Exceptionally Good honest Inview with Peter Bleksley ,it so refreshing to listen to Adult conversation without being Verbally abused/abusive . Agree 💯 percent with everything said , and it actually gives you some hope that there is someone in Authority that might listen and have a backbone to at least approach these subjects in the same manner and actually start making plans and taking action so we can progress to having a proud , safe Great Britain for our children's future.
I agree but time is running out. Our birth rate is under 2 children per family so not enough to replace ourselves whilst the Muslim birth rate is far larger. By then the Muslims will want sharia law & eventually establish an Islamic caliphate. This is their goal and the commands come straight from the Qur’an. We would have to act fast
Peter is a national treasure, he would be a fantastic mayor in the city he was born, raised and worked in. We can dream... Thank you for a great interview Liam...Godspeed Peter.
A fantastic and reasssuring interview to know I’m not the only one in despair. I found Peter got better and better, more relaxed and relatable as it went on. Top class from you both!!
Peter is a straightforward man of wisdom,he should be police commissioner as he has actually done the job and has his feet firmly on the ground , he actually knows what he’s talking about,I wish kier would listen to this podcast and take it in
What I don't understand is the sheer number of police in London who look and sound like they just got off the last boat across the channel. It's like Mr Khan is building an army of immigrants to keep the native population in line.
@petermackay1929Yes I saw that. So I thought they were behind it until Oct 7. It was like a flare going up and exposing everyone's position. Whatever sinister force at work are in charge of the universities and unions that's a given. These two entities have been marching with the river to the sea signs every weekend. So I don't think it's them.
@petermackay1929 your repeating the same line in every comment section you troll . Europe doesn’t have to accept anything & all these stabbings across Europe is going to put an end to uncontrolled mass migration.
I think this is my favourite podcast to date I love the old schoolness of this, Liam thank you so much for mentioning crimes against women because as I was watching I actually said that out loud just before you mentioned it and I don't feel this is emphasised enough having two daughters myself my 22 year old who was wearing a short skirt and shorts underneath add two men who were the same age as her dad uplifting her skirt she didn't want to report it to the police because she didn't think it would be taken serious enough it would be great if you specifically did a podcast about crimes against women and how so few actually end up going to court with successful prosecutions and justice thank you for always having podcasts that are just so real and raw
They have been washing up on our shores for many years not just now Labour in power,Conservatives had 10 years remember so imagine how many gave come in their reign,Labour and Conservatives are the same rubbish.
That's nearly 6000 people that need to be immediately houses, fed, treated, given money list goes on and on. No one. No one can rock up to any country without any identification and start working and paying rent, Bills and taxes. If I went to another country with a passport, with skills and can speak the language it would take me weeks if not months to afford to pay for a deposit and upfront rent for an apartment or room. Take weeks to get a bank account, phone account and so on and so on. Driving licence!!?????!??? How are they all getting these things instantly that takes even born and bred Brits months and months to set up. Its all just immediate benefits.
Bang on Guy's. Well done. Great to watch 2 English Gentlemen have such an in depth conversation. Also hearing the Cockney always warms my heart as my dear old mum was one too. Sadly she passed when i was 9. Thank you both so much and be safe ❤
What are these 6000 police officers doing when theres no riots, as there are no police ever available. Which is why we are fobbed off with a crime reference number!
Interviews mate absolutely superb of this! Peter he’s so good at calling out what is really going on with regards to tier policing and our current situation in this country. 👏🏻👏🏻
Says he’ll never run for any kind of office, but a political party should definitely try to get him as an advisor to create, and publish a plan as to exactly what they will do if they get in to power. I would say the government, but Sir Kier Stalin clearly has no interest whatsoever in stopping the knife & drug epidemic we’re currently facing!
He’s actually encouraging it because it undermines the white British born spirit, that’s how you start the rot, make the people of that country feel ashamed of their own flag & culture & values. Go & listen to a man called Christopher Hitchens, he foretold all this some 30 years ago.
A Fantastic interview once again Liam. I’ve always had so much respect for Peter. He radiates a feeling of safety, openness and tells it how it is but, equally is accountable and admits his shortcomings too. Brilliant work once again xx

My god peter is such a refreshing down to earth man its such a pleasure to here with such clarity and passion such common sence,he should re write the book on policing and maybe we would start to regain some respect and belief in the police as a whole
An honest and transparent dialogue from Peter Bleksley. I can't agree with him on drug legalisation though... It's an important moral issue that has already taken place and facilitates crime. We should strive to stop offenders from doing it as it gets worse year on year
Well done Liam, your getting better with every podcast, i enjoyed that, and your letting them speak, only breaking in to ask or clarify .....well done!!
