You can read the text of the FFHA here - www.hud.gov/sites/dfiles/FHEO/documents/fairhousingact.pdf
I would like to clarify something concerning the housing laws that govern places that accept RVs. First let me reiterate that I am not a lawyer or a judge. But I do know how to read. The Federal Fair Housing Act(FHA), in it's own wording, states clearly that it "...prohibits discrimination in the rental of a 'dwelling' based upon race, color, national origin, etc..." and there have already been rulings that have clearly defined "dwelling" to include an RV. Some folks, myself included, have used the term "structure" to say the same thing. My apologies for any confusion.
I'd also like to point out that we're not against private businesses being able to conduct business as they see fit. Never have been. I also am not trying to encourage people to make trouble. If you are rejected, there are peaceful solutions that don't involve trying to ruin someone. The purpose of the video is to try and give some understanding of the legalities of these situations and to offer some alternatives. Sadly though, situations like these only reinforce the stigma against people who are not well off enough to afford a rig that won't be turned away. It also perfectly fits the definition of "snooty". I'm sorry, but it DOES. The businesses don't have to accept everyone, but the people they reject don't have to like or keep quiet about it either.
Thank you very much for watching!

@@NomadicPride Slight correction to this. The FHA does classify a spot to park an RV as falling under the classification or definition of "Dwelling".

    • @CheapNomads
      @CheapNomads  4 месяца назад

Not a problem. There's a link to a legal article below. You'll note that it states
" 'Dwelling' includes any vacant land which is offered for lease for locating any “structure” on it. A structure would include an RV."
      www.marklbusch.com/single-post/2014/06/04/discrimination-claims-by-rv-tenants
      "Database Upstairs"? - that's good...I'm gonna use that. ✌️

    • @CheapNomads
      @CheapNomads  4 месяца назад

      Very well then.
      Sec. 802. [42 U.S.C. 3602] Definitions
      (b) "Dwelling" means any building, structure, or portion thereof which is occupied as, or designed or intended for occupancy as, a residence by one or more families, and any vacant land which is offered for sale or lease for the construction or location thereon of any such building, structure, or portion thereof.
      www.hud.gov/sites/dfiles/FHEO/documents/fairhousingact.pdf
      Some cases: www.hud.gov/press/press_releases_media_advisories/hud_no_23_199
      archives.hud.gov/news/2022/pr22-125.cfm
Clearly the government, specifically HUD, sees RVs as "Dwellings" if they are willing to charge and/or prosecute RV parks under his law. Regardless of the outcome of these charges.

    • @CheapNomads
      @CheapNomads  4 месяца назад

Hmmm...Interesting take. To be clear, these are not "HUD Rules", they are laws. Not mere federal regulations. The Federal Fair Housing Act is also known as Title 8 of the 1968 Civil Rights Act. Which HUD is responsible for prosecuting. So, I respectfully disagree. I think that everyone deserves equal access to accommodations regardless of their circumstances. Especially when they are paying out of their own pocket. Denying someone a spot at a campground falls under this and, regardless of case outcomes (which the federal court system seems to be unwilling to make available). The act seems pretty clear about "vacant land which is offered...for lease...for the location thereon..." An RV lot is indeed vacant until an RV is parked on it. It is also "offered for lease". I mean the IRS classifies an RV as a home (i.e. "dwelling"-ask me how I know) for tax purposes why then would the Civil Rights Act exclude them? Or why would a judge rule that it does when it is not explicit, or implicit for that matter. So, as you have stated you will keep your "database" intact. I will do the same as you have also not offered any legal precedent to back up your opinion. Cheers and happy 4th!

We have a 2012 Class B motorhome and the parks are very judgemental, saying things like, oh, do you even have a bathroom onboard your rig? Plus, one time that we stayed at one the park was asking if we even had holding tanks? Imagine. They were the rudest people and only wanted large Class A's that are 5 years old or newer. In your introduction you showed an old 1972 green swinger motorhome. It is actually an international with a 392 V8 engine. I know this because that motorhome was once mine. In 2003 I was leaving california. While travelling, my alternator belt which also runs the water pump broke. The engine overheated entering flagstaff arizona. I had it towed to a campground and pulled the heads and dropped the oil pan. It had a bent rod. I replaced the bad rod and had the heads done and reinstalled them. After the engine was back together I added water to the cooling system to check for leaks. It leaks really bad and I assumed it had a cracked block. I had a great deal of money invested in that old thing but I just gave it to the camp ground with the pink slip. I had not way of towing it all the way to the midwest 1500 miles so I cut my loses and left without my motorhome. This was a terrible disappointment. Now I have the means to put it on my own trailer and bring it home but I never found out what happened to that old swinger motorhome of mine. If anyone knows where it is let me know, thanks.

