    I'll never forget my mom telling me if these were sisters they never would have been arrested. That was back when they were first arrested before the trials. Crazy so much has come out since then too

      That is definitely NOT true. Women do not typically BRUTALLY kill someone twice for alleged abuse that happened a long time ago when they were 11. When women do that type of brutality they get the SAME punishment as these brothers did. For example, Jodi Arias said her boyfriend was abusing her but similarly could not convince an entire jury of that and because she brutally killed her boyfriend she got life without parole. Nothing has “come out” to erase the brutality in these brothers’ crimes and nothing has “come out” to erase the 61 minute Oziel tape where the brothers state their reasons for killing the parents very coldly and those reasons have nothing to do with abuse.

      TF are you talking about. Gypsy Rose did her entire sentence. She was incarcerated for 8 of her 10 year sentence and then got parole. This when there was clear public evidence that she was abused. She didn't get pardon or anything. Her bf who did the actual murder got life in prison without parole, and is not getting out of jail. So yeah exactly like Gypsy Rose, Menendez are also gonna serve their sentence, which is life without parole. Abuse is no excuse to murder. If one is abused, report it to authorities, fight it out. Only the self defense when life is in danger scenario murder might be excusable and even then its not easy unless you are cop.

    In one interview, a female cousin said that when they were sentenced to life, she said something to Lyle and and Lyle said something like, “Diane. Don’t. I feel safer in prison than with mom and dad.” That’s very telling.

Good people always feel guilty after killing their victims despite the fact that the victims had abused them. So being in prison helps to compensate their trauma.

    Six weeks before she died Kitty told her Psychiatrist she was "Hiding sick and embarrassing secrets about her family". She knew what was going on. I'm no expert but I believe she suffered from a mental illness and didn't want to get help. Family members say she displayed odd behavior at times. One time she threatened to poison the family and she would also fly into rages and throw dishes. Family members also stated she would talk about how she wished her boys hadn't been born. I wont get into the abuse the boys say they suffered at her hands, but the women clearly had issues. She was not the innocent thing some people make her out to be. Both brothers say they saw Jose physically abuse Kitty. It's just a crying shame and so sad she sided with a husband that not only abused her and her children, but other children as well.

      I mean TBF if the movie shows ANY truth (and we know some pieces are VERY truthful) that part where one of them was talking about how the mom would lay naked on the couch and then have them come lay next to her. Like... that's not JUST sick, that is mental illness and from what i have seen over the years it is because she probably experienced that and thought it was normal but it also may have been sexy to her in a sick way. Perverts do perverted things because it turns them on. It's sick. But, it's honest.

    Why does "whole internet" behave like they know exactly what happened? Maybe they are monsters, maybe abused victims but none of us know the truth. I would forbid public appearance for lawyers, they are paid to do their job (which is perfectly fine) in courtroom but not here to convince the public in someone's innocence.

    Hockman has already let his opinion be known publically BEFORE he has even talked to defence and the 25 family members less one in favour of release. That is exactly what he SAID HE WOULDNT DO to heaps of programs when elected. Whether Hockman actually has any say now or all the say is with the judge I'm not 100 percent sure. But it sure didnt take Hockman long to show his biased opionion and remove two deputies on the case and promote anti release Cade

    As a mother of two children who were victims of SA I can say the brothers deserve a second chance. Trading one hell for another isn’t the answer. It’s just my opinion….

      Hell No. You would not be saying that if your children brutally killed their abuser AND you. They had no legal justification for killing either parent, especially their mother. The brutality of their crime is not something to ignore just because you feel compelled to personalize it to yourself. NO abuse story is the same. There is not even solid evidence or corroboration they were abused.

Their whole world is turned inside out and they live with fear everyday of their lives. My sons predator threatened to kill his mom and sisters if he told and then strangled his cat in front of him. He still lives with fear and anger!

    Most of the victims' family members want the killers to be released. That's unheard of. That means the dead ones were really horrible people if not even their own sisters' want their killers to stay in prison. I have never in my life heard of a case where the victims' family support/defend the killers /testified against the victims. I know because I watch a Lot of true crime AND seen many parricide cases so can compare. In most cases, the victims' family do want the killers to stay in prison for the totality of their sentence even if the killers are family as well.However, this is clearly not the case here and they also have the right to be heard and taken into account under California laws.

    I hope they get released. What they did was wrong but they don't belong in prison forever and even their family thinks that. I saw the trial and what both parents did to them was horrific.

