In one of the most powerful and moving interviews I have done for a long time, the former President of the Supreme Court Bar Association and one of India’s foremost lawyers, who breaks into tears at the end of the interview, says by permitting surveys of mosques “Justice Chandrachud has done a great disservice to the constitution and to this country”. Dushyant Dave says of Justice Chandrachud he’s “playing in the hands of somebody” and later, when specifically asked whether he means the ruling BJP, he replied “no doubt about it”, adding this was proved by the aarti the former Chief Justice performed in the company of the Prime Minister and, secondly, by his claim that the Ayodhya judgement was revealed to him by God.
I am not going to precis or paraphrase this interview in great detail because I think you should see and hear it for yourself. More importantly, Mr. Dave should be permitted to speak for himself and be heard and seen directly.
I will, however, point out that Mr. Dave speaks with enormous passion and, at times, anger about Justice Chandrachud’s May 2022 ruling that whilst the Places of Worship Act of 1991 does not permit any change in the religious character of a place of worship after 15th August 1947, “ascertainment of the religious character of the place of worship is not expressly barred”. Mr. Dave calls this “intellectually dishonest” and says that Justice Chandrachud has defied and is in breach of the Supreme Court’s own judgements on this issue, in particular the Ayodhya judgement of 2019, which we now know Justice Chandrachud himself authored.
Right at the end of the interview, Dushyant Dave breaks down and starts to cry. His voice shakes with emotion and his eyes are filled with tears. He says “I have sleepless nights thinking about this”. He says “I am worried about my country … you don’t know how much this is impacting me … and how much it must be affecting those belonging to the minority community … it’s really sad what is happening … I can’t understand why no one in this country wants to stand up and fight this nonsense.”