I'm new to your channel and thoroughly enjoyed this conversation. It's refreshing to here from an ex Police officer/ Detective who is 💯 grounded and openly admits to his faults and how he learnt from them ....the gift of failure .... But more importantly, his views and honest opinions on Drugs and the Illegal immigration crisis and how to, specifically with the Global Drug Problem. Tbh, I've never used drugs but i do know many people who have used and we've always maintained the idea of making all Drugs Legal and Regulated to be the way forward... Long term it will drastically reduce overall Crime and save Governments Billions of pounds ....money that could be better spent and invested elsewhere. Imho those Politicians who would be opposed to this idea, probably have a vested interest in the Companies involved in the Prison System or maybe are getting kickbacks from the Drug Gangs... Just locking People up is counter productive. So unless they're getting a financial incentive somewhere why would they oppose such an idea??
I love this gentleman for having no bias and saying as it is.. fact is every carribean, indian, asian of that generation says exactly what he pointed out.. nowadays this generation has 0 self respect, goals because gov took over parenting, education etc.. you cant tell these kids off with the police showing up at your door or their parents and extended families.. everything thats happening is because of that.. no accountability for anyone, I came from Swaziland legally and have never had an issue here.. because of the old Ps and Qs, respect your elders..just that would change UK. I pushed hard and semi retiring before 40 because im accountable to myself, family, wife, neighbour, even tbe government because boy do i pay lots of taxes from every angle. I saw this happening 10 years ago when i saw no respect in British society.. gov trying to be parents, nothing to do with immigration, even though now theres lots to do with illegal immigration... kids saying the F.. word to their parents.. black, brown British born and mostly white in lower income areas... i know being a tradesman.. its a mix of things that brings us to this chapter right now..
Fascinating. I had a cousin in the Met who loved every second of it. He was at the Brixton riots, Broadwater Farm, Harrods bomb, Clapham Rail etc. Great stories.
Peter Bleksley was spot on, in fact it should be Sir Peter Bleksley, you should be up there as the chief of police instead of the, In my opinion "coward" that is in charge at the moment, we need decent Coppers such as yourself that isn't affraid to tell the truth as it is, that are not affraid to build that bridge with local communities, to make this country a safe place for ALL that live here, well done Sir, i take my hat off to you.
I stand by the officer in the airport. If it was the US he wouldn't be here. Fact. His job was to protect his colleagues, innocent public and the airport. That airport event, Leeds riots, the soldier, the kids and the coldness and ignorance from Stalin was the final nail in the coffin.
Yes and if you watch the whole clip he'd just been belted and dragged down to the floor whilst armed. He turned around and did what he could only do to subdue the nutter. The second kick was more of a problem but how was he to know it wasn't a fully flegged T attack.
