting to question who claims that I have done them a harm, injury, or loss, present the claimant."
Yep, he talked them into writing him a ticket for an unestablished offense. The officer did not have any direct evidence of an offense, yet he wrote a ticket as though he did. The word of the camp warden is insufficient to write a citation, unless the officer also has first hand knowledge of the offense. The officer investigated and saw the hood up, which, in and of itself, is only evidence of the hood being up. Is there a law prohibiting a hood being up in that park? Nope, as evidenced by the fact that he was not charged with that. Instead, he was accused of something that he may or may not have done, but for which there is no direct evidence. As Travis seems to be in no rush to get anywhere, he has the time to take this to the local court and demonstrate for all to see that the officer acted out of irritation and not sound legal judgement. Win for Travis.
i don't understand. The ordinance 10-12.040 says, "no owner shall allow a vehicle to be parked upon a street... B.Repairing or servicing the vehicle, except repairs necessitated by an emergency;" You were not parked on a "street".

The "witness could have said anything to the Cop as he seemed to take issue with Travis being there regardless of what he may have been doing. A "witness" could be an exagerated construct by the cop based on what he heard from the witness. Cop could be wanting to make it bigger and a whole lot worse as he tries to try get Travis to slip up in answering his questions. Cops can make up stuff. I saw no evidence of Travis "working on his car" if we agree that means doing mechanical repairs and servicing. Just a single guy driving around minding his own business seeing the country and taking each day as it comes. The cop wants compliance. It's about telling Travis and others what to do. He is obviously bored rather than run off his feet sorting out the local crime. Travis, I love your questions in response to questions. It really bugs the sh*t out of them. Keep doing what you're doing. We need more people like you to keep potentially abusive cops in check. They so often get away with this tactic because too many people are intimidated by the tactic. I have followed so many different 1st amendment auditors, each with their own style. There's the 'silent treatment', 'questions with questions' (your style) and the 'aggressive response to bullying'. All are effective. Every auditor needs to use the method that they are most comfortable with.

I took a quick peak at the ordinance. It would be so easy to beat in court. That ordinance specifically states it applies to cars "parked on the street." It also said it does not apply when repairs are "necessitated by an emergency." Thirdly, did anyone see you actually working or did you just have the hood up? Your argument should be that you were not parked on the street so the ordinance doesn't apply. If they railroad you on that one then tell them you had the hood up and were not working on the car, merely inspecting it because IT WAS AN EMERGENCY. Tell them you do not feel safe driving a car that might be malfunctioning and therefore, for the safety of myself and other motorists, I felt it was necessary to inspect under the hood for any problems. That's my two cents.

The cop is literally googling the "law" he is trying to enforce. This is what we pay for in the US. In many European countries, like Germany for example, citizens have to study law for 3 years before they can even apply to become an officer. Exactly right. There is no evidence for a code violation. If the cop is dumb enough to go to court with this, the cop will lose. A hood up does not equate to working on it.
Implied in fact (look it up if you don't know what it means) combined with both Hienze's lack of denial, refusal to explain what he was doing while pretending that he was dumb and common sense used by any rational person is why he was charged. Don't forget that officers don't want to waste time dealing with stupid minor offenses. But if you're going to insist on wasting his time, he has the authority to enforce the law. This is done by using his radio, patrol car mounted computer and cell phone to discuss what is going on each time he steps back to their vehicle. They work together with the DA office to enforce the law. So if he's going to charge you it is likely that he spoke with one of the attorneys there to verify the charge will stand. Otherwise he will end up reprimanded by his leadership as they get flak from the DA office every time there is a case that has issues caused by the officers who respond because it leads to guilty parties getting off free of charge due to failures of requirements in the legal process. Look at the bigger picture, my friends.

It's a pretty simple defense, did the officer ever witness you turning a wrench or other wise handling tools or having tools openly displayed in a manor that would suggest you are currently, will be, or have been working on the vehicle? NO! Then all he did was waste tax payers money and engage in fascism by enforcing corporate policy as though it were law. And, make no mistake about it all (99%) of cities and towns in America are corporations. Hence, City Ordnance is a corporate policy, NOT law.
Scrutinize the policy, Deposition the officer, Submit your video as evidence, and submit a notarized fee structure to the city for your costs of attending their fascist court and building your defense. Most likely the Magistrate, not a Judge, will drop the issue before you even get halfway through this process.

The cop is kind of stupid. It didn't seem that any of the ordinance applied to what you were doing. Where are the public rules for the use of the park? Were you in compliance with those rules? If not, I'm sure it would be a different ordinance you would have been cited for violating.
Heinze never said he was working on his vehicle. They assumed he was because his hood was up.. Maybe he was letting it cool off after a long day of travel. He wrote a ticket for working on his car with no proof.. Based on an assumption.. I feel safer now

The ordinance says you can't park a vehicle on the street with the intent of trying to sell it. The repair thing is actually an *exception* allowing you to leave it parked for longer if trying to do a repair. They are completely misinterpreting the law.