I have Australian friends who had a year-long travelling working-holiday trip to England.
They thought to buy a mid-sized panel van, as it would give them the option to just sleep in the back on a mattress sometimes, as they travelled around.
Turns out tha Britain's campgrounds and caravan parks don't want "Gypsies" staying there. (They often own panel vans). However it would be a breach of discrimination laws to put up a sign outside saying "No Gypsies" (oh yes they also changed the spelling of the word "Gypsy" to "Traveller" to try to get around discrimination laws).
So instead the campgrounds forbid any "commercial" vehicles from entering the residential area of the park (freight deliveries etc only allowed as far as a front office area).
If my friends had known, before they bought the van, about the "no vans or commercial vehicles" rule, they would instead have bought a hatchback or station waggon, which with the backseat folded down, some window curtains etc, they could have had a mattress in the back to sleep on, as they travelled. Yes they did stay in some cheap "cabins" and with some distant relatives at times).
Note the widespread ban on panel vans at British campgrounds, includes the tiny little “bubbleback” style vans, such as usually powered by small engines and on a small car chassis footprint, so it is not about size of the van.

Children running wild all hours of the night, openly smoking marijuana outside (in a state where that is not legal), leaving trash everywhere, hanging clothes outside to dry and just generally breaking rules. True I am not a lawyer. But the FHA does clearly state that an RV is considered a "dwelling" under the law. USe of the term "structure" could be reasonably construed to have the same meaning. Now I know the internet can be a sketchy place, but I did see where several lawyers verified this, as well as having case law to support it as well. Now in reality, anyone suing a campground for discrimination under the FHA would likely have a hard road ahead of them. Personally, we would just move on and save the trouble.

You can legally ride in a "conveyance," but that is only true if an RV is a Class A, Class B or Class C motorhomes.
The problem with your meaning is that one cannot legally ride along inside a Fifth Wheel or Travel Trailer (even though Lucy did that in the movie "The Long, Long Trailer"). Therefore, non-motorized RVs do not qualify as "conveyances" in the legal sense. The must be "transported" by something that does qualify as a "conveyance", the tow vehicle. While such STRUCTURES are unhitched and standing alone, they do not move around on their own, except for THIS
      ruclips.net/video/cIAX5DEDQYI/видео.html
But people are legally prohibited from riding along in even that type of RV. They must ride in the tow vehicle.
So NOPE. RVs are NOT conveyances unless they are motorhomes.

If it's private it's legal. Private businesses can refuse service for any reason. My thing is, there should be an online resource that lists all these campgrounds and people should stop using them so they shut down. Most RV parks and campgrounds, etc. don't allow school bus conversions even if they are amazing looking. It's pathetic.

“Private businesses can refuse service for any reason.” Not entirely correct in this case. As I stated in the video, the FHA does cover campgrounds and an RV is considered a dwelling under the law. Doesn’t matter if the guest or “resident” is temporary or extended stay. The loophole is that the business doesn’t tell any particular guest they can’t stay there, only that the vehicle can’t. Nonetheless, the level of discrimination shown towards bus conversions is somewhat perplexing.

Between my wife and I we probably spoke to around 40 or 50 facilities (campgrounds, RV parks, state/federal, etc) and were only asked about that twice. 80% of the private facilities flat out said no the second we said the word BUS. The rest refused it based on it's age (2006). No one who got pictures of it refused it for the way it looked, but there were a few places that thought the concept of an old school bus as an RV was laughable, and one place (maybe 2) actually thought we were hippies. In practice, asking to see an RVIA sticker is usually only for the campgrounds insurance purposes. Now I'll admit we don't have one. But as it turns out, a majority of places won't take skoolies anyway so it ends up being a moot point.

