    I understand that this is all important to know, but don’t all of these ATF regulations seem so purposefully convoluted, as if they try to confuse people in order to get them to break the “law”?

      Its made that way purposely to confuse people which is why nobody knows their rights and cant defend themselves in court always needing an attorney. Its by design. Most dont know their all caps name is a fraud along with thier bifth certificate

      @Diesel Ramcharger it doesn’t matter. They still haul your ass to jail. So clearly they do have authority. As for who should be concerned about these “rules”. If your gun is going to be seen or used in public you should be concerned. As for the rest of us who really cares?

      Kinda have to know how this mess came about. AR-15, while it is America's rifle it wasn't that wildly popular until the aughts. Yes, I know AR-15s have been around since the 50s and Colt commercially sold them in the 60s, it wasn't a popular platform. It wasn't until 90s when the upper was redesigned to replace the carry handle with a rail system it started getting traction.
      Now the short barrel rifle became an NFA item when NFA was instituted back in 1934. Now in the 90s, AR pistols weren't really a thing, sure there was the OA93 but not much after that. That period was more of the beginning of the AR-15 custom build era and the focus was on rifles.
      It wasn't until AFT tried to sued Thompson Center for their Contender/Encore system in '92 that caused all of this. That ruling alone made it possible for a pistol to become a rifle. But the not rifle into a pistol because of the NFA's regulation on SBRs. So all of these decisions have to be based on the judicial ruling of US v Thompson Center case.
      When people explored the AR-15 rifle format people looked for what else can be done. So in the aughts, they started exploring the pistol format. Now since receiver served the same functionality of the TC Contender/Encore frame in regards to being a pistol, the same ruling had to apply to AR-15s. So a "pistol" receiver into a rifle and back to pistol is an exception because of a SCOTUS ruling and not because AFT wanted to let you bypass making an SBR.

      @@DieselRamcharger The ATF isn't writing or changing laws, but they are mandated with a task that effects law. The ATF is only trying to interpret these idiotic laws and trying to comply with previous court rulings.

      Correct. These "rules" are set cause someone, somewhere thinks that 26" is the magical number that makes a rifle no longer concealable. All the extra BS of brace vs stock, and vert grip vs handstop is just to scare people into not wanting them.

      one could argue pistol braces are unsafe for 7.62, when not fired from the shoulder, from weaker or smaller shooters but it would do more harm to current laws than good... IMO they should modernize the law, and base it with research, logic, and real world data, but that's not gonna happen.

    They can't have it both ways when it comes to "length of pull" by counting in the brace itself measured while being extended and "OAL" where the brace itself extended cannot be included at all, only the naked buffer tube can. That is not a confusion, it's a deliberate conflict.

      Exactly they said the brace is an accessory and not necessary for function of firearm. The length of pull should be measured from end of extension tube without brace attached, same as they measure OAL. Why would you even measure LOP for something that is designed to be shot one handed. Defund ATF.

    Thanks for the info and trying to explain all this more. I personally think this just proves that there are way too many restrictions and laws on firearms and that causes confusion which could lead to how someone else interprets something differently.

    SB Tactical makes a LOPL LENGTH OF PULL LIMITER which is a plug that fits into buffer tube to shorten length of pull for SB-3 and 4 brace

      Just found this video and after looking at buffer spring tubes I had the same thought. Glad to see it confirmed by Mfgr. Avoids potentially creating new functionality issues from shortening buffer tube and more spring precompression.

    I could be wrong, BUT, the 26 inch measurement is to the end of the barrel not the flash hider or anything else screwed onto the barrel. That end piece must not removable by unscrewing. It must be 'welded', silver soldered in some fashion or by pinning and welding.

    OR - SB Tactical sells LOPL- Length of Pull Limiters in packs of 4 and Strike Industries sells a Stock Stop. They install in the adjustment holes and limit the brace travel. I use them to set my preferred min-max range for where I like it and my wife likes it. Cheap, done and no cutting.

