- Robert Furr, 20, took the stand, took his oath, then sat silent as prosecutors asked if he would testify in the murder trial of Clayton Perry, Jr. Judge Gil McBride declared Furr as "unavailable for purposes of testifying" as Furr remained silent.

Wrong title, he didnt actually refuse. He indirectly refused to answer the question of whether he wanted to testify. They declared him "unavailable". He never said he wouldnt. He probably just understands the law and his rights more than they think he does; since most dont know their rights.

Do you think thats just some cute thing police say when they arrest you? These are your Miranda Rights. These are the result of the United States Supreme courts case of Miranda vs. Arizona. During any arrest police have to tell you your Miranda rights. They are reminding you of your 5th amendment right, which is your right to not be self incriminating; which basically means you dont have to answer anything that incriminates yourself. If they have proof you did a crime, great let them prove it, you dont have to help them. They also will use anything you do say against you, so why exactly should you say anything anyway? Its important to understand your rights so those in law dont manipulate your ignorance of the law to convict you of things they otherwise would not have been able to convict you of. Learn the law so you can protect yourself from it.

I loved his level of intelligence. Yes! They wanted him to help their case by divulging information from a privileged communication with his attorney. That would be stupid, and would only make his life more difficult. Therefore, he kept silent. Very astute young man!

They really don't care. Prosecutors will even go for guilty verdicts when they know you didn't do it, as long as they can maintain their win streak. Police will tell you to sign a "release" to get out of jail when it's a confession they're handing you.
