Outstanding advice!! When filling a supplemental claim with new and relevant evidence; same or similar benefit on same or similar basis, do you keep yor effective date?
Let’s say I was denied for vertigo and migraines several years ago because I tried to get service connected. Can I now file a secondary claim for same two conditions under a service connected tinnitus disability? I have now a nexus letter, personal statement, wife statement, logs, and medication that i didn’t have 5 years ago.
Amputations secondary to diabetes. Currently in the battle of combating this through a supplemental. Diabetes seriously compromises our healing ability in feet and hands. VA doesn't see the link/nexus. Getting a letter from a doctor that will explain the epidemiology better.
If you have an in service sleep study and diagnosed with sleep apnea, you dont need a nexus.....if you have a sleep study after service, than you need to link it to a secondary service connected condition... I am service connected sleep apnea 50% secondary to ptsd....
Piece of sheet metal hit me in the face on deployment cutting my nose in half (Deviated Septum) obviously leaving a scar that remains. And also causing allergic rhinitis . When i file for Primary service connection due to deviated septum (and it's in my service treatment records) can i also go ahead and file secondary claim the scar and rhintis? Or have to wait till Septum is established first you think? And thanks!
File them together there is no law that says you have to wait till your direct is connected first. I filed scar deviated septum and sleep apnea secondary at the same time. They will tell you you can't but that's not LAW!

Great advice. Any advice on how I can connect my lower back condition to service connection? I have no prior treatment in my records but was deployed twice in combat and know all those sand bags in Saudi Arabia and Israel is the contributing cause of my condition. Please advise.
I have been denied for PFB. It was in my navy medical records that i had been diagnosed and was being treated I even sent a copy in with my claim however, under the favorable findings it stated that there was no evidence found in my service records. I am totally confused! James Trower Retired CPO

I don’t get it, I thought if diagnosed with sleep apnea during service, equals direct service connection. Diagnosed while serving.

If you're outside 12 months it will not 360dsys.. 365 days will affect you