In the UK, the criminal procedure from arrest to prison involves several key stages, each with its own legal processes and protections for the accused. Here’s a breakdown of the journey: ### 1. **Arrest** - **Reason for Arrest**: A person may be arrested by the police if they are suspected of committing a crime, have been caught in the act, or there is a warrant for their arrest. - **Rights Upon Arrest**: The arrested person must be informed of the reason for their arrest and their rights, including the right to remain silent and the right to legal representation (solicitor). ### 2. **Detention and Police Custody** - **Custody Officer**: Upon arrival at the police station, a custody officer will review the arrest and determine whether there are sufficient grounds to continue holding the person. - **Interrogation**: The suspect may be questioned, but they have the right to have a solicitor present during interviews. - **Time Limits**: Generally, the police can detain a person for up to 24 hours without charge. This can be extended to 36 hours for more serious crimes and up to 96 hours for the most serious offences like terrorism. ### 3. **Charge or Release** - **Charging**: If there is sufficient evidence, the Crown Prosecution Service (CPS) will charge the suspect with a crime. If there is insufficient evidence, the suspect may be released, sometimes under investigation. - **Bail**: The suspect may be released on bail, with or without conditions, pending further investigation or court appearance. Bail may be denied if the court believes the suspect might flee, interfere with witnesses, or commit further offences. ### 4. **Court Appearances** - **First Hearing**: The first court appearance usually occurs at a Magistrates’ Court. Here, the charges are read, and pleas are entered. - **Types of Offences**: - **Summary Offences**: Minor offences are typically dealt with in the Magistrates' Court. - **Either-way Offences**: These can be heard in either the Magistrates’ Court or Crown Court, depending on the severity. - **Indictable Offences**: Serious offences are sent directly to the Crown Court. ### 5. **Trial** - **Magistrates' Court**: For minor offences, trials are conducted by magistrates (lay judges) or a district judge. The magistrates decide the verdict and impose a sentence if the defendant is found guilty. - **Crown Court**: For serious offences, a trial is conducted before a judge and jury. The jury decides the verdict, and the judge determines the sentence if the defendant is found guilty. ### 6. **Sentencing** - If found guilty, the court will impose a sentence, which could range from a fine or community service to imprisonment. The sentence is based on the seriousness of the offence, any mitigating factors, and relevant sentencing guidelines. - **Appeals**: The defendant has the right to appeal a conviction or sentence if there are grounds to believe a legal error occurred. ### 7. **Prison** - **Transfer to Prison**: If sentenced to imprisonment, the individual is transferred to a prison. The type of prison (category A, B, C, or D) depends on the severity of the crime and the perceived risk of escape or harm. - **Time Served**: Most prisoners serve half of their sentence in custody before being released on licence, where they are subject to conditions. Early release may be granted for good behaviour. - **Parole**: For longer sentences, particularly life sentences, parole may be considered after a set period. ### 8. **Release** - **Licence and Probation**: Upon release, the individual may be on licence, meaning they must comply with certain conditions and may be supervised by a probation officer. - **Reintegration**: The aim is to reintegrate the individual into society, but breaches of licence conditions can result in a return to prison. Throughout the entire process, the accused has rights designed to ensure a fair trial, and legal procedures must be followed to uphold justice. Yes, in the UK, everyone has the **right to a fair trial**. This is a fundamental principle of the legal system and is protected by both domestic law and international human rights standards. Specifically, the right to a fair trial is enshrined in: ### 1. **Common Law** - The principle of fairness in trials has long been part of the UK's common law tradition. Judges have a duty to ensure that trials are conducted fairly, and this is a core element of British justice. ### 2. **Human Rights Act 1998** - The Human Rights Act 1998 incorporates the European Convention on Human Rights (ECHR) into UK law. Article 6 of the ECHR specifically guarantees the right to a fair trial. ### 3. **Article 6 of the European Convention on Human Rights (ECHR)** - **Article 6(1)**: Provides the right to a fair and public hearing within a reasonable time by an independent and impartial tribunal established by law. This applies to both civil and criminal cases. - **Article 6(2)**: Establishes the presumption of innocence, meaning anyone charged with a criminal offence is considered innocent until proven guilty. - **Article 6(3)**: Details specific minimum rights for anyone facing a criminal charge, including: - The right to be informed promptly, in a language they understand, of the nature and cause of the accusation against them. - The right to have adequate time and facilities to prepare their defence. - The right to defend themselves in person or through legal assistance of their own choosing. If they cannot afford legal assistance, they have the right to free legal aid if the interests of justice require it. - The right to examine witnesses against them and have witnesses on their behalf. - The right to have the free assistance of an interpreter if they cannot understand or speak the language used in court. ### **Ensuring a Fair Trial** Several measures are in place to ensure a fair trial in the UK: - **Impartial Judiciary**: Judges must be impartial and free from