    An 11.5" upper is typically right at 26", but it's extremely close. I have an A5 extension, which puts the LOP at about 13.25" and OAL at about 26.75", so I _could_ put a VFG on it, but then it wouldn't be a pistol, and there are advantages to a pistol over a "firearm".

      @Stuckgrenadepin Bro... Do you really think that buttstroking is the only reason for using a brace?
      The index point of a brace or stock just makes coming up and getting a sight picture so much easier and faster, and using it to manage the recoil makes follow up shots way faster.
      It's not about "being able to handle the recoil". It's about managing it effectively so you can deliver more shots on target faster. Even with a proper stock a key to shooting fast and accurately is recoil-management, even with 5.56.
      I got my SBA3 with an entire LPK for $130.
      There's a reason AR Pistols have absolutely *blown up* since the Advent and proliferation of the SIG brace. It's a goddamned game-changer.

      But would they still throw you in jail if you were seen with such a setup? In my experience the overwhelming majority or "law enforcement" officers neither KNOW the laws of this country and their state, nor do they CARE about acting in accordance with said laws. In their mind, the law IS what they THINK it is, or should be, and that they don't even necessarily HAVE TO follow what they think is law, at least not ALL the time. And 9 times out of 9, trying to explain what the laws actually are, and that you are not in violation of any of them (thus making them wrong and their judgment being faulty; damaging the high self-image they usually hold of themselves) will result in the officer(s) becoming defensive and angry, which leads to them escalating their hostility towards you and further violating your constitutional rights (which they also do not know, nor care about), usually ending with you in jail, charged with just as many offenses as they believe they can lie about and reasonably justify to their superiors. Sometimes you just end up dead, and they claim you were assaulting them or reaching for a weapon, and typically no questions are asked and their actions are deemed 'justifiable'.

    Simple solution for a folding stock/brace adapter is to plug weld the 5th hole on the buffer tube. The brace will lock on hole 4, and slide right off if you try to go one more, making LOP just a hair over 13". AFT can pound sand.

    The AR receiver's do not meet the ATFs current definition of an action, as it states it is the part that houses the hammer, bolt, fire control, and a barrel. Since the AR splits these up between the upper and lower, neither can be defined as the action by itself. I forget the article, but I have read a few cases where judges are ruling in favor of people not being in possession of a firearm if they have just the lower due to this definition.

    It their latest ruling the BAFTE specified that the OAL (over all length) must be measured with the stock folded when a folding adapter is present. They also stated that anything added to the firearm that serves no purpose other than to add additional length cannot be counted in the OAL. This basically means that you can’t use the law folding adapter with 26”+OAL other/firearms (Aka not-rifles/not-pistols). My experience is that to create a firearm (not-rifle/not-pistol) from a pistol so that you can attach a VFG (vertical forward grip) you must use either a minimum 11.5” barrel with a carbine length buffer tube or a minimum 11” barrel with an A5 length buffer tube to reach the 26” OAL. (FYI, The SB tactical braces attached to an A5 buffer tube still have less than 13.5” LOP.) My favorite combination is an 11.5” barrel + A5 buffer tube as you get a 26.5” OAL, more dwell time in the barrel and the added benefit of the softer shooting A5 buffer system.

    Set screws in the adjustment slots so the stock can’t go too far back or set in any of the rearward slots. Can’t count against you if the stock can’t lock too far back👍🏻🇺🇸

    I didn't hear you mention it. but I could have sworn that if you have a folding stock, the oal of your weapon is now to be measured from the end of your barrel or muzzle break (if the break is pinned and welded) to the farthest end of your lower where it folds. Your buffer tube doesn't add into your oal now to help you meet the 26in... Again I could be wrong but I thought they re interpreted that law not too long ago... You never know, they could have changed it since I seen it last or I could be wrong or Miss understood all together. But I could have sworn that's how it was.

    Its amazing to me how the know it alls in the atf will sit around dreaming up insignificant details about a firearm and create all these laws. It just never made sense to me. It just seems like a big slap in the face to the constitution and 2nd amendment.

