Proximity is about safety, and searching the vehicle is also about safety. Courts decide whether the search was legal, they also decide whether not conducting one was a violation of the officers duties. You make many assumptions. You know who didn’t speak? The suspect in the wheelchair.

Think of all the movies TV shows documentaries where they are in public filming, let's say on a busy sidewalk in NYC so you think they have to ask everyone before they record their seen or shots and I would guess the same goes for photos as well.

Failure to identitfy as a public servant, security or police, is illegal.
Here's the deal they have no obligation to protect or serve. WARREN VS DC. They however can't violate rights and they can't operate on private property. Try getting into an accident on private property. They won't do anything or take a report. They can't just come into your property unless they are called or have a warrant. She has every right to film and speak to the man and make sure his rights aren't violated . We can choose to protect others if it doesn't violate anyones rights. She can tell that man he can refuse an unlawful search. She can get his number to send him the video or be a witness for him. They are absolutely in the wrong. Filming is not obstruction other than obstructing their unlawful actions. We need to demand they cite the exact law that they claim she's violating. This cop is prime example of why the public feels how they do.

The cops' behavior is intimidation, and they should not be allowed to work as cops. A cop is supposed to help the people and make sure things are good, not be a bully and threaten others just because they are wearing a uniform.

I understand what you mean about a crime scene and everything, but realistically I think they would have been bothered regardless of where she was recording from. The reality is that police just don't like being recorded. And I'd wager that if she had been standing where they told her she could record from, from the beginning, they'd have approached her and told her to go somewhere else.

I had a buddy who is a constitutional attorney... they tried to bully him and eventually detained and arrested him. Once they found out who he was it wasn't a pleasant conversation for them. Both officers had to sell their homes to pay for their lawsuits once he removed their qualified immunity.
I wish ALL lawyers knew how to do that!

Remember, sherrifs are not the same as police. Sherrifs are basically legal road pirates. Any LEO that needs to cover his face or stop someone filming isn't interested in 'protect and serve'.

Sheriff's are responsible for the jail operations and to patrol any unincorporated area of the county, same arrest authority as PD.

A guy called them bc his ca red stopped on the railroad tracks and the 2 female cops snatched him up to him to the ground and said he was drunk without a field sobriety no proof and took him to jail pitiful

I’m a Law student, and the key thing about this vid is the lady recording. In all 50 states, the cops can’t stop you from recording because of the First Amendment, but in 21 states, officers can ask you to back up if they feel you are “obstructing” the detainment/search. (they can’t touch you though)

One state, maybe Indiana or something, has a 25 foot law. In one video a cop literally pulled out a measuring tape and measured the camera guy to 21 feet and arrested him.