    After watching 8+ hrs of court trial videos and reading the definitive book by Robert Rand on the case, the brothers definitely should’ve been charged with manslaughter and released by now, although not being given the death penalty could be considered a win for the defense and the brothers- considering the attitudes towards sexual abuse, particularly male sexual abuse at the time. The defense had examined 101 witnesses and the prosecution barely any. It is telling that the entire family except for one is advocating for the brothers’ release. I’m no expert, but this is my opinion considering the opinions of the experts. As for the prosecution, they sure did their job acting like emotionless, rigid robots ignoring that human nature is complex, nuanced and messy. The brothers have been model prisoners: helping those who have suffered, creating art etc.
    It is hypocritical to argue that they are being let out due to changing societal attitudes, when the backwards societal attitudes of the time disallowed a proper comprehension of the victims and proper justice to be served - namely a biased judge, a desperate DA, and jurors who were in disbelief despite the testimonies of witnesses under oath, and a second trial barring much of these witnesses and evidence and a judge framing it the way he wants it to go. The verdicts were limited to either acquit or death penalty/life sentence. Also about the expert witnesses on psychology, child abuse, trauma etc. Erik was mentally 8-12 years and Lyle 13/14 respectively. The defense’s case was that they had reasonable belief they were acting out of imperfect self defense. adding this because i have seen people say they were adults when they committed these crimes. Yes they were, but it is all so tricky to put in nice neat organized boxes. The prosecution and judge treated this case as a one and done thing - murder, guilty, life sentence. But this criminal trial was more complex than that. The brothers had every reason to believe their life was in danger.
    It was not about whether the brothers were guilty or not guilty. Yes they were. But they have served their time. Whether it is to say their mental psyche is not fit to be a citizen in the world, well time has shown they have been good. As Abramson said, Erik has had the worst karma, and him and Lyle deserve to have that vacation with their respective wives and families. And as she said again in respect to the argument that the brothers’ motive was for money (disproven due to them thinking they were out of the will and Lyle was to be executor of the estate in a few months etc.): “what do they say when poor kids kill?”
    While I do think crime especially murder and so on is abhorrent, what their parents did too was loathsome. If they did not kill their parents, maybe the headlines would have been about a suicide instead.
    (If someone has more information and alternative angle, please do share. I am happy to research more about the case and also hear about differing views.)

      I think you should read the second trial transcripts and listen to the 61 minute Oziel tape. The defense manipulated some of the people on the juries at the first trial and this was discovered afterwards by the second trial’s prosecutors. Lyle asked family and friends to lie for him and tried paying some people to lie for him. Erik lied numerous times to his psychiatrist Vicary and Attorney Abramson ordered his psychiatrist to redact large portions of his notes that were incriminating so prosecutors could not see them. The second prosecutor obtained the original notes, Vicary’s medical license was suspended, and Attorney Abramson faced misconduct charges with the state bar for 3 years. This was always a first degree case because of the brutality the brothers used in killing their unarmed parents. It is a common misconception that the goal of people on the jury was to determine if mere abuse occurred. The real duty on them was to determine whether or not there was corroboration of both parents abusing the adult brothers so extremely that they were in such imminent fear of them they had no other choice than to kill them. The evidence and corroboration is not there which is why the defense tried to manipulate people from realizing the actual duty with their child abuse stories. Regardless if the dad abused them or not, retaliation killing is illegal and first degree. Lyle had no legal basis to kill either parent because his abuse ended at 11 according to Lyle. Erik testified that his mother never abused him so he had no legal basis to kill her. When someone is guilty of SA or child SA they are sentenced to prison NOT the DP by brutal execution and in the mom’s case DP by brutal execution TWICE. The brothers are self-proclaimed former victims of abuse and also violent felonious murderers and burglars.