any bias. They are responsible for ensuring that the trial is conducted fairly. - **Right to Legal Representation**: The accused has the right to be represented by a lawyer, and in some cases, legal aid may be provided to ensure this. - **Right to Public Hearing**: Trials are generally open to the public and media to ensure transparency, though some proceedings may be held in private under specific circumstances (e.g., to protect national security or vulnerable witnesses). - **Adversarial System**: The UK operates an adversarial system, meaning that the prosecution and defence present their cases, and the judge or jury determines the outcome based on the evidence presented. - **Disclosure of Evidence**: The prosecution must disclose all relevant evidence, including any that might be favourable to the defence. In summary, the right to a fair trial is a cornerstone of the UK’s legal system, ensuring that justice is administered fairly and equitably for all individuals. Yes, sending a person to prison without a fair trial would be considered unlawful and a violation of their fundamental rights. If a person is convicted and imprisoned without being granted a fair trial, the conviction could be deemed **null and void**. Here’s why: ### 1. **Legal Invalidity of an Unfair Trial** - A trial that does not meet the standards of fairness, as outlined by UK law and international human rights conventions, is not legally valid. If a conviction is obtained through a process that violates the right to a fair trial, it can be challenged and potentially overturned on appeal. ### 2. **Right to Appeal** - The person who has been imprisoned has the right to appeal their conviction or sentence if they believe that their trial was not fair. An appellate court can quash the conviction, order a retrial, or, in some cases, order the immediate release of the individual if it finds that the trial was fundamentally unfair. ### 3. **Remedies for Unfair Trials** - If a court determines that a person’s right to a fair trial was violated, several remedies may be available: - **Quashing the Conviction**: The conviction can be overturned, making the imprisonment invalid. - **Compensation**: The person may be entitled to compensation for unlawful imprisonment and the breach of their rights. - **Retrial**: In some cases, the court might order a retrial if it believes that a fair trial is still possible. ### 4. **Legal Precedent and Human Rights Law** - The principle that no one should be deprived of their liberty without due process is a core tenet of both UK common law and the Human Rights Act 1998. Courts are very strict in upholding this principle, as it protects individuals from arbitrary and unjust treatment by the state. ### 5. **International Human Rights Standards** - The European Court of Human Rights (ECHR) also plays a role in ensuring fair trials. If a person in the UK exhausts all domestic remedies and still believes their trial was unfair, they can take their case to the ECHR, which can rule that the UK has violated its obligations under the European Convention on Human Rights. ### **Consequences of an Unfair Trial** - **Nullity of Imprisonment**: If a trial is found to be unfair, the imprisonment that follows is considered legally null, meaning it has no lawful basis. - **Protection from Arbitrary Detention**: This protects individuals from being detained or imprisoned by the state without proper legal justification, ensuring the rule of law is upheld. In summary, imprisoning a person without a fair trial is not only a violation of their legal rights but also makes the imprisonment itself null and void under UK law. The justice system provides mechanisms to correct such injustices, including the potential reversal of convictions and the release of wrongfully imprisoned individuals.

My daughter got her car blown up and 2 neighbours cars did also, the police took her name and left after 5 minutes.. it took me to contact my MP to raise a complaint to them and 1 month later they decided to visit asking questions, by that time any evidence was gone.. honestly shocking service.
Where do u live!

Belting.. Love this guy..I could listen to his stories all day long 🌿🌿🇬🇧🇬🇧🇬🇧
PETER IS A LEGEND. LOVE THIS BLOKE ..SPEAKS SO MUCH SENSE..SHOULD BE PM OR HEAD OF METROPOLITAN POLICE ..FOR A SAFER COUNTRY …KEEP GOING PETER 🇬🇧🏴
*Bleksley
I agree but time is running out. Our birth rate is under 2 children per family so not enough to replace ourselves whilst the Muslim birth rate is far larger. By then the Muslims will want sharia law & eventually establish an Islamic caliphate. This is their goal and the commands come straight from the Qur’an. We would have to act fast
Absolutely love Peter, top geezer!! Thanks Liam for having such a great man on the podcast 👍
So refreshing to hear you speak Peter.....we could do with so much more from you......TALKING TO THE BRITISH PUBLIC.
Peter is a diamond and speaks facts!
Peter is a national treasure, he would be a fantastic mayor in the city he was born, raised and worked in. We can dream... Thank you for a great interview Liam...Godspeed Peter.
Peter would make an exceptional Mayor of London, it’s a shame he feels too long in the tooth to do it now. Godfrey bless you Peter !
A fantastic and reasssuring interview to know I’m not the only one in despair. I found Peter got better and better, more relaxed and relatable as it went on. Top class from you both!!
Brilliant interview I have great admiration for Peter Bleksley.
This interview was just an hour or so of complete and utter ,COMMON SENSE!!!! WELL DONE!!!!
one of the best
Peter is a straightforward man of wisdom,he should be police commissioner as he has actually done the job and has his feet firmly on the ground , he actually knows what he’s talking about,I wish kier would listen to this podcast and take it in
Peter for mayor off London
Mayor of London would be even better !
