One of the investor objected to this action by company and contended that such step on part of company shall amount to prospectus. Decide SIR IS PAR KONSA SECTION APPLICABLE HOGA
@Sundari_K In my opinion suru sec42 se hoga as company shall issue shares to specified person, however such specified person shall not exceed 200 in no. In case anytime issue of shares exceed 200 it will amount to public issue , Co. Shall not issue any advertisement, circular or notice to public at large As per the given Q co. Intending to issue it's share to local people they must be specified and shall not exceed 200in no. And shall not issue any advertisement contravention of which amount to compliance of chapter III of part A of the Companies Act 2013
