  • After the Defense contested the severity of the Plaintiff’s brain injuries, Sean Breen of Howry, Breen & Herman, LLP used an accident reconstruction and a TBI illustration throughout litigation to attain a seven-figure settlement. The young man was rear ended by an intoxicated driver at over 100 MPH, causing intracranial hemorrhaging and cognitive impairments.

Howdy! Scenario-large box truck rear ends 4 door sedan at low mileage that yielded to traffic while the injured’s head is turned to the west while the course of travel is going east. The injured reported the symptoms to an attorney later that evening & eventually saw a neurologist/PM and was diagnosed with Concussion w/o LOC, severe, worsening HAs, vertigo, nausea, insomnia, pulsating in ears, anxiety, neuro-deficits, etc. Only brain MRI was performed: essentially negative. The patient complained of those symptoms to every medical professional he scheduled with. Six years later, symptoms are still present, some worsening-lawsuit is still active. Is it too late for this patient to claim TBI and be compensated? Patient had Battery Test with SSD appointed MD, but no official TBI work up (?).

Hey, Blake. Attorneys who advocate for TBI victims work with DK Global for their visual aids a lot. A few instances come to mind where TBI sequellae (1) didn't show up until some time had passed after the impact, (2) didn't register on medical scans, and/or (3) didn't get better over time. In those cases, the attorneys were able to add TBI as part of the damages claims successfully. That being said, DK Global is not a law firm, so we can't give advice about specific cases. We strongly recommend that the injured person discuss their case with an attorney who has experience handling TBI lawsuits - the sooner, the better.