Peter would make an awesome London mayor 😊
What I don't understand is the sheer number of police in London who look and sound like they just got off the last boat across the channel. It's like Mr Khan is building an army of immigrants to keep the native population in line.
He probably is.
@petermackay1929oh shut up with your bloody rubbish
That’s exactly what he’s doing, Islamists are being allowed to take over this country, it will be turned into Mogadishu before you know it !!!!! 😡😡😡
5.500 crossed our shores in the first 50 days of Labour being in number 10 .😮
All by design
They have been washing up on our shores for many years not just now Labour in power,Conservatives had 10 years remember so imagine how many gave come in their reign,Labour and Conservatives are the same rubbish.
just that is 5 of them for every single town in Eng and Wales
That's nearly 6000 people that need to be immediately houses, fed, treated, given money list goes on and on. No one. No one can rock up to any country without any identification and start working and paying rent, Bills and taxes. If I went to another country with a passport, with skills and can speak the language it would take me weeks if not months to afford to pay for a deposit and upfront rent for an apartment or room. Take weeks to get a bank account, phone account and so on and so on. Driving licence!!?????!??? How are they all getting these things instantly that takes even born and bred Brits months and months to set up. Its all just immediate benefits.
so quite a lot less than under the tories then ,i think their 5 day record was 8.2 k
Thank you Liam and Jim. Brilliant ❤
Thanks for the video Peter is the best comissioner of the met that we never had. Shame. Last of the good coppers
Beautiful cast, amazing guest in Peter. Class man, said it straight said it right, bang on.
Thanks to both of you for a great time listening to two nice people chatting with common sense it's been a pleasure watching you Thanks ❤😂🎉😢😮😅😊
The only copper I actually admire Peter Bleksley
Love to listen to Peter my dad died at 54 and was a good man with principles Peter your views are so refreshing to listen too ❤️
bleks you are an absolute Diamond 👌👌
I have never not enjoyed anything Peter has ever done. He’s a very clever, experienced man! A lot can be taught by him!
Arresting people for social media posts.
running away from real dangerous thugs , ignoring grooming gangs and arresting pol for posts that hurt their pc feelinga
Reasonable dialogical analysis by Peter B, excellent interview Liam 🇬🇧👍
Interviews mate absolutely superb of this! Peter he’s so good at calling out what is really going on with regards to tier policing and our current situation in this country. 👏🏻👏🏻
Just imagine if Peter and others of the same ilk were in charge of policing in this country , would be a game changer
Peter, you are a legend. I love listening to you. Respect. Bless you for speaking truth.
No he isn't I admitted what did in past did doesn't class him a lengend
Says he’ll never run for any kind of office, but a political party should definitely try to get him as an advisor to create, and publish a plan as to exactly what they will do if they get in to power.
I would say the government, but Sir Kier Stalin clearly has no interest whatsoever in stopping the knife & drug epidemic we’re currently facing!
He’s actually encouraging it because it undermines the white British born spirit, that’s how you start the rot, make the people of that country feel ashamed of their own flag & culture & values. Go & listen to a man called Christopher Hitchens, he foretold all this some 30 years ago.
That was a brilliant interview.
Absolutely hitting the nail squarely on the head.
That should be put on mainstream Tv.
Well done
A Fantastic interview once again Liam. I’ve always had so much respect for Peter. He radiates a feeling of safety, openness and tells it how it is but, equally is accountable and admits his shortcomings too. Brilliant work once again xx
Peter would make a very good Police Commissioner 🇬🇧💪
Watched/listened on my way to, at and from the gym this morning, and finished up on the TV with a coffee when I got back! What a bloke! Thanks Liam for asking all the questions that were preying on my mind!
Great job lads!
Brilliant interview, thanks Liam.
There are so many good and chivalrous men out there still, which is plenty reassuring.
Liam what a fabulous interview . Got a soft spot for Peter 😊 but he speaks the truth
Love this guy, he says exactly how it is!!
Two of my favs!
Your interview was ace Paul. Good to see you all come together ❤️
Liam, get BlackBeltBarrister on
My god peter is such a refreshing down to earth man its such a pleasure to here with such clarity and passion such common sence,he should re write the book on policing and maybe we would start to regain some respect and belief in the police as a whole
I've great respect for Peter. 🙂
An honest and transparent dialogue from Peter Bleksley. I can't agree with him on drug legalisation though... It's an important moral issue that has already taken place and facilitates crime. We should strive to stop offenders from doing it as it gets worse year on year
Peter is truly wonderful human being; this man has done so much and been to all the places none of us would ever want to be. Bless you sir
Love Peter ❤️ Cheers 👍
Well done Liam, your getting better with every podcast, i enjoyed that, and your letting them speak, only breaking in to ask or clarify .....well done!!