Automotive repair ordinances are common. Here in California most cities say you can only only do work in your driveway that takes less than something like two days and there’s some bs like the wheels have to stay on. No work whatsoever on public property.

Yep, he talked them into writing him a ticket for an unestablished offense. The officer did not have any direct evidence of an offense, yet he wrote a ticket as though he did. The word of the camp warden is insufficient to write a citation, unless the officer also has first hand knowledge of the offense. The officer investigated and saw the hood up, which, in and of itself, is only evidence of the hood being up. Is there a law prohibiting a hood being up in that park? Nope, as evidenced by the fact that he was not charged with that. Instead, he was accused of something that he may or may not have done, but for which there is no direct evidence. As Travis seems to be in no rush to get anywhere, he has the time to take this to the local court and demonstrate for all to see that the officer acted out of irritation and not sound legal judgement. Win for Travis.

The "witness could have said anything to the Cop as he seemed to take issue with Travis being there regardless of what he may have been doing. A "witness" could be an exagerated construct by the cop based on what he heard from the witness. Cop could be wanting to make it bigger and a whole lot worse as he tries to try get Travis to slip up in answering his questions. Cops can make up stuff. I saw no evidence of Travis "working on his car" if we agree that means doing mechanical repairs and servicing. Just a single guy driving around minding his own business seeing the country and taking each day as it comes. The cop wants compliance. It's about telling Travis and others what to do. He is obviously bored rather than run off his feet sorting out the local crime. Travis, I love your questions in response to questions. It really bugs the sh*t out of them. Keep doing what you're doing. We need more people like you to keep potentially abusive cops in check. They so often get away with this tactic because too many people are intimidated by the tactic. I have followed so many different 1st amendment auditors, each with their own style. There's the 'silent treatment', 'questions with questions' (your style) and the 'aggressive response to bullying'. All are effective. Every auditor needs to use the method that they are most comfortable with.

I took a quick peak at the ordinance. It would be so easy to beat in court. That ordinance specifically states it applies to cars "parked on the street." It also said it does not apply when repairs are "necessitated by an emergency." Thirdly, did anyone see you actually working or did you just have the hood up? Your argument should be that you were not parked on the street so the ordinance doesn't apply. If they railroad you on that one then tell them you had the hood up and were not working on the car, merely inspecting it because IT WAS AN EMERGENCY. Tell them you do not feel safe driving a car that might be malfunctioning and therefore, for the safety of myself and other motorists, I felt it was necessary to inspect under the hood for any problems.

We all know the cops love to lie. I'll bet you he didn't even contact the city attorney. Make them prove their case. If they want your money, tell them to bring the witness in to testify. Ask him what work he saw you doing. Ask him if he could have mistaken your inspection as work. Ask him if he saw you with any tools. As for laws being word fill, that's how you can use the law to your advantage. The law says what the law says and there is a difference between a parking lot and a street. Besides, all this is irrelevant if it was an emergency. So, say it was an emergency inspection. Use the safety of others as an excuse.

The cop is literally googling the "law" he is trying to enforce. This is what we pay for in the US. In many European countries, like Germany for example, citizens have to study law for 3 years before they can even apply to become an officer. Here in the US they'll take any dumbshit with a high school equivalency and six months later he has a badge and a gun.
SO police should know all laws by heart. Do you know all the tax laws. I was an electrician for 20 years and used a book called the "NEC" no I didn't know all the rules I had to look them up.

Do you know what the law is for right turns, I don't so I try and use common sense when making one. If you are told there is an ordnance then say yes sir and try and comply. I like your approach and you are able to keep that laid back attitude. I heard him say the other guy said you were working on your car, and he seen the hood was up. The officer never asked you if you were working on your car, he wanted you to say you were and when you didn't admit you were he wrote a ticket anyways. That was a bad example of an investigation before writing a ticket. All he's got is your hood was up.

There is no evidence for a code violation. If the cop is dumb enough to go to court with this, the cop will lose. A hood up does not equate to working on it.
Implied in fact (look it up if you don't know what it means) combined with both Hienze's lack of denial, refusal to explain what he was doing while pretending that he was dumb and common sense used by any rational person is why he was charged. Don't forget that officers don't want to waste time dealing with stupid minor offenses. But if you're going to insist on wasting his time, he has the authority to enforce the law. This is done by using his radio, patrol car mounted computer and cell phone to discuss what is going on each time he steps back to their vehicle. They work together with the DA office to enforce the law. So if he's going to charge you it is likely that he spoke with one of the attorneys there to verify the charge will stand. Otherwise he will end up reprimanded by his leadership as they get flak from the DA office every time there is a case that has issues caused by the officers who respond because it leads to guilty parties getting off free of charge due to failures of requirements in the legal process. Look at the bigger picture, my friends.
