- The International Court of Justice (ICJ) on Friday ordered Israel to "immediately" halt its military offensive in the city of Rafah in the south of the Gaza Strip. Panel judges voted 13 to 2 in favor of the order, which characterized the humanitarian situation in Gaza as "disastrous" and "catastrophic." The ICJ said Israel must "immediately halt its military offensive and any other action in the Rafah Governorate which may inflict on Palestinian groups in Gaza conditions of life that would bring about its physical destruction in whole or in part." It added that Israel must keep the Rafah crossing open for "unhindered provision" of aid at the scale necessary to provide "urgently needed basic services and humanitarian assistance." The court said that 800,000 people would be displaced by May 28 and found that Israeli efforts to alleviate risk to civilians or provide necessary food, water or shelter were "not sufficient."
The Israeli military released images allegedly showing an assault in the north, where it claims to have destroyed rocket-launching sites. The fighting has forced Palestinians to abandon the Jabaliya refugee camp. The UN says more than 100,000 people have fled northern Gaza in recent weeks. The situation in Rafah, the southernmost part of the Gaza Strip, is equally as dire, with the Israeli military reporting that 900,000 Palestinians have fled the area. As a result of ongoing fighting in Gaza, UN aid agencies have said that they are unable to access their warehouses in Rafah and are suspending aid operations.

Actually, the court didn't call upon Israel to "end its offensive." It called upon Israel to end any military or other actions in Rafah that "may inflict on the Palestinian group in Gaza conditions of life that would bring about its physical destruction in whole or in part." A military operation that brings about the destruction of Hamas, rather than "the Palestinian group," would not violate this. This qualification is a reference back to the Genocide Convention's prohibition against actions with the intent to "destroy, in whole or in part, a national, ethnical, racial or religious group, as such." It doesn't prohibit the destruction of a military or political group, nor collateral civilian casualties incurred in the process of doing so. I think that the ICJ has once again issued a decision that will be widely misunderstood by the media, as it appears to have been misunderstood here by DW.

You are dreaming. The current war strategy is benefitting Hamas, because there is no other authority when Israel withdraw from a previous conquered area. Also the brutality how this war is fought will push the people in the arms of Hamas.

My country, Switzerland, joined the UN only recently and we considered this very well. We love our freedom and do not want to be subject to foreign interference. Still we went ahead to join most other countries.
ICJ has no enforcement power on its ruling. You can compare it to a theatrical play.

~31,497 Palestinians in the Gaza Strip have been killed, of whom ~28,951 were civilians, of whom ~12,345 were children under 15 years old, also including 295 health personnel, and 113 journalists.
~61,079 wounded Palestinians of whom ~24,431 are children under 15 years old, more than 1,000 of those children having one or more limbs amputated, often without anesthesia because Israel has strong restrictions on the amount of medical supplies going into Gaza.
~1.955 million Palestinians have been displaced from their homes and now face combined threats to life of starvation, dehydration, poisoning from water unsafe to drink, exposure, disease, and lack of medical care for these conditions as Israel has made at least 26 out of 35 hospitals non-functional while the remaining 9 have extreme problems with lack of medicine, lack of power, lack of water, lack of medical staff, and must deal with the wounded at the same time.
~69,700 apartment buildings have been destroyed.
~187,300 apartment buildings have been damaged.
Also targeted has been 320 schools, 1,671 industrial facilities, 183 health facilities, including 23 hospitals, 59 clinics, and 92 ambulances, 239 mosques, three churches, and 170 press offices.
~10 civilians are killed and ~22 civilians are injured for every 1 Hamas fighter killed. Look at this figure for other wars.
But the real genocidal part of the war is around making the conditions of life for the Palestinians unlivable to force them into a binary choice of fleeing out of Gaza or of dying from the combination of threats to life knowingly and deliberately caused by Israel, those threats being:
> Starvation from Israel restricting access to food. While Israel pretends to allow in aid trucks, Israel has severely restricted food supplies into Gaza while destroying or making it too dangerous to get local means of generating food. For example, limiting when aid trucks can come in to 8 hours a day, adding additional lengthy inspections, and rejecting entire truck loads of aid of some small thing they reject allowing in.
> Dehydration from Israel restricting access to drinkable water or even unsafe water. Israel turned off water supplies from Israel, destroying water desalination plants, contaminating well water with salt water, and limiting drinkable water from aid trucks.
> Poisoning from Israel restricting access to drinkable water thus making Palestinians drink unsafe water. Note that Israel is flooding tunnels with sea water which is likely to have little impact on Hamas but will 100% contaminate well water making safe drinking water even more scarce. Also, Israel restricting access to power or fuel results in Palestinians burning things to cook or for warmth which are unsafe to burn. Also, Israel's bombing creates health hazards from poisoning.
> Disease from Israel creating conditions where Palestinians are massed even more densely than normal while being deprived of any sanitation system. The sewage systems are not working anymore, there is not enough clean water to keep things clean, and very large numbers of people are being pushed into a smaller and smaller area against the Egyptian border, making for very crowded unhealthy conditions.
> Exposure from Israel displacing so many Palestinians while progressively destroying all structures and ability to live within Gaza that increasing numbers of Palestinians are living in makeshift shelters not capable of properly protecting them from the environment.
> Extreme psychological trauma from Israel Israel continuously bombing and attacking with no safe place where Israel will not attack, thus the constant fear of death punctuated by explosions is going on 24 hours a day 7 days a week. To this is added the mass numbers of deaths and wounded within the destruction all around. This too weakens the ability of people to live.
> Lack of medical care from Israel restricting access to medical supplies, targeting hospitals and making them non-functional of which at least 26 out of 35 hospitals have been made non-functional while the remaining hospitals have all been defined by Israel to be centers of Hamas activity and while being overwhelmed with casualties and sick people.