Ahh I only caught the last 10 minutes! Hope this gets uploaded ASAP. Peters a top geezer
The police need to serve all people, not be the government bully boys or racist. Theres so much wrong now with all this.
Brilliant. Enjoyed this one Liam
This man speaks so much truth I could listen to him talk all day, go on Peter
This guys amazing and I've always liked his views
Peter is honest!! & Refreshing!!
It's a cliche I know but the Met only Police the Tweets not the Streets.
Nice rhyme 💫
Nice one Liam this guy is a man after my own heart, utter respect for his principles. Keep up the good work tuffs.
Peter has had a massive awaking in the last couple of months. He's speaking with no apologies. He's the generation I miss!
Fair play Peter a very smart man and honest about the whole racism thing respect it , takes a man to admit he was wrong 👊🏿♥️
That was a great interview. Thanks for sharing Liam. Cheers.
Thank you for this. There’s lots of like minded folks out here.
The best podcast yet and what a top bloke Peter is. He speaks absolute common sense, seems simple doesn't it?
Peter should be PM! He knows more about politics than anyone in parliament!
Amazing podcast! Thank you very much!
No he shouldn't
I love hearing Peter...he tells it as it is...no bars & no bull!! God bless you, keep going Peter, we're all behind you. 🙏🇬🇧🇮🇱💜
What a great guy reminds me of my grandad he was a copper too
This is the type copper we were terrified of as kids, bring back the old school British bobby! What a legend
You didn’t hear the part of him admitting he became part of the racist thuggish cop culture that targeted blacks ?
I stand by the officer in the airport. If it was the US he wouldn't be here. Fact. His job was to protect his colleagues, innocent public and the airport. That airport event, Leeds riots, the soldier, the kids and the coldness and ignorance from Stalin was the final nail in the coffin.
Yes and if you watch the whole clip he'd just been belted and dragged down to the floor whilst armed. He turned around and did what he could only do to subdue the nutter. The second kick was more of a problem but how was he to know it wasn't a fully flegged T attack.
This man needs to be put in charge massive respect to him❤
I respect Peter Bleksley.
In the UK, the criminal procedure from arrest to prison involves several key stages, each with its own legal processes and protections for the accused. Here’s a breakdown of the journey:
### 1. **Arrest**
- **Reason for Arrest**: A person may be arrested by the police if they are suspected of committing a crime, have been caught in the act, or there is a warrant for their arrest.
- **Rights Upon Arrest**: The arrested person must be informed of the reason for their arrest and their rights, including the right to remain silent and the right to legal representation (solicitor).
### 2. **Detention and Police Custody**
- **Custody Officer**: Upon arrival at the police station, a custody officer will review the arrest and determine whether there are sufficient grounds to continue holding the person.
### 3. **Charge or Release**
- **Charging**: If there is sufficient evidence, the Crown Prosecution Service (CPS) will charge the suspect with a crime.
### 4. **Court Appearances**
- **First Hearing**: The first court appearance usually occurs at a Magistrates’ Court. Here, the charges are read, and pleas are entered.
- **Types of Offences**:
- **Summary Offences**: Minor offences are typically dealt with in the Magistrates' Court.
- **Either-way Offences**: These can be heard in either the Magistrates’ Court or Crown Court, depending on the severity.
- **Indictable Offences**: Serious offences are sent directly to the Crown Court.
### 5. **Trial**
- **Magistrates' Court**: For minor offences, trials are conducted by magistrates (lay judges) or a district judge. The magistrates decide the verdict and impose a sentence if the defendant is found guilty.
- **Crown Court**: For serious offences, a trial is conducted before a judge and jury. The jury decides the verdict, and the judge determines the sentence if the defendant is found guilty.
### 6. **Sentencing**
- If found guilty, the court will impose a sentence, which could range from a fine or community service to imprisonment. The sentence is based on the seriousness of the offence, any mitigating factors, and relevant sentencing guidelines.
- **Appeals**: The defendant has the right to appeal a conviction or sentence if there are grounds to believe a legal error occurred.