I have a minivan camper that I converted myself in February of 2022. The van itself has a a 2012 Ram C/V and it is in good running condition and not beat up, it looks normal, not like a mini meth lab. I am knowledgeable in electrical, there is no water system because it is also my daily driver and I don’t want to worry about freezing pipes. I use a hose to wash pots and dishes. There is no propane either because I didn’t want to deal with restrictions on bridges or tunnels. It is all electric. The van IS over 10 years old, the build is not. I have yet to be turned away but I also don’t go to many high end resorts because it’s just cheaper to go to a family owned campground. My dad has a 1990 Viking pop up that is in great condition and I just redid the wiring to add more circuits because the pop up is mostly electric too. The only thing that uses propane in the pop up is the heat and we only use that in early spring and late fall. I replaced the 3 way fridge with a 120v mini fridge and removed the gas line that supplied it. The stove wasn’t permanently mounted so we put it in the basement. We don’t even bring a gas tank in the summer. The water system in the pop up consists of one line to the sink faucet and one drain out. It’s as simple as it gets. It’s amazing where you can go when your rig is actually in good condition and doesn’t look like cousin Eddy lives in it!

My education focused on government outdoor recreation, so the concept of discriminating against anyone is foreign. With that said, I personally, and professionally, do not have a problem with private businesses setting the rules for their business. Sure, it does not feel right when they turn YOU away, but how would you feel if it was YOUR business and you wanted it to have a certain vibe/feel and someone tried to tell YOU that you have to admit them? Or lets try this example, if you make cakes and someone tried to force you to make a cake you do not want to make (we all know that story). My point is this: Their business and they get to do what they want. My only objection would be if their reservation did not clearly state those restrictions up front and they denied you at the entrance.

Sadly, situations like these, as other viewers have so astutely pointed out, only reinforces the stigma against people who are not well off enough to afford a rig that won't be turned away. I know many "campgrounds" won't allow tents because they're "RV only" even though they call themselves campgrounds which I also think is ridiculous. This should all be illegal. It's not discrimination, it's false advertising. They're an RV park (meaning they have a business license), not an RV club. Even if they call themselves a "club", if they have a business license they are committing felonies turning people away based on visual discrimination factors like age or looks of equipment. They're also creating safety hazards by turning away vehicles that they can visually see "that are in need of repair" back on the road Rather than give them a safe place to park and repair which makes them liable for anything that happens afterwards. These are just rich racist yuppies that don't want to live next to "poor people".
Also personally, when I go on vacation I actually have somewhere I want to go meaning I don't care about hotels or camp sites and I'll happily sleep in my car in a truck stop parking lot. We need to stop discriminating against poverty and homelessness. This attitude of reserving resources for those who don’t actually need them is DISGUSTING.
Your comment leads me to believe you are driving something a lot newer. Every year it’s value DEPRECIATES, while my vintage travel trailer APPRECIATES. When we've stayed in Walmart parking lots we would always ask what their limit is. So we don't overstay our welcome. Every Walmart is different and some don't allow it at all. One thing that was usually made clear in every case where it was allowed was that if a rig becomes unable to drive away they will have it towed when the time limit is up. Some Walmarts disallow the practice because they have to pay those towing costs and it is extremely difficult to get to offending parties to pay.

    • @CheapNomads

I am behind you 100% that we need to stop discriminating and poverty and homelessness, and that older rigs be associated with deadbeats. In our experience we've come across folks in some nice rigs that were let's just say unpleasant neighbors. So it can go both ways. That being said, (gonna play devil's advocate here) NO ONE has a RIGHT to park at Walmart. Overnight or otherwise. It is a private business on private property. We do not have the right to the use of other's private property. Just because they do business with the public doesn't give anyone this magical right to their facility. They can deny anyone they wish at any time for any reason. Now they may choose not to in some cases to avoid bad PR, but ultimately they are under no obligation to do so.

