You realize that in order to operate a motor vehicle, you need to have a license, car insurance, and a valid registration for the vehicle. That is the law in every single state. She had NONE of those three. By law, she was not allowed to operate the vehicle and drive it away. That aside, the officer was NOT taking the keys so that he could take possession of the car itself. He was only taking the keys temporarily so that he could remove the license plates (which she had no legal right to have, since she didn't have registration) off the vehicle safely without fear of her starting the car and attempting to drive away or run him over. It's a procedure used to ensure the officer is safe, as several officers have been injured in the past during that process. As the chief said in the video, they weren't impounding her car. In fact, the grandfather was allowed to tow it home after the stop. The car was still their's, it just couldn't be driven legally on any road.

The Lady who was charged should be thankful of the transparent and lawful police force they have in her city. In Montana things would have been much different and this police action would have never have been this open to the public. This was a very righteous and courteous arrest by the officer. She made the arrest difficult and wasted a lot of taxpayer money. she was treated with respect and the officer gave her several opportunities to comply with his requests that were totally and understandably warranted. She clearly thinks she is above the law for some reason. I believe the arresting officer is a good cop and I hope he is not in any way deterred from continuing his career in law enforcement. First, This Lady should get charged with everything she earned. However, I do find it interesting how the Police along with the city were able to make the original video so conveniently available to the press when a more less favorable video was released about there Officers stop on Facebook by the suspect.The point I'm trying to make in other case's were the video could be released by authorities and won't is because it does clearly show a less than favorable video of the Officers actions. Authorities hold the video for years to fend off the possible charges the Officer maybe looking at facing or the civil lawsuits. This is what has to stop, hay if it favors the Officers, no problem, will have a prep rally on the 5:00 o'clock news, to show just how proud they are of the actions of their officer when the video looks good for the officers action. But NO if favors the victim and shows a much less then favorable for the Officer, bury the video for as long as possible.

You realize that in order to operate a motor vehicle, you need to have a license, car insurance, and a valid registration for the vehicle. That is the law in every single state. She had NONE of those three. By law, she was not allowed to operate the vehicle and drive it away.
That aside, the officer was NOT taking the keys so that he could take possession of the car itself. He was only taking the keys temporarily so that he could remove the license plates (which she had no legal right to have, since she didn't have registration) off the vehicle safely without fear of her starting the car and attempting to drive away or run him over. It's a procedure used to ensure the officer is safe, as several officers have been injured in the past during that process.
As the chief said in the video, they weren't impounding her car. In fact, the grandfather was allowed to tow it home after the stop. The car was still their's, it just couldn't be driven legally on any road.

It articulated a very simple test, which you have never discussed in your 170+ posts on this thread. No one, not even the internet commentators and legal blogs run by lawyers, agrees with you.
Mimms held that "What is, at most, a mere inconvenience cannot prevail when balanced against legitimate concerns for the officer's safety." Mimms' simple test is to compare the concerns of the citizen against those of the cop.

Mimms went on to hold that an officer could order an occupant from a car, have them stand behind the car or on a curb, etc. If the harm to the citizen is only inconvenience and the officer's order reduces risk or enhances the officer's (or the driver's) safety, the officer's order is valid, regardless of whether the driver feels humiliated by the inconvenience.
Many police departments take keys. In the 40 years since Mimms, not one case has held that the inconvenience of taking keys outweighs the officer's concern for safety.
Mimms articulated a simple, objective test. Taking Tereka's keys is, at best, an inconvenience that is far less than the inconvenience of "seizing" her person and forcing her to perform certain tasks with her body, such as getting out of the car, walking to a certain place in a certain manner with her hands held just so, etc. I would argue that taking her keys is not an inconvenience at all, because she can't use them until the detention ends. The car has already been seized; the keys are immaterial in comparison.
What would the lovely Tereka have preferred if she had known the score? Seizure of her person or seizure of her keys? Would her answer have changed if it was raining?

