    How long does the K3 Visa take to get, once you have filed the I-130? Right now the i-130 takes 17-124 months, I am already married, but have to return to the US, I am not going to wait 24 months to see my wife and son again.

    Great video! Question though, I've been reading that the K-3 is obsolete now and that the CR-1 is the replacement. Can you offer any clarification on the difference between a K-3 and a CR-1?

      I have heard the same thing. However, from my understanding, the K-3 is not a replacement as conditional resident visas have been around at least since the Immigration Reform and Control Act of 1986. The history behind the K-3 Visa, from what I have read, is that it was signed into law by President Clinton under the Legal Immigration Family Equity Act of 2000.
      This law was enacted supposedly because spousal immigration visas took much longer to process than K1 non-immigrant visas. In order to have a faster alternative, the non-immigrant k3 visa was established. After the years have passed, the speed at which processing CR/IR visas increased thus rendering the k3 visa obsolete. I suppose this is why form i-129f is closed if form i-130 is approved first.
      I am also trying to figure out what happens to a stepchild/child if you file form i-130 and form i-129f but form i-129f is closed. Does this mean that the stepchild/child will not receive derivative status from form i-129f?

      @@KK-fq6sm That is a good question. You would likely submit an Affidavit of Support for the child also, however, I have no idea what process or form(s) you would need.

    hi i have a question. after my fiance has arrived with k1 visa, and we got married within 90 days, and then applied for an adjustment of status, do they have to leave after 90 days are up, even if waiting for the adjustment of status? because naturally the adjustment of status wont happen during the 90 day period due to the long process

    A question I have is: I'm trying to file a fiancée visa I-129F and under What Evidence Must You Submit it says "9. Evidence for Petitions to Classify a Spouse as a K-3 Nonimmigrant" with "A. Form I-130." and "B. Marriage Certificate." I'm not understanding why I would be submitting evidence of the marriage and filling out the I-130 BEFORE getting married? The whole point of the fiancée visa is to GET MARRIED... Is it saying I need to just affirm I'm going to fill those out afterward?

    Do you help people from out of state with this process? I’m traveling to Nicaragua this month and maybe April next year. I’m planning on trying one of these options with my fiancé. I dont know what the best option is or how to go about doing the process. And I’m terrible with keeping up with paperwork and deadlines. 😬

    Due to Covid my spouse isn’t able to ge their interview at consulates and we’ve just been waiting. It’s so hard I haven’t seen her in 7 months would it be too late to get the k3 now? USCIS stage and NVC stage is over just waiting on interview schedule but consulates aren’t taking appts now

    Hi, would like to ask if it is faster to get your spouse in the US if petitioning as a Permanent Resident or as an US Citizen? The F2A family-based petition has "Current" date, does it mean it will be faster as it will be processed right away (Current date as of 9/6/2020) vs filing a K-1 petition? Please let us know.     Thus, if an American marries a foreign spouse overseas, he or she can file an I-130 and K-3 visa simultaneously, then the foreign spouse should be allowed into the US in 4-9 months [probably closer to 9 months, due to COVID], and would have full work authorization while the I-130 and K-3 are pending? Would the $535 filing fee need to be paid for each petition?

    Hi. I have a question. Let me explain my case. I'm citizen from United States. I got married with a Pakistani men in September 14 2021 I came back and on October 8 I submitted the application with USICS. I received the receipt on my application in October 11 2021. Then we sent all that they asked everything it's approved and completed, since February 17 2023. and his case is on NVC just waiting to the Pakistan consulate schedule his interview date appointment. But we are knowing that it may take 2 or more years to they schedule his interview. And honestly we are getting so much desperate to not be together soon. So my question is if we qualify for this visa K3. If you can answer my question I really appreciate it. Thank you 🙌🏼

    Thanks for adding this video. I am from NY and currently dating a European girl for 2 years. We have both never been married and have no children. I am a naturalized citizen. We are interested in K1 visa and looking to apply within 4 weeks. We usually meet every three months but due to current pandemic/travel restrictions, we are hopeful next time we meet will be no more than 6 months. We have plenty of proof we have met multiple times through the years-I assume sending in pictures will be enough proof? Do you recommend use of lawyer to complete this process? Also, if approved, 90 day time period becomes active the minute she lands on US soil, it doesn’t begin the minute it is approved correct? Lastly, has the pandemic delayed processing of k1,k3 visas or are they still accepting applications?

      Alex Peguero although use of a lawyer is not required, I do always recommend using a lawyer because the information provided on the internet is never enough. Too often people submit their cases and something goes wrong because they didn’t have a lawyer to prepare it or follow up with their case. For a K-1, you need to provide proof that you met in person at least once so the pictures you have are sufficient. The 90 days time is once she touches US soil. The pandemic has actually sped up the processing of the I-129F but unfortunately no one is able to go get the k-1 visa stamp at the embassy until they open back up

      Alex Peguero I do not have someone to recommend in NYC but any immigration attorney in any state can file the application for you. For example I have clients in Texas, Colorado, Virginia, Florida, and New York, to name a few. Because immigration is federal law, we can represent clients in any state AND any country. So it’s just about finding an attorney that you feel would do a good job for you

    I have a question regarding the affidavit of support. Since the spouse is getting a permanent residence green card (or ten (10) year renewable equivalent), in case a separation occurs, could the citizen get nailed for supporting an immigrant spouse who used the citizen to gain entry into the United States and can the integrity of the immigrant be challenged in court?

      If K-1 visa, recall the affidavit of support states 10 years. So yes, in theory you are financially responsible for your beneficiary.

      You need to be a US CITIZEN (not a green card holder) to petition for K1 Fiancee visa.

    Hi, am I understanding correctly that if the US citizen lives abroad together with their spouse, the US citizen has to move back to the US in order to have a US domicile and be able to sponsor the CR1 for the foreign spouse? This would imply that during the whole CR1 process, the couple will have to live in different countries even tho they are married unless they file for a K3 which could take longer than the CR1, correct? Thank you

    I am a U.S. and married a indonesian woman in Thailand. I want my wife to be able to come back to U.S. We BOTH are Retired and she doesn't need to work. So i would file a I-130 And a K3 for my wife here in Thailand where we got married ? We have been here 3 months and want to get out of Thailand. Will we have to wait 3 more months here to get the K3 visa . I have no more visa extensions left to stay here . i have to leave in 30 days.

    My fiancée and I have been engaged for almost a year and a half. I’m currently living with him in Mexico due the pandemic, but am going back to the U.S next month. Do I need to be working for a certain amount of time before filing the K-1 to show that I can sponsor him? Or can I file right away?
    Also having doubts over should we get married here in Mexico or should I go and file the k-1?

    *I 130 sucks. I filled as green card older on January 2020. Nothing changes till now they are saying that my case still in Review process. So k 1 is better and faster. Especially if you are green card holder. I became us citizen in this year so I wish I knew this before*