Unfortunately some “discrimination” has become a necessary evil in some cases, and simply marketing in others.
Many newer locations or older locations purchased by a corporation are affiliated with RV and mobile home manufacturers and real estate investors.
They are selling an entire package of nice RV/mobile home, nice place to park it, and neighbors that aren’t on an episode of “Cops” every week with toilets and kitchen appliances for yard decorations.
Others that aren’t affiliated with another business don’t wish to deal with evictions and other problems that come with people making poor life decisions and have been forced to live in something with wheels and no address.
With modern code requirements and expenses to install the infrastructure to park RV/mobile homes, the business simply cannot recoup the investment at the budgets that many people building or using older RVs can afford.
Having lived in a “trailer park” years ago, and known people that lived in low rent trailer or RV parks, I can understand why someone or a corporation wouldn’t want that for their business.
While I would love to have a location that people with older rigs, or diy setups could visit short or long term, I cannot justify doing that myself.
A couple difficult tenants could ruin the investment for decades.
So rude personnel aside, before you fault an owner or company from not accepting your rig, consider how many others aren’t the nice guy that you are, and that you might want to exclude problems also.
Of course, any rental location should be upfront about any restrictions they have before you have booked a reservation and driven across the country.
I plan to build my own Rv. It won’t be shabby, but it won’t look like a $500k artwork either.

Wow! Thanks for taking the time for this response. To be fair, most of the places we've talked to so far haven't necessarily been blatantly nasty rude, just very matter of fact with their denial. Some owners were even a bit sympathetic given how many more people are struggling these days. The only ones we clapped back at for denying us were the ones that had photos of the facility online that showed rigs that were pretty run down by comparison to the one they were denying for the way it looked. We don't encourage people to publish vengeful reviews and that's why when we do a video like this one we don't like to mention names. The only time we might is if the business contact was especially rude or insulting.

First we lost a majority of Walmart over nights allowed.. Homeless and Rv parks loosing to the overnighters... Then the Rv parks turn the tables on us by the 10 year rule. When we are on a fast track traveling in our rig we just need a place to crash overnight . Walmart provided this convenience and in turn we always shopped when needed at that Walmart.. Also bought gas at their store gas stations. So Walmart looses. Now we are encountering another RV travel dimension,.. safety! uggg

Pulling or driving something that looks better than most houses in my area, that's not camping or even close to camping lol..When I's a kid in the 60s, that was camping. We had what was called pup tents and you slept on the earth as in ground with grass or under pine trees is where my tent went cause I used pine needles for a cushion for my bed. We drank mountain water and fished for food but we always had marshmallows and hotdogs incase the fish wasn't biting. We camped like that, or at least I did plum into the 90s and people I grew with still don't have a pull behind or a drivable camper. I had a motor home for a couple years until I drug my feet about bringing it home, so my friend sold it again but I didn't care at that point in time cause he was having it rough and the man needed the money. The moral of my story is, people has camping all twisted up and I'm not going to pay for a piece of ground to lay on for a weekend or a week. That's not camping. I reckon I'm to old school but having a mobile home is not even close to camping lol..And these snooty people don't even have a clue of what it's like to really be out in the woods and nature camping. We as kids use to build lean two's or things to sleep under made of sticks and tarps so we didn't get wet cause just about everytime we'd go camping it'd dump the rain on us but we always put in the work to keep us dry throughout the camping trip...

Absolutely ridiculous. This has been standard practice for decades, most places since the internet will say, nothing over 10 years old, and when they are empty not enforced or arbitrary. No kids should be an easy one.. nobody under 18 should be clear..no pets other than cats and dogs, nothing over 40 pounds, standard stuff.. lots have no pitbulls no matter the weight. Because vanlife, full time, people living in their vehicles, homeless, people gaming the system have basically ruined camping I applaud these places for having standards and sticking to them. All you have to do is look at any campground and you will see absolute abuse, over use and gaming the system.. people are not camping they are living, don't care about out doors care about WiFi and if anyone is checking how long they have been there..in many places that have 14,15 day limits you have one guy motor running waiting for the person to leave so they can pull in . nature doesn't get to rest, recuperate, heal, instead it gets trampled and driven on that was never part of the design.. and because of the demand, camp management can't take spaces out of circulation, most of our campgrounds are getting beat to death, literally.. not by people camping from all the other users. Walmart is not for shopping, it's for parking.. Cracker Barrel is not someplace you eat, it's a place to park, Cabela's, Bass Pro shop, moose Lodge.. just care about free parking..Planet Fitness is no longer a gym it is a place for vanlife and RV people to take a shower.. the entire country is being repurposed