    You can use a sb tactical limiter to reduce the length of pull with a LAW TACTICAL brace folder. You can avoid having to cut your buffer tube.

    I used a non-adjustable brace on a rifle extension with a carbine buffer and spring spacer inside to help make the 26 inches on the back end of the extension. You can block the last adjustment hole in the carbine extension if you don't want the adjustable brace locking into it. In court an ATF agent testified that the ATF measures length of pull from the trigger to a point on the rear of brace in the plane of the barrel. Traditionally, length pull on rifles has been measured from the trigger to a point on the rear of the stock in the plane of the trigger, parallel with the barrel.

    Would it not be less invasive to permanently reduce the adjustment length for the stock? Maybe weld a shorter stop verses cutting the length of the tube?

      As long as all the parts are used for their intent no modification are needed reguardless of the length of pull. You dont have much room to play with and if you start cutting down buffer tubes then the bcg will not be able to move reward enough to lock back or maybe even to pick up another round.
      I know probably at least 5 people with folders on pistols and noone has ever modified any of the parts in any manner just build your pistols guys

    I have an other as well. Everything you said your spot on.
    About that other firearm you have, yes you can put a law tactical folding adapter on it as long as you don’t reach over 34 inches overall. You can’t even change the upper to a 16 inch barrel as long as you stay under 34 inches. Once you exceed 34 inches it is considered a rifle per ATF
    Tolerance overall size is 26 inches to 34 inches

    Ok, hear me out one more time. They can't say in one sentence that OAL of a pistol is measured in it's shortest configuration to the end of the receiver extension and LOP is measured in it's longest configuration to the attached brace. Rifles are measured in their longest configuration but pistols can't be rifles unless they become SBRs. This measurement crap is just that, conflicting crap.

    I added a Sylvan Arms side fold adapter to my ar15 pistol. That added 1 inch to my arm brace extension. Instead of cutting my buffer tube, I blocked out the last 2 adjustment holes on my buffer tube. I have an SBA3. With the brace pulled all the way back, my measurement from front trigger face to end of brace is 2 mm shy of 13 1/2 inches.

      But, it only has to be measured to the end of the rifles reciever. When they came out with the new opinon about the law folder everything changed again and noone realized it. Those pistol braces are designed in a very specific way to meet the length requirements and the folder doesnt matter. The only way to rectify it if it did would be to cut down the buffer tube as he said. Which wouldnt give the bolt enough room to reciprocate. Making the firearm a single shot. They couldnt include the folder in the length of pull measurement because if they did,it would also have to be included in the OAL. Which would mean you could run a verticle grip on a 10.5 pistol.lol.
      Its confusing I know.
      If you had to cut down buffer tubes like I said first,it would be a single shot that you would have to hand feed. Second,he just committed a federal crime and posted it for everyone to see

      @@dansage3665 just put it together and run it. The only thing you have to worry about is measuring over all length. Measure it with the stock folded. If it is under 26 inches from end of barrel to the folder you cannot run a verticle grip. It brace itself has been deemed an "accessory" and not a part that makes the firearm function amd shouldnt be used when measuring. Do "length of pull" which pistols dont have one, is measured from trigger to the end of buffer tube. Not the brace.
      It doesnt matter. You have the authority over government. All gun control is unconstitutional and enacting it was illegal on many fronts.
      If you are interested most people dont realize that the federal government, not even Congress has the authority to enact national sweeping laws that affect you anywhere other than legally purchased federal land. So unless you are on legally purchased federal land as out lined in article 1 section 8 their laws dont apply to you. Now,someone is going to jump in amd say "the supremacy clause". That clause doesnt trump my individual rights. I have 10rhA rights.
      "Laws" like the NFA are exactly why the anti federalist pushed for the 10thA to be included in the bill of rights. Out of 126 proposed amendments at the convention of states,it made it into the first 10 amendments. So it was pretty damn important.
      The people of this country habe become so ignorant about how our government is designed to operate they just accept whatever they are told they must do. Its sickening really.

