    It is opposite for me. Respondents havent replied back to ET-1 for over a month now. Put in a strike out order still nothing from tribunal

      Definitely chase with the Tribunal!

      @@valla_law yes three claims all not responded back to tribunal. Even judge is on record saying she heard nothing. London Croydon is still buckling under pressure. Judge even refused to merge all 3 claims forms together saying she will do after ET3 but nothing for months. Shaady employer rejected my grievance appeal also as expected without accepting any fault as expected despite evidence taken directly from gov.uk website and other legal laws in UK broken like Christmas has come earlier. Surprising thing is employer is playing high handed tactics even with judge openly like they are untouchable. Not sute what they are trying to achieve but best guess is settlement down road but nothing regarding that even

      Might be worth applying for a Rule 21 judgement at this point, if they're even ducking the Judge

      @@valla_law will do thanks. Issue is even tribunal is not responding. No justice if tribunal struck out my interim relief application for being out of time by 1 day while is pampering respondents and not bothering to even reply back to me.

    respondent has filed ET3 5 days late and not applied for an extention within the time limit ie 28 days am I in my rights to apply for a strike out before the prelimany hearing?

      Hey there! You could ask for a Rule 21 Judgment, I'm not sure you would get it as Tribunals seem to be very permissive of Respondents being late in filings, but it's certainly worth a try! If you haven't already, check out the Rules of Procedure - that's where rule 21 comes from! www.gov.uk/government/publications/employment-tribunal-procedure-rules
