She should hire the firm that took on John Hopkins Hospital and seued them. They represented the little girl Maya(spelling? I watched that long trial and the jury found John Hopkins guilty and awarded the little girl $265 million dollars! Biggest lawsuit ever. Trial lasted about 6 weeks. A two man team of attorneys took on JHCH (John Hopkins Childrens Hospital) huge corporation. They had about 6-8 high profile attorneys and 4-6 paralegals. Look up the trial, it was fascinating to watch and very sad to see what that Hospital did to Maya and how Maya's mom sacrificed her own life to save her little girl.
I don’t know about you, but that seemed deliberate, premeditated, and personal!

My dad was an engineer for over 40 years, and you couldn’t imagine the stories of the idiots he landed up hitting. It doesn’t just hurt the person hit by the train, but it hurts the engineer that has to live with it. Obviously this was not the woman’s fault, but the idiot cop.

QI does not apply to this case. It shields officials from civil liability in cases where the constitutionality of their actions is unclear.

I didn’t think about the Railroad Operator and the aftermath of hitting the car. It had to have been devastating and the psychological effects were probably tremendous
@@5paces164 There are a lot of train drivers never get back in the cab after a train hits a car or truck. they lose it .Even if no one is killed they know it could have killed and there is nothing they could do to stop it .

@@5paces164My boyfriend is a Conductor on a Class I. He has had to deal with the aftermath of someone laying on the tracks. It definitely took a toll on him and he already deals with PTSD from the Army.

People can suffer from injuries for the rest of their lives. Medical teams do their best to repair damages. However, arthritis, traumatic brain injuries, and post-traumatic stress syndromes follow.

Fun update: The cop who handcuffed her and put her in the vehicle recieved 30 months of probabtion and 100 hours of community service. The cop that parked his car on the tracks recieved a commuted sentence of unsupervised probabtion for 24 months as long as he stays out of trouble.
The woman is still facing felony road rage charges, even though, according to her lawyer, the other involved party admitted fault. So the charges not being dropped is the first hurdle she needs to overcome before her lawsuit moves forward.

The state not dropping the charges is the only defense against a lawsuit they have and they know it.
If they push that case to trial with an admission from the other party on record, she can tack that onto her lawsuit as a §1983 as malicious prosecution and not only take the police dept for hundreds of millions, but the city itself and the city prosecutors office as well. Talk about turning 100milliin into a potential 500 lmfao.

Yes! I have always lived within a mile of the tracks and you can feel the vibrations long before they arrive. These cops completely ignored it.
Can't believe they were LEO and parked ON the tracks knowing the possibility existed. Criminal negligence. The young girl survived but how will she ever be the same with all those broken bones and trauma? How can she trust police ever?
I remember when this originally happened and I told a friend about it.... he brought up how rail companies are also incredibly litigious and there's no way they're eating the cost on those repairs.

Not only did they put her in the vehicle on the tracks, but then they just ignored the train while they searched her car. You could hear the train for about a minute before it hit the car.

@@shannonobrien9922yeah, that's what everyone here is talking about. They ( the cops ) put her in their car with the police lights that was sitting on the tracks and were searching her car, ignoring the train.
@shannonobrien9922 on top of that after the accident instead of checking on her they searched her vehicle for a gun instead of administering aid. The female officer walked up to the cop car like 20ft away after the accident and turned around to help the male officer search miss Gonzalez truck. The full bodycam vid (amazingly) is here on RUclips from the news.
I have degenerative spinal disease. Mine didn't get bad though until middle age. She is probably going to spend the rest of her life, every conscious moment, with pain. I consider any payout she gets as a token payment, considering what she's going to go through.
I'm so sorry. I understand. Broke a vertebra at 1 year old, now 75. Arthritis and fibromyalgia, as well. Something always hurts. Pain sucks the life out of me sometimes, but it's all I know.
Basically the money is to improve her quality of life, whatever she needs to try and get back some semblance of normalcy

I remember seeing this when it first happened!! She should sue, and with the video evidence, it should not even go to trial. They should settle for whatever she is asking for!!! In her future, after she heals from all the damage done to her body, she still has to look forward to all the arthritis and stuff that will set up in all her broken bones as she gets older. I speak from experience from being in a car/train accident when I was a child. It has been 47 years and I still suffer from all my injuries!!

@@readysetgo8244 sometimes they can go in debt for being found guilty of the rights violation. However, the debt would be to the employer instead of the victim. This issue is contract and law dependent, however. If the employer refuses to pay, the cop can be held civilly liable for the funds because the court ruled against him. However, it's usually going to be like squeezing water from a stone.

