    Honestly, it feels like there is no point in following the monthly VB anymore. It follows no statistical probability pattern whatsoever and every new VB issue is a surprise on its own. NVC should publish a visa aging report showing the visa queue for EACH INDIVIDUAL COUNTRY. This ROW category does not work! E.g., one can't compare the U.S. visa demand from Nigeria with that from Norway. Every chargeability area should be looked at individually, like it is done for India, China, Mexico and the Philippines. Unless they want to increase the visa quota, which will open a whole new Pandora's box.

    For everyone- STOP WAITING. THERES NOTHING YOU CAN DO ABOUT IT. IT'S OUT OF OUR CONTROL. F1 FAMILY PREFERENCE UNMARRIED CHILDREN ABOVE 21 IS A DEAD CATEGORY. SLOW MOVEMENT MEANS NO MOVEMENT AT ALL. JUST ACCEPT THAT YOURE NOT GONNA BE REUNITED WITH YOUR US FAMILY. MANY CHILDREN HAVE DIED AND AGED OUT WAITING. WE NEED TO GET MARRIED AND MOVE ON WITH OUR LIVES NOW.

    Family categories are such a disappointment no wonder why they always have so much spillover. They aren't moving the dates then come the end of the year all the number are spillover when there is a massive backlog

    I disagree about your prediction based on the note from the DoS. The definition of the word throughout means something different than the conclusion you have drawn.
    Let us use f4 as an example.
    If it moves 4 weeks per month until the end of the fiscal year that will bring it upto November which would bring it in line with a complete consumption of the available visas. This would be good.
    If the dates only move forward by 4 weeks until the end of the fiscal year that would mean that somewhere around 40k or more f4 visas would be wasted this year. That would be bad.
    An in-depth understanding or explanation of the word “throughout” is needed.

      Same opinion. Mr.Jacob hasn’t explained well about this. Based on previous Section E in Charlie’s era, the last one in early 2020, Mr.Charlie clearly said potential “monthly” movement. This section E which is created under the new Visa Office leadership makes readers confused about the upcoming availability of Family-based visas (the employment is clear). However, given the already-issued visas up to January 2024 for F1, F2A, F2B, F3 and F4 are: 30%, 13%, 29%, 16% and 19% respectively, the anticipated pace if we interpret for the whole quarter 3 and 4 will result in loss of lots of visas. That makes no sense.

      It also doesn’t help when consulates with Juarez as an example will do their entire years worth of visa category in a single month and they don’t tell you which month it will be then even though a persons priority date is current they won’t tell them why they are not being scheduled for an interview and the applicant has no idea they have to wait until the next fiscal year. Those consulates really make things bad for applicants who use them which means a person has to watch their consulates visa statistics to know if there are even any visas available to them.

    Now, I am hoping to get an explanation about how the VB movement is useful or exciting to someone whose priority date since a long time ago is before the indicated priority date or the category of his case is “C” but not receiving any communication from USCIS or NVC that enables him to proceed the next step or learn the status of his case?

    • @SanDiegoImmigrationlawyer
      @SanDiegoImmigrationlawyer  6 месяцев назад +1

      A "Current" category (C) on the Visa Bulletin means you can file for your green card regardless of priority date, so it's good news! No USCIS update is needed to proceed - check their website for filing instructions.

      @@SanDiegoImmigrationlawyer As you know and I read from an online reference, Family Green Card applications have four basic phases:
      1) Petition 2) Application,3) Interview, and 4) Final Decision.
      A VB, as it uses PDs, serves to inform the status of the second phase for commencing either DS 260 or I-485 depending on where a case is to proceed. That is after receipt of I-797 C. However, the real commencement of the second phase is after you receive a case creation status or I-797 from NVC/USCIS. My comment is VBs show your PD but you do not receive any communication for a real commencement of the second phase, or your case’s denial or RFE or so. This may be due to a VB using PDs that are shared by many cases all over the world. As to the Cs, in my case of for abroad processing (not for adjusting status) in my understanding still refer to PDs [any PDs] needing those communications to proceed to the second phase. For concurrent filing of 130 and 485 as 1st phase, knowing C could help if filing them done quickly. Thanks for your help.

    • @FG42
      @FG42 6 месяцев назад +2

      It is a hard to understand note. However the definition of “throughout” means every point within. So legally speaking it should mean the movement listed is expected every month. It seems like a lot but in most fb categories it would only bring those categories upto where they should be to consume all of the visas available in fy 2024 if the consumption rate remains the same as it was previous to the history covid event.

    • @FG42
      @FG42 6 месяцев назад +1

      However with a sixty day delay between visa bulletin movement and interview taking place this means that all visas for the last two months will be wasted which still leaves 10s of thousands of unused fb visas this fiscal year.

    Date for family filling chart sounds confusing for me now based on what you stated that the person has to be in the US ground . Does it mean that the person (applicant) has to be in the US ?

    • @SanDiegoImmigrationlawyer

      There are categories for family members already in the US (adjustment of status) and those abroad (consular processing). Being present doesn't violate if entered legally.

    My PD is December 25th 2022, rest of the world for the EB-3 category, do you think it's feasible that I would be current on the next visa bulletin or the one after? Or is it way too far for it to become current?

    • @SanDiegoImmigrationlawyer
      @SanDiegoImmigrationlawyer  5 месяцев назад +1

      Predicting future Visa Bulletins is difficult, but December 2022 for EB-3 Rest of World is likely too early to be current anytime soon.

      Processing times vary, but 15 years is unlikely for a US citizen petitioning for a married child. Expect months, not years

    We had a GC application which became current in 2020 jan.
    We had moved out of US while on Work Permit to India to work with a wholy owned subsidiary in india of the same company which had applied for our GC.
    I did not respond to the GC interview because we were advised by our company that since im not resident in US and also not employed by the same legal entity in India so we would not be avail the GC interview.
    The company promised that since im in senior manager level i will be able to get a L1 which will enable us to get GC in short time.
    We indicated we want to return to US since 2021.However so far since then the company has been unable to find us an appropriate opening in US where they can justify a L1 Visa..
    I want to know if we have any chance to revive the GC application?
    Alternatively my son is a US citizen is 18 but he will be in india studying when he turns 21 in 4 years. Will he be able to sponsor our GC in family based category. ?
