I think in the context of a single statement for the purposes of a criminal investigation, you can stretch the presumption of innocence to mean "could this have been said by a complete moron, a complete asshole, or both, who isn't also a criminal".
Is it a realistic consideration? Usually not, but the whole "beyond reasonable doubt" thing kinda demands it.
Of course, once you take it all together and contextualize it, there is nowhere reasonable left for that doubt to hide.

@@devon5807 Everything you just said is a complete lie: Tate is still in prison, his detention has been extended for another 30 days, pending an appeal (which legal observers weigh in on that it's all but an absolute certainty he won't win, he's staying in jail until his trial, which is 100% happening), and they're adding money laundering to the list of things he's going to be charged with.
He has NOT been let go; the women the tater tot channels are claiming prove everything was a hoax are NOT even part of the investigation (or were literally one of the co-conspirators arrested alongside the Tates, calling into the news to pretend as if she was a victim on the day she got out of jail for a funeral), the person tweeting on Tate's account is NOT bloody Tate (because he's in solitary confinement), the man is facing serious, SERIOUS charges and the investigation isn't even done.
The only reason they're allowed to keep investigating is the information they present to the judges reviewing the case shows they have evidence of crimes, if the prosecution had nothing he would have been released after the initial arrest, in that 24 hours.