@@ZenoPcs Tell me what part of those actions were necessary for protecting the community. Cop or not is irrelevant when the actions undertaken do not fulfill the duty of a cop - protecting the community.
As far as I've seen this is a traffic stop so no overwhelming community risk is presented, and she ended up in the hospital just as though she was shot, probably worse. A cop has a duty to protect the arrested party once in custody.

it's dumb enough that they park their cruiser on the tracks, but who ever had the bright idea to put the suspect in a vehicle on train tracks is so far beyond "head empty" that i'm lost for words. i cannot even begin to imagine the utter helplessness/horror that woman felt as she likely watched that train hit her, and it is frankly a miracle she is even alive. i hope the cop(s) responsible are not only banned from ever wearing a badge again, but also criminally charged for this insane levels of negligence (but, most likely, that'll unfortunately never happen)

Shocker!! One officer got community service and probation for putting her in the car, and the officer who parked on the tracks got probation. The one who parked on the tracks has the chance to clear his record if he doesn't violate his probation and the other will probably successfully petition the court to clear hers as well. Who would have thought that officers are immune from consiquences even when they are charged and found guilty or plead guilty, no one...

I too saw this soon after it happened. I suspect the cop who parked on the crossing thought her emergency lights would stop a train. *WRONG!* The officer actually parked on Private Property. The railroad owns the Right-of-Way on which the rails are laid. Another topic skipped in "Policing 101?"
Colorado and Arkansas are probably the top 2 most reckless states when it comes to officer misconduct. I know of more excessive force cases in those states than anywhere else.

This is already a classic. I hope their employer has stupid insurance, because stupid happens.
A lot of cities are self-insured, so the limit does not exist on what can be claimed. Negligence is a given on this, and ALL the officers on-scene bear shared responsibility for this. The Constitution allows for slavery as a punishment for crimes, maybe officers failing their oaths quality as a good reason to have them work off the liability they caused.
I believe like most states they are immune from prosecution, a principle called “Qualified Immunity”. A court must first remove the immunity of the governmental entity and from the individuals. The individuals are to be sued in both their professional and personal capacities.
Qualified immunity needs to abolished!!! To many cops getting away with breaking the law cuz they KNOW they are protected.... the tide is starting to change with many of these lawsuits but unfortunately it's only the city (tax payers) who are responsible for the bill when it should be the officers paying the bill!!!

The Fort Lupton police officer who put a woman in a parked police car before it was hit by a train in Platteville, Colorado was found guilty of two misdemeanors: reckless endangerment, a Class 2 misdemeanor, and third-degree assault. Jordan Steinke was found not guilty on criminal attempt to commit manslaughter, a Class 5 felony.
I know she filed suit, don’t know if it was settled or ongoing. I live in the Denver area. This was huge!

The woman settled for $8.5M. The PD insurance maxes out at $10M, and the PD had already used $1.5 on their defense. Steinke was fired after her conviction and is expected to lose her Peace Officer Standards and Training certification. She can never be a cop again, if this happens.
@@robertbehan9186 Rios-Gonzalez' was stopped for an accusation of waiving a pistol at a driver. Her attorney plead no contest to the menacing charge but I didn't find any reports that a pistol was found in the vehicle. There may have been and I just didn't happen to find it.
I'm mentioning it because of the frequency people are arrested for "resisting arrest". When the judge asks "Why are you arresting them in the first place?" the cops will say "For resisting arrest!".
Go after the judge

What I saw in the original comments was that it is a well-known fact that these tracks were busy tracks. These deputies should have known better. And, if I remember correctly, they pulled her over for supposedly brandishing a gun at the bar, but never found a gun in the truck. I hope that girl takes them to cleaners. I get nervous around any train tracks and would NEVER even think about parking on them. I mean, how stupid do you have to be really?!
From watching a couple of videos covering this case, the cops even after Ms. Gonzalez was taken to the hospital were still searching for a gun and almost joking/laughing about what had just happened.

As a driver education instructor, I teach my students NEVER to stop on railroad tracks. If you can't cross completely, stop before the tracks. If my 16 yo students understand this, how does a police officer not?
This is why you should have to study for at least 2 years instead of 6 weeks to be a police officer, along with a minimum IQ of 130.

This was pure stupidity. I still can't believe they were that unaware of what was going on around them. It's almost like it was on purpose and if it really was an accident they should never have been hired. Them being so focused on snooping through her car is crazy.
You have to be just about legally brain-dead to park a vehicle on Railroad tracks and leave it with someone who is handcuffed inside.

This is the perfect reason. There should be aptitude tests under pressure for police officers. Although the pressure was self-inflicted because she couldn't get to the supposed crime scene quick enough, all common sense was thrown out the window by her eagerness to exercise her power over someone else.