Also you are correct when you say that we all as a community need to make sure we are all informed of the latest laws and regulations, since they are constantly changing.     One more thing KB, a pistol can become a rifle and go back to being a pistol again as many times as you want as long as it started as a pistol. A rifle can never become a pistol if it started as a rifle.

      Question for a friend. If a stripped lower receiver is labeled "reciever". Can a AR pistol still be built? I know pistol which is 16" below cannot have a vertical grip, or butt stock. But the confusing part is , is does a stripped receiver Have to be labeled a certain way? Like example "receiver pistol"?

      @@techti8792 if you buy just a plan lower receiver its considered other, not Rifle or pistol because it's neither until that type of upper receiver is put on it. That's why if u buy a lower first thing you put on it is a pistol upper. Thin you can go back n forth. But technically if you put 16" or bigger barrel upper first you can't go to pistol legally. Is what he's saying, I think.
      Say you buy a complete AR-15 carbine. 16" barrel. That gun has a serial# that goes with that gun. That # says weather it's a rifle, pistol, shootgun. There for you cannot legally turn that carbine into a pistol because the serial # will say carbine but you got it configured as a pistol. Now you have altered the gun and it is no longer what the serial# says it should be. ( if you have a run in with law enforcement with your gun and they run that number and it comes back as carbine but you have turned it into a pistol or SBR. short barrel rifle ) so if you buy a complete gun it cannot be altered different than what the # says it should be. But with a plain lower receiver you should be able to do what you want win you want cause that s# is neither pistol or rifle, its considered OTHER.

    I watch the video from a former ATF now a lawyer said a lot of this stuff is on paper but it's not actually in the law books so if you do get prosecuted for violation of some of these gun parts the charges can't stick that's why they're scrambling right now trying to figure out how to deal with it

    If your 4473 (for your stripped lower) says rifle then you can only make a rifle, if your 4473 says “other“ you can go from pistol to rifle to pistol to rifle to pistol.

    I'm thinking some Jb weld in the last 2 holes in the buffer tube and then it can't lock back any further than 13.5" or if you good. Cut the back end and Tig it back together. I've had problems with screwing a buffer tube in too far or not far enough and it caused a cycling issue.

      @@drewdunc75 I'm just throwing it out there and waiting for someone to comment about it. Just seems that It's furthest rear position. If it only lock in the first 3 then the next 2 on the proprietary buffer tubes then IF it did contact your shoulder it's going to collapse and therefore not useable in those positions. I'm just looking for a simpler solution. I THINK the original Kak blades make it even with the folder. I'd have to try one.

    with respect to the AR the "Receiver" is a two part component. Meaning the "Receiver" constitutes both the upper and the lower. With respect to "affixing a rifle length barrel to the action" that refers to both the upper and lower as one unit. Thus once you have affixed a rifle length barrel to the "action" it becomes a "rifle" and cannot become a pistol... it's fucking dumb; but alas, that is the "law" as it currently stands.

      @@FreedomInc agreed. im simply referring to when Kota mentioned that he doesn't know how that determination is made with regard to is upper the "action" since the bolt and firing pin actuate in the upper... though by definition, that would also require the hammer to be considered part of the "action"; but in an AR that is housed in the lower... it's all BS; but I was trying to portray how the powers that be look at it. For what ever reason, with an AR the "receiver" is the lower, thus is the only part that requires serialization, even though per definition, it only houses one of the criteria that in their language constituted a "receiver". I swear they do this shit on purpose... i have a friend who won't get an AR unless it's completely manufactured by a "known" manufacturer, because he swears building your own is "illegal", which obviously it's not; but then you get into topics like this and I can see why people get scared to dive in to building their own...

    Seeing that Stella Artois bottle just seals the deal. I rarely and I mean _very rarely_ drink alcohol.     Nonetheless, my preferred drink is good ole purified ice water (this is Arizona after all) and Lavazza Coffee because we're coffee connoisseurs.

    Some states like Michigan, which i live in, you have to register hand gun;s. So if you buy a lower and build a AR pistol you have to register it as a pistol. So you can switch to rifle or back to pistol if you don't register it, it stays a rifle for life.