### 7. **Prison**
- **Transfer to Prison**: If sentenced to imprisonment, the individual is transferred to a prison.
### 8. **Release**
- **Licence and Probation**: Upon release, the individual may be on licence, meaning they must comply with certain conditions and may be supervised by a probation officer.
Specifically, the right to a fair trial is enshrined in:
### 1. **Common Law**
- The principle of fairness in trials has long been part of the UK's common law tradition. Judges have a duty to ensure that trials are conducted fairly, and this is a core element of British justice.
### 2. **Human Rights Act 1998**
- The Human Rights Act 1998 incorporates the European Convention on Human Rights (ECHR) into UK law. Article 6 of the ECHR specifically guarantees the right to a fair trial.
### 3. **Article 6 of the European Convention on Human Rights (ECHR)**
- **Article 6(1)**: Provides the right to a fair and public hearing within a reasonable time by an independent and impartial tribunal established by law. This applies to both civil and criminal cases.
- **Article 6(2)**: Establishes the presumption of innocence, meaning anyone charged with a criminal offence is considered innocent until proven guilty.
- **Article 6(3)**: Details specific minimum rights for anyone facing a criminal charge, including:
- The right to be informed promptly, in a language they understand, of the nature and cause of the accusation against them.
### **Ensuring a Fair Trial**
Several measures are in place to ensure a fair trial in the UK:
- **Impartial Judiciary**: Judges must be impartial and free from any bias.
Here’s why:
### 1. **Legal Invalidity of an Unfair Trial**
- A trial that does not meet the standards of fairness, as outlined by UK law and international human rights conventions, is not legally valid. If a conviction is obtained through a process that violates the right to a fair trial, it can be challenged and potentially overturned on appeal.
### 2. **Right to Appeal**
- The person who has been imprisoned has the right to appeal their conviction or sentence if they believe that their trial was not fair. An appellate court can quash the conviction, order a retrial, or, in some cases, order the immediate release of the individual if it finds that the trial was fundamentally unfair.
### 3. **Remedies for Unfair Trials**
- If a court determines that a person’s right to a fair trial was violated, several remedies may be available:
- **Quashing the Conviction**: The conviction can be overturned, making the imprisonment invalid.
- **Compensation**: The person may be entitled to compensation for unlawful imprisonment and the breach of their rights.
- **Retrial**: In some cases, the court might order a retrial if it believes that a fair trial is still possible.
### 4. **Legal Precedent and Human Rights Law**
- The principle that no one should be deprived of their liberty without due process is a core tenet of both UK common law and the Human Rights Act 1998. Courts are very strict in upholding this principle, as it protects individuals from arbitrary and unjust treatment by the state.
### 5. **International Human Rights Standards**
- The European Court of Human Rights (ECHR) also plays a role in ensuring fair trials. If a person in the UK exhausts all domestic remedies and still believes their trial was unfair, they can take their case to the ECHR, which can rule that the UK has violated its obligations under the European Convention on Human Rights.
### **Consequences of an Unfair Trial**
- **Nullity of Imprisonment**: If a trial is found to be unfair, the imprisonment that follows is considered legally null, meaning it has no lawful basis.
BULLSHIT ,.... The law is 99% corrupt at ALL levels,....!!!!!!!!
Brilliant interview Liam. Two of my favourite commentators having a good ole chat. Plus am I the only person who can listen to the common sense attitude of Peter all day long?👌
Good interview. Peter is amazing. He’s an absolute diamond. He has something that has been lost in society which is common sense his views on everything he said politically and about the police surely resound in the whole of the UK population.
Peter should have been a commissioner
Old school up front .
Great podcast and great guest, lovely to listen to people with sense xx
One of the best videos I've ever ever seen !! I don't like the old bill, because of what they have become, but I utterly and truthfully like, respect, and enjoy listening to this man's opinions, story's, conspanrancy, and nature. He is an absolute legend and decent human being !!!!! It's appalling the current state of the UK and if more politicians, people, businesses, companies amd agencies took upon themselves to have an inch of what that man owns and values the country would be a better place. He's an inspiration to what is right and decent and I adore the fact his opinions and experiences are shared for all to acknowledge
what fantastic podcast, i think peter has a lot in common with the old school criminals, women and children untouchable, police informer dirty grass, hope you can get a part two liam, the time just flew by mate
