    I think the trickiest part is knowing all of your disabilities and trying to connect the dots (is y directly connected to z, or x aggravated by z and causing y, etc)

    I didn't think I had sleep apnea because of I workout three times a week and wasn't overweight or snored but I realized over the years that the reason I was waking up screaming in a panic need to walk outside was that not from bad dreams felt like I was about to die or anxiety but from obstructive sleep apnea

    For 20 plus years I was ignorant that I could get any help from the VA. I thought you had to be totally disabled. Now that I've educated myself for the most part. I'm still learning. I'm finding out I'm eligible for many things. Thank God. I was in a bad way. But like many people know. Its a uphill battle. I live in Kentucky. It's very hard to get claims resolved in a good way. Gulf war syndrome is a big one. I'm a Gulf war veteran. The C&P examiner I last saw. Said there was no such thing. I was like. Really!! So why am I here???

    Quick question... If when using "medication" for an already service connected primary disability to file a secondary claim, what would be the wording to use to indicate that the medication is the intermediate step? For example, if attempting to secondarily connect OSA to service connected PTSD were the medication has caused weight gain, in turn causing the OSA.

    Prior to leaving USAF in June of 1974 I applied for service connected injuries for my chronic back condition and skin conditions and I was seen in the mental health department about 4or 5times before discharge and was diagnosed with a stress disorder the day before discharge which I was not aware of at the time because of the stigma that was associated of going to a mental health professional but my question is can psychological factors affecting physical conditions become part of the original claim?

    As a child I had to have tubes in both ears and at some point in childhood the right tube fell out. When I went through MEPS they noticed I still had a tube in the left ear and made me get it pulled out and get a waiver. I had several ear infections while active duty in my left ear and when I got medically discharged for a seperate issue I was found to have hearing loss that did not exist when I joined. When I first got out I filed for disability for the conditions I recieved the medical discharge as well as for the hearing loss. The conditions that I recieved the medical discharge were approved but the hearing loss was denied due to being a pre-existing condition. The VA has been my health care system since I left the military and I've had almost constant ear infections in the left ear for the past 10 years and am now legally deaf in that ear. Can I get a rating for a pre-existing condition aggravated by service by proving that them making me get the tube removed from my left ear caused my hearing loss, Meniere’s syndrome(due to constant fluid in the ear for years), and the constant ear infections?

Is it possible to get compensated for the medical malpractice of the Dr and the VA hospital?

    I have a 10% back disability and was going to file for secondary somatic disorder which is higher than PTSD baseline per my testing, but my psychologist who diagnosed me with somatic disorder said that even though she feels it is service connected that the VA won't award it because my primary disability is too low and that I need to increase that first before trying for somatic disorder? Is this true, do I need to wait? Even though the Dr thinks it is clearly connected. Thanks!

    It's been 50 years since I served in Viet Nam, I was injured and didn't seek a claim for my injury , THEN I was having lots of problems mentally which was then diagnosed as PTSD do to the activity I was under. I filed and received 40% disability after my records check, then a couple of years later I was re-diagnosed and bumped up to 80% back in 2010, now at the tender age of 71 I've lost memory etc. and was diagnosed with Parkinson's Disease. The neurologist asked if I was ever subjected to Agent Orange and I said yes, we were dumped on in the jungle several times, and then she told me Agent Orange was linked to PD and that I should file for compensation, which I did within two weeks, submitted my documentation and I'm currently waiting for information. The VA handles thousands of individuals and if you don't try then don't cry, no one will do it for you unless you are physically unable i.e. blind, missing arms or mentally deficient. The VA is not out to screw you as mentioned by "Door Mouse"

    I had my spleen removed while in service due to being in pain only to find out it was the size of a football. I found out it was hereditary spherocytosis. I had it removed and then developed a nosocomial infection while in the hospital. I then had to have it reopened to drain the infection. I was in the hospital for 3 months. Then I had to go back to the hospital because they left a gauze in my stomach. I had to have surgery again and was recycled into a different unit to start my training over again. I now have a lot of pain in my side. I was told it was scar tissue. Can I file a secondary claim for any of this?

      I hope you resolved your secondary condition claim. I am a vet, I was honorably discharged from the military in 1979 I filed a claim and was denied. I was encouraged to keep trying I finally was awarded 10% disability in 2017 finally after nearly 40 years. I am now at 20% and working on my secondary conditions claims. To make it clear I was honorably discharged after a year and a half of service with a four obligation. They argued that I had a preexisting condition.

However he said my combat in (Iraq) exasperated my PTSD. Also said I had mild alcohol dependence due to PTSD from Iraq PTSD. Can they deny me? There is nowhere in my service records of a diagnosis of PTSD before joining. What type of doctor would be necessary as I have been seen by the VA for about 4 years now and as far as I know I am not seen by an actual doctor but by a PA who has been assigned to my care. Is her opinion acceptable or should I look to an outside opinion?

    • @CCK_Law
      @CCK_Law  5 лет назад

      James Lancaster, thanks for tuning in! The type of doctor would depend on your condition(s). Our blog on medical nexus may provide you with useful information: cck-law.com/news/providing-a-nexus-for-your-va-disability-claim/

      At this time my condition has been monitored and treated by my VA assigned Physician Assistant. My original question was that if she was attempting to treat my obesity (my nexus) would she be qualified to write the letter to link all my secondary conditions to the service connection ankle injury with continual pain leading to substantial weight gain.

      @@jameslancaster9655 Yes, a PA is qualified, but it's better to have a medical doctor if you can. If not a PA, Nurse, etc. can write your nexus.

    My secondary service connected injury was increased to 10.percent. But my overall rating didn't increase.Will it increase and will I get backed paid?

      It depends on what the % you had and how you were paid. so let me explain it to you a bit. VA math is not 30%+20%=50-%. The VA would do 30% then the 20% is 20% of the remaining 70% of your good body or 14%. Add the 30% plus the 14%=44%, but that rounds to 40%. Your VSO can help, but this is an easy to sue calculator, but remember the % round up or down, but this calculator works great: www.hillandponton.com/va-disability-calculator/

    Service connected left side of body aggravated right side of body due to body part compensating and overused. Sounds straight forward enough, but to the VA it's not.

    Can you get depression as secondary even if you have another claim for ptsd.

    • @CCK_Law
      @CCK_Law  5 лет назад

      @Celerino Jasso, it is possible to have multiple mental health conditions. However, since all mental health conditions are evaluated using the same criteria, veterans with multiple mental health conditions will likely be assigned one combined rating. Therefore, you do not need to submit separate claims for each condition.

    Quick and precise question. I was diagnosed with high blood pressure on active duty but never treated for it. In 1980 a year after I was discharged I started HTN treatment. I ask my Doctor if
    ED, DVT and (OSV) sleep apnea can be linked to high blood pressure he gave a link to go to I read it and they all applied to my conditions. Can I use he reply message as a Nexus letter?

    • @CCK_Law
      @CCK_Law  5 лет назад

      @Phil Jones, A strong nexus letter should be written by a licensed professional in the appropriate medical or clinical field, be based on the veteran’s service medical and personnel records, be based on the veteran’s medical history before, and following, service, Address whether it is “at least as likely as not” that the veteran’s disability was incurred in or caused by service, provide supporting rationale for the conclusion, or in other words, the medical professional “shows their work” by elaborating on how they reached their determination.