    For the ar pistol with the law folder, why not stock stop the positions on the buffer tube to reduce the maximum notch that the brace can lock into. In this case, you wont need to cut the buffer tube if the notch does not allow the brace to exceed 13.5 inches.

    Rather than cutting down the buffer tube, or drilling and pinning the buffer tube track, I fabricated a piece of plastic that is inserted into the track of the buffer tube and blocks the last 2 settings. The LOP went from 14.5 to just under 13.5 and I still have 3 working stops for the SBA3 brace.

    I run the Law Tactical folding stock adapter on my CMMG Banshee AR9 Pistol. On the CMMG Rip Brace you can install a set screw to limit the length of how far out you can pull the brace therefore shorting its length. In my opinion no need to cut the buffer tube.

    I think SB makes whats called "LOP limiters" that slide into the locking slots on the buffer extension to prevent the brace from being able to slide back beyond 13.5" so you don't have to cut the buffer extension

    Just put one of the strike industries stock blockers on the last extension hole so that the stock will only extend far enough to be legal. You would have to make the buffer somehow shorter if you shortened the receiver extension.

    You can also plug the rearmost holes in the buffer tube to prevent extending the brace beyond a 13.5" length of pull. You can buy the plugs and they're inexpensive. Most would only need to plug one hole, but it could require two depending on the brace and where its plug is located to engage the adjustment positions in the tube. Easier than cutting down a buffer tube . . . . which screws up the buffer and spring which rely on a specific length tube. That said, see the proposed ATF 4999 with the length of pull scoring. Many may need to plug all but one hole to make it non-adjustable (only one position) and achieve a short enough length of pull to pass the rest of Section II. If the LOP is 12.5-13.5 inches, you consume 3 points, and you can't take any hits anywhere in the rest of Section II or you FAIL -- which all but impossible.

    I'm an FFL (type 7 with an SOT class 2) in Frisco, TX. This video was right on one thing he forgot to mention is if you pin and weld your flash hider you can include that in the OAL to make it a firearm or you can't have a vertical grip on it. Now here is another thing, YOU CAN NOT MODIFY OR CHANGE A BRACE. What this mean is you can't tamper with any thing on the brace at all. I've seen people on facebook doing this. I have some friends who actually work at the ATF here in down town Dallas, and the word on the street is the ATF HQ in Washington, DC is now reviewing their official ruling on shouldering a brace.

    Thanks for this video, I am considering a Law folder for my gun and wasn't aware of the length of pull. The whole situation is ridiculous the stock counts when the ATF wants it to, other times it doesn't. What a way to trap an unsuspecting person trying to stay legal with opinions (not laws) that can completely ruin someone's life.

    Necro post, but you raised the thought of shortening the buffer tube to get the 13.6" LOP limit. Don't cut down your buffer tube and re-thread. Extra work and it messes with your buffer and spring mechanics. Instead use JB Weld to fill in the position holes as required or use the stock length limiter kit from SB Tactical to do the same thing and have the ability to remove later. Hopefully we are near the end of the ATF's brace rule.

    They are talking about that you cannot remove a rifle barrel and swap it out for a barrel under 16".. the other way is fine. As long as your lower was designated "other", you can swap uppers all you want as long as you switch stock to brace, and vice versa.

    FWIW SBA tactical makes Length of pull adjustment plugs that get inserted into the rear holes on your buffer tube that prevent locking the brace far enough back to violate LOP restrictions. Combine the SBA4 brace with a. LAWS folder and this becomes a real concern.

    I just read a letter from the ATF posted online, dated june 2019. Clearly states the length of firearm is measured with folding brace, in the folded position. Sp adding a folder like the law tactical is actually a good thing. No modifications needed to the buffer, since its folded to measure the over all firearm.

    According to what I've seen it's not illegal to own an AR pistol with a bare buffer tube and its not illegal to own a brace. As long as one is not mounted on the other you are not in violation of atf rules. Further bufferless AR Pistols usually have a picatinny rail on the end of the receiver which can host a folding stock or brace but they can easily be removed and are unneeded to fire the pistol.