The Lady who was charged should be thankful of the transparent and lawful police force they have in her city. In Montana things would have been much different and this police action would have never have been this open to the public. This was a very righteous and courteous arrest by the officer. She made the arrest difficult and wasted a lot of taxpayer money. she was treated with respect and the officer gave her several opportunities to comply with his requests that were totally and understandably warranted. She clearly thinks she is above the law for some reason. I believe the arresting officer is a good cop and I hope he is not in any way deterred from continuing his career in law enforcement. We need more officers like him.

The car wasn't going to be impounded. Did you not listen to what the Chief said? The Granddaddy had the car towed back to where he lives. The Chief said that is what happened - and that's what would have happened in the first place. She knew the car wasn't legal.

First, This Lady should get charged with everything she earned. However, I do find it interesting how the Police along with the city were able to make the original video so conveniently available to the press when a more less favorable video was released about there Officers stop on Facebook by the suspect.The point I'm trying to make in other case's were the video could be released by authorities and won't is because it does clearly show a less than favorable video of the Officers actions. Authorities hold the video for years to fend off the possible charges the Officer maybe looking at facing or the civil lawsuits. This is what has to stop, hay if it favors the Officers, no problem, will have a prep rally on the 5:00 o'clock news, to show just how proud they are of the actions of their officer when the video looks good for the officers action. But NO if favors the victim and shows a much less then favorable for the Officer, bury the video for as long as possible.
The Driver complained about her breast being shown how about buying a shirt that fits you, one that covers up some of your rolls and put your kids in a seat belt when required to. No one spoke about how her kid was unseatbelted while in the car.

I have seen the video before there was no racism at all involved in this traffic stop. if she wasn't speeding, had her paperwork updated, and her license wasn't revoked in the first place. none of this wouldn't have happened. why was she driving in the first place when her license was revoked, that's just stupid. the woman brought this on herself. she resisted arrest, she didn't listen to lawful commands from the officer. she has no one to blame but herself.

Having read many of the comments below it's disheartening to see the ignorance of those who THINK they know the law.Allow me to set some of you straight.
1-Anyone who thinks a cop with more than mush for brains is going to kneel behind a ton or more of vehicle while the ability to move said vehicle ANYWHERE is still retained by a driver who has already committed multiple code infractions (no insurance,expired registration,revoked driving license) and been clocked at 51 in a 35 zone has even less mush for brains than they presume this cop to have.Officer safety in requesting keys (demanding if request is refused) is definitely in play and will be upheld by any court in the land2-.To those that think the vehicle can't be searched I'm here to inform you it will most definitely be searched before it is towed if the vehicle falls into police custody for towing since chain of custody issues are in play.Authorities must know and be able to prove the vehicle was clean of weapons,explosives,hazards and contraband before it can be turned over to any towing company to be towed and impounded.
3-I'm not a cop sucker,I see plenty of videos where cops have exceeded or outright abused their authority and find those actions disgusting in the extreme.That said I fail to see anything here that smacks of racism in the slightest.I've no doubt that the officer in question was mandated by law and policy to remove the plate/s from the vehicle once DMV queries revealed the lack of insurance and expired registration PLUS change of address without notification of change to DMV.Such could reasonably be construed as criminal actions on the part of a person deliberately seeking to avoid detection.
4-The officers reasonable precautions were completely borne out by the subsequent actions and statements of this completely irrational woman and will easily survive any challenge in court.
5-The entire stop was video and audio recorded,then released in it's entirety to the public.Those recordings,IMO, prove the officer lawful, reasonable and correct in the actions he took during the stop.Had the officer abused his authority I've little doubt we'd all be waiting a long time to see those recordings,if we ever got to see them at all.
6-For those that think this cop was unreasonable in requesting/demanding the keys here's a little experiment for you to perform.Feel free to put on a police uniform,find an obese,possibly irrational black woman (no shortage of youtube videos of these wacko's going off the chain),let her even suspect she's about to be ticketed or maybe arrested for multiple violations of state vehicle code that she knows she has committed (assuming she has enough of a functioning brain to discern such).
Now that you've done all that give this woman the keys to a vehicle and let her know you'll be kneeling right behind that vehicle to remove her plate.I hope YOU feel safe back there.
