I agree with the CJ that a justice's interpretation of how the SALN was to be submitted was a "unique" interpretation that is absurd and oppressive. It was a nitpicking exercise and an attempt to read "opinions" of the CJ out of context. And I agree with the CJ that the quo warranto was never about ill-gotten wealth and so how did that come about in the questioning of at least one justice. Mukhang the issues are continually mushrooming at every point. And another issue came up which was her position in the Human Rights Commission which prompted the CJ to question the proceeding as "global roaming". Kahit ano na lang tinatanong to the point that the CJ said baka yung high school records nya gusto na rin tanungin. When CJ responded to Justice De Castro that "You have a self-serving statement.", I agree. Self-serving statement is not evidence. "It is important that the context be laid down" on the questions and should not be an exercise to "trap" the Chief Justice. That is the best description made by CJ on how the questioning was being done by a particular justice. CJ was remarkably answering with facts but a justice was stating a "unique" interpretation.. Sabi ni Justice Teresita de Castro on the meaning of the law: "From my reading of the law, that is my conclusion". PERO that is her conclusion. Did it occur to her that her conclusion may be wrong and that the reading of Chief Justice Sereno was correct? I believe CJ's interpertation is within the spirit of the law. When Justice Peralta asked the Solicitor General on the earnings of the CJ because of her being a consultant of PIATCO, the Solicitor General cannot answer directly and with any particularity. In fact there was no substantial answer at all. It was Justice Peralta who came up with the arguments contained in his questions and the Solicitor General can only answer "yes your Honor." In short , it was NOT the solicitor general who made an argument. There was no argument on his part at all. The burden of proof and evidence to prove that CJ did not file a SALN rests on the shoulders of the Solicitor General. Justice Jardeleza should have asked Sol Gen of the proofs of the allegations. Jardeleza also referred to the slide of the OSG, but that was not evidence of non-filing. Its merely a slide. The burden of the proof is on the Sol Gen to prove the allegations and the content of the slide. The CJ was correct in reminding Justice Jardeleza that the burden of proof is on the Solicitor General. There was no shift in the burden of evidence either because the Sol Gen did not prove anything.