    Have you checked out the length of pull limiters from sb tactical? They are just plugs that up 1 or multiple positions on the buffer tube to allow a legal length of pull!

    Just tap on of your position holes on the buffer tube and install an inside hex head screw in that final hole that will prevent full extension of the brace if you have a folder. Totally easy, my brothers! Swedge it in place to make it a more permanent "fix" buy an aluminum inside hex head screw that is anodized and you can use your Tig welder to seal it in place. Real easy.

    Do not modify the brace by shortening! Besides it possibly being illegal, it changes the space available for the buffer and buffer spring and may cause function problems. Instead, buy a LOPL limiter from from SBA and install - this prevents the brace from opening as far. You can keep adding limiters until LOP is legal.

    An easier way to adjust length of pull is use the CMMG Rip stop pistol brace. It has a set screw option to limit length of pull. It's a very nice brace also. The Rip stop feature makes a quick deploy.

    From what I can tell on the ATF website, an AOW must contain a smooth bore barrel. It can also have a rifled barrel in addition to a smoothbore.

    The first stripped lower I bought. The ffl ask me what I was building, and not understanding the depth of this I answered rifle. So I do have 1 lower that was transfered as rifle. Since then I've figured out to have them transfered as other/reciever. From there it's no one's business what might be sitting on it at that time

    You can purchase or fabricate yourself a strip about 1/4” W x about 1/4” thick x the length necessary to reach the edge of your first or second hole of the channel of bottom edge of the buttstock/buffer tube. It will need include a short round plug to fill the hole closest to the receiver and make it a press fit on the width so it will not fall out. Being about 1/4” thick it will stop the buttstock from compressing all the way and will make it’s collapsed position match the length more or less you desire by varying the length of the strip you manufactured. Have fun experimenting! Living in California I have purchased the plastic ones or made wooden ones to prevent my AR-15’s from having collapsible stocks, which are illegal here!

    Some guys are putting JB Weld Inside the positional holes on the buffer tube To keep the brace from extending out to far to keep the length of pull under 13.5 inches. Not sure on the legality of that or on cutting the buffer tube down since both of those options are a modification.

    Great info! I did not realize the LAW folder changed the specs of my "pistol". It's always something.... aren't there some alcohol and tobacco issues they can focus on?

    Great information as always the issue I have is the fact that all of this is necessary to be " legal" . Obviously none of this should be necessary when the second amendment is being upheld and there is no point in me complaining about it. This type of issue will get worse until we stand together and stop all unconstitutional restrictions of the second amendment.

    Two questions about vertical foregrips...
    ....so you put a vertical foregrip with an adapter at 45 degrees clockwise orientation as seen from the back of the weapon... it's not a vertical foregrip...it's no longer vertical... it's a 45 degree foregrip.
    ..... so you install a vertical foregrip at 90 degrees clockwise from the vertical as seen from the back of the weapon... it's not a vertical foregrip... it's s 90 degree foregrip (think of how a British sten gun was held).
    Both mods highly increase accuracy and natural pointing, because they put the wrist in a natural presentation position. (There is a whole ergonomics of shooting dissertation about this, but I won't go into it here... but I will give you an example... make two fists... bring them up in front of you like you are holding your AR ... look at the angle between the axis of a line grasped by each fist....if the wrists are neutral... the angle between the two lines is 40 to 90 degrees... we have been shooting ARs wrong since they were invented, and now apply that to primary and secondary sights - location and position. Also... you will be most accurate and less fatigued shooting from the natural pointing position... try it and see. B out.

    Alex Kinkade is a 2A lawyer as well. Her video on how not to go to prison building your own SBR I think it was. She spoke of American made parts and the foregrip. It may be outdated due to recent legislature, but I payed heed.

    The problem is buying a rifle or a lower with a stock and making it a pistol, not a lower without attachments. Make sure your FFL does not use "rifle lower" in the description. Caught mine doing it several times.