I think your opinion is the most well rounded and intelligent I have read from anyone supporting the brothers and I agree that Erik should NOT have ever had his case combined with Lyle's. However, legally if a crime occurs as a result of your initial crime you are legally responsible for that crime. For example, if 5 people rob a bank and 1 of the 5 kills a teller all 5 of them are legally liable for murder because the murder happened as a result of their initial robbery crime. The notion of Judge Weisenberg being biased on this case really has not been proven and can only be believed if someone is unaware that in 1996 he ORDERED both sides to negotiate a plea deal. The brothers adamantly refused anything other than manslaughter when second degree was a reasonable compromise given the brutality of the crimes and given the additional evidence the second trial prosecutors obtained the brothers may or may not have been made aware of. Because the brothers rejected second degree the case went to trial a second time and the jury voted guilty of first degree. In legal cases there are usually mitigating factors but the strength of those mitigating factors lessens depending on the brutality of the crimes and if the mitigating factors are subjective and not irrefutable. The mitigating factors you mentioned are all subjective.
      For example, the faceless photos supposedly of Erik were presented to the juries at the first trial 3 TIMES and proved themselves to be unconvincing. The one medical record of only Erik was subjective as well. Subjective means different people understand it differently. Those photos were very common for the time period. I have seen similar photos of myself in family albums at Erik's age and likely people on the jury have too and also have similar photos of their children at that age in family albums. When a photo is in a family album or in an envelope with a mother's affectionate handwriting "Erik's 6th Birthday Party" that means the parents were not trying to hide the photos nor did they see anything wrong with the photos. Back in the 1980s and before you had to take a camera roll to a store to have the photos printed. That also means the employees at the photo store in NJ did not see anything wrong with the photos either. Erik's one medical report lists a very common injury in children even present day and nowhere on it does the doctor mention it was a result of abuse. The rest of the 8 pieces of SA evidence you refer to are all subjective meaning that an objective person looks at this case as 2 adult brothers charged with killing 2 victims not just 1.
      If you have evidence painting Jose to be an abuser that is not good enough because it does not paint the second victim to be an abuser. Also, mere abuse is NOT strong enough legal justification for the brutality of their crimes. The evidence NEEDED to be irrefutable evidence that BOTH parents were abusing their adult sons EVERY DAY, and keeping them captive in that house. WHY? Because the legal penalty for SA or child SA is prison sentence NOT the DP by brutal execution and in the mother's case the DP by brutal execution TWICE. One thing to keep in mind is that ALL of the jury members that voted against the brothers at the first trial said they had empathy and sympathy for the brothers' plight but they did not find corroboration of their accusations against their parents. There is a CERTAIN coldness and cold bloodedness that resonates from the brothers during their cross examinations. I am not talking about the when the defense attorneys ask them questions and they fake cry with no tears and spew rehearsed lies but rather the coldness and defensiveness they demonstrated when answering the prosecutors' questions during cross examination. Erik was worse than Lyle with his acting, despite having acting experience, and at the second trial Erik proved himself unable to think of lies as quickly as he did at the first trial when questioned by prosecutor David Conn. Unlike the first trial, Conn had his own psychiatrist interview Erik as well and it was learned that there is a certain amount of coldness, premedidation, and maliciousness required which has nothing to do with being a self-proclaimed victim of abuse and everything to do with brutality and monetary gain.

      Idk I rarely ever stick up for “murderers” and come to their defense, but I believe that prison can in many cases be rehabilitation. I do believe that they were abused sexually, physically, emotionally & mentally. Mostly by their father. And they knew their mom would always come to her husbands defense. I think they were very heavily influenced & their father had immense power over them. It’s unheard of for the family to want them released. I think they’ve done their time. I do believe they should be allowed a second chance at life, but that’s just my opinion.

It broke my heart, but it was the best place for them after what they've went through. I am thinking of their transition, and then the fact that their parents created monsters and for them to be released just freely is not a good look. I am thinking of everyone's safety. Anyway, just SMH 🤦😞

    Sometimes you have to carry out your own justice. Parents got what was coming to them. Hopefully those who have this tendency to be so abusive will keep in mind their victims wont remain their victims forever. Only they don't get to decide for them how they go about putting an end to it.

But abuse effects the victims more than just physically. Physically you heal. But that definitely doesn't mean you heal mentally and emotionally from it.

    Those boys grew up in hell and fear. They went to extreme out of fear. Their 1st trial the male jurors didn't believe oys could be abused so 2nd trial wasn't fair. These boys have been in jail longer than life sentences in other countries all over the world which is 25 years in most. They probably can't have good future outside because of their crimes but they deserve a chance to try. Their Dad was a monster and their Mother seemed to either be too afraid to protect them or she was truly just jealous of them mentally ill or abused to point she meant it when she said she hated her kids and wish they werent born. The threatened to poison them. They were afraid to eat. Ill mever believe those boys werent afraid. Other family members testified. They tried to get them help but the mother wouldn't listen. They should have gone to child services but with his power and money how could they prove it? They could have removed them from home put them in a safe place and demanded doctors to examine them for evidence. Even then the boys would probably have feared for their lives if returned. It was groomed into their brains to not tell and the family name was most important. They didn't even want to use this for a defense. They refused to tell until they had to. Come on now. There were ways to find the truth. Nobody cared. The prosecutor wanted a win after losing the OJ case. They put the boys in the courtyard for the flogging rather than try to get them proper help right? Many others have come forward admitting abuse at that man's hands. Everyone feared him. I can't believe they were just stuck in those prisons separated for so long when they were all each other had left. Funny how their stories haven't changed after all these years without contact. The person , Kitty's brother doesnt want them released and it is probably too embarrassing to admit his sister behaved like she did and if he fights for them it's like admitting the truth and horror of his sisters behavior. While her sister is all for their release. They deserve to be released.

      2. only one of the shot guns was reloaded and they just panicked and shot whatever they had aimlessly.
      3. they did not party, they acted very distressed and spent around their usual spending habits and used money to cope. like many people do.

    I might’ve had a little sympathy for these two if they would not have killed the mother. The mother was not a threat as much as the father was physically/sexually. She was a threat to them mentally as she was their mother and allowed things to happen, but they should’ve spared her life because she was probably a victim of their father as well.
    That’s what points to the money factor here a little bit because they knew if the father was dead the mother was still being in control of the money.

    How fickle the public is. After the Netflix show and the documentary, all people were talking about was their release. It seemed like a done deal and things were moving fast. Now it’s like old news again. They have Luigi now to focus on I guess. If all that hype was really because the former LA DA was trying to get good PR for his campaign, that’s sad that he used them in that way.

    If they can actually prove they were molested, sure, try them again, but i highly doubt if it did happen that both parents were involved. 9/10 times things like this happens it's usually the male figure. The fact that they killed both parents and only changed their story to molestation after they realized their fake Mafia story wasn't cutting it says their motive was something entirely different.

      Really? I know three survivors of child sexual abuse, all of them women, whose mothers were complicit in that the victims told their mothers and their mothers refused to believe them. In two cases, the mother's immediate, knee jerk reaction was to slap her daughter across the face for telling lies about the abuser (one was the grandfather, one was a stepfather). In the third case, the mother just told her to stop exaggerating.
      In all three cases, the abuse ended up when the victims finally got up the courage to tell an adult outside the family who involved law enforcement and the abusers were charged and convicted.
      All three cases happened back in the 1970s and 1980s--I think that, if they happened today, the mothers would also have been charged for negligence, at the very least. I hope they would have been, anyway.

It's pretty common that spouses are in denial that someone they married is a monster, but that doesn't mean they were complicit in the act nor does it mean they're as bad as the actual perpetrator and deserve the exact punishment what he does. If you weren't an adult pre-1980s, you may not realise that during that era, it was very common to believe that men and boys could not be sexually assaulted. In fact, the prosecutor in the case at the time said so publicly! That attitude is also what enabled the Catholic Church pedophile scandal, where multiple bishops shuffled pedophile priests from place to place without cutting off their access to victims--the bishops knew darn well that most people would not believe that boys could be sexually abused.

      Yes murder is murder. But Motive and intention is a huge factor, and why there are degrees in murder. And why self-defence and manslaughter are not described as murder, though the end result is still the same (the death of a person you caused). Nuance is important, and intention is key in handing down the correct sentence. Yes they deserved sentencing but to what degree is the point here. Should they be released at some point? Perhaps. Perhaps not.

    I’m not sure if their father abused them, but as adults, they had the option to leave instead of resorting to violence. Furthermore, it’s puzzling why they would reload the gun and return to shoot their mother (in the face), who was innocent in the matter. This situation raises many questions, and like the esteemed Judge Judy, who wisely stated that she wouldn’t release them, I also find the circumstances difficult to justify.

    This is just outrageous at this point! There's something off with that Nathan guy. I really feel like he's totally lying when he said he's not gonna be political when it comes to the brothers case but he fired two deputies who support them decreasing the balance and fairness of the argument on the case. Seems like he will low-key try to overturn everything George Gascon did even if it's justified cause of political purposes. I really hope the case will be transferred to the CA Attorney General so we can finally end this story with the brothers being released for good.

Including their cousin who testified that Erik had confided in her years earlier about the abuse, she didn't report it because she did not know what to do.     It sets a precedent for other cases. Court TV did a profile of Taylor Schabusiness and questioned the experts if she is capable of rehabilitation. They suspect she may have been SA by her father. It could be a ticket out of prison for other ruthless killers.

      HEY! fun fact! that’s not how it fucking works. if you’re being emotionally manipulated by your parents you can’t just “leave” it’s not as easy as just walking out the front door. their parents controlled EVERYTHING. Lyle actually did manage to get away and was going to go off to Princeton, however Erik was still being completely controlled by his parents who would not pay for him to go to college if he didn’t stay at home.

      I was so furious for her case. She didn’t need to be in a prison after all she went through. Maybe that boyfriend of hers should, but she needed to be in a mental facility getting help and not some common jail cell as if she was malicious for no justified reason. Her mother was a damn monster.

      She is the one who asked him to off her mother & convinced him it was the only way. 😂 That boyfriend of hers would be in his basement playing D&D games had they never crossed paths.

      TF are you talking about. Gypsy Rose did her time. She got 10 years for 2nd degree murder, with possibility of parole. She did 8 years and then got parole. These guys are sentenced on 1st degree murder and are sentenced to life with no possibility of parole, same as Gypsy Rose's bf. They are never getting out irrespective of what TikTok tells you.

      And yet Gascon only used them for publicity rather than doing anything about it. See it is clear they murdered 2 people for greed or hubris or let's say even for abuse but murder they did. They ain't getting out.
