"The evidences that has been provided so far have proved that the defendant is guilty of bullying the victim." "OBJECTION! That is a baseless accusation!" "And why is that?" "Because I am the victim."
One of the perks of having a private attorney is that he is more likely to DO HIS JOB…. More effectively anyway. Public lawyers are swamped. And most do the minimum, but every once in a while there’s a good one OR your case was just an easy case to win, and the public lawyer does well.
In the scenario, I’m not entirely sure what the punishment is from stealing candy from a baby, but I assume it would be a small fine. Paying $20,000 for that scenario is definitely not the way to be not guilty, especially when a public lawyer could handle this case (stealing candy from an infant) with ease. So you should take a public lawyer for this case
Yeah, we're all asking, why? No point in being a private lawyer if you have to publicly serve. Like imagine working as a private maid and one day they just say "ok you'll be a janitor at a High School for no pay today". Kinda ridiculous to ask.
@@suungjinuppl are often pressured into plea deals despite being innocent. It’s basically a choice between fighting your case and losig your job, your kids, you home, and maybe going to jail, anyhow, or getting a fine, plea, or even time served, and getting back to your life.
Court, just like everywhere else, is all about relationships. At the end of the workday, the district attorney and the public defender go to the same downtown bar.
I’m Peruvian here you have three options: A) pay a private lawyer B) get defended by a guy who studied law on skillshare C)pay the judge to win the case instantly (The third option actually happened to me, some guy killed my aunt and got free because he paid the judge)
I flipped a coin and it landed in the middle, so I hired the judge. All I had to do was give him a briefcase full of benjamins and I won my case. 10/10 although costly, would recommend to anyone.
Public Defenders are the only advocacy some people have. Instead of shaming them with a dusty suit and saying how they won't care about your case: you should be using your platform to bring more attention and hopefully have counties give them a fraction of the budget they give the police force.
Also, most private lawyers rarely see a trial compared to a PD. A PD knows the prosecutor well and can work a deal if that’s what you want/need. Or has the experience with the judge and jury pool with dozens if not hundreds of jury trials to try an excellent case.

@@khayyamaurelius912 OK? So why can we not defend ourselfs in court if it's just "common sense" also I'm not quite sure if you realize how common False incarcerations actually happen. Not only that but It works both ways and the guilty go free all the time too.. And most times this all depends on how good of a lawyer you have which boils down to how good of a lawyer you can afford. You Can try to deny this and act like we have a flawless or even close to flawless justice system, but it's the furthest thing from the truth And many people have experienced that first hand. If The world was black and white and it only depended on common sense and logic Then there would never be a need for a lawyer and no reason you couldn't defend yourself in court.
Few things not mentioned: 1. Private lawyers specialize in certain cases. Meaning some only do stuff like insurance cases. 2. Those high fees go by case. For example: if you're suing a company and win, they pay the lawyer bill. Some contracts have the lawyers get nothing if they lose. Thats why the pick and choose their own cases. 3. A private lawyer will do a lot more investigating than a free one. Meaning theyre willing to get warrant for records and video fortages to neighbors, get more witnesses, read through past records, and so much more. Like he said, a free lawyer doesnt have much time and can only go with what is presented currently as evidence at the court.
@@charlee_hotel No, the problem with pro-se is even if you are right, the law is clear, you are great, the system itself will rig against you. Lets say you make the best objection possible. I mean one could get a lifetime batch of quality snacks for that money, and there is literally a high chance the private lawyer could be even worse than the free one, in fact they probably have less experience than the free one unless the public lawyer is a new guy :d
One of my biggest frustrations is that some jurisdictions allow you to pay off your community service in lieu of actually working it. Defeats the purpose and unfairly favors wealthy defendants.
@@evanshannonAnd the fact that there are crimes that are usually just a fine is pretty unequal in a lot of countries where a rich person can pay off the fine no problem while poorer people would take a serious hit financially by having to pay that fine. It’s basically just paying to break the law.

Public defenders are often actually far more effective than paid attorneys. They have “less time” to devote to your case but that only matters if the paid attorney devotes more time to your case. Do they? Or are they just billing you for it? Public defenders are often MORE effective in some scenarios. For example: in Wisconsin at the SC level, public defenses achieved a favorable outcome in 45% of cases. Private attorneys only achieved an 18% rate. Public defenses also know the prosecutor and judges far better, and often have a better relationship due to sheer volume. There’s no question that it’s better to have a private attorney if you’re OJ Simpson. But if you’re Joe Nobody with a court case that isn’t the top of the food chain and you’re not mega rich? A public defender might objectively be a better option - financially as well as efficacy.
You fail to understand that the efficacy rate difference has nothing to do with the quality difference of the defendant class but the nature and circumstance of cases presented to each lawyer class for them to actually reach SC.
@@twrk139 Source: Trust me bro 😂. It sure is easy to just SAY that with 0.0 evidence to support the claim. I’ll counter with my own equally evidence-backed retort: “Nuh uh.”

I recently served on a jury in a criminal case where the defendant represented himself. After the prosecutor rested I would have had a very hard time voting guilty. After the defendant testified on his behalf, and in particular the prosecutor's cross examination, it was a virtual slam dunk guilty verdict for me. We started deliberations about 45 minutes before lunch, and thought we might reach a guilty verdict before we got our free lunch.
My father isnt a public defender, he has his own office and stuff but since he is a labor lawyer and he does the job to help workers, he doesnt take much money and he sometimes volunteers and he's a great lawyer.
Private Lawyers are running businesses. So their priority is making money. That's where their focus and attention is. Public defenders do that job because they want to help people and aren't concerned with making big money doing it. Always go with the public defender.
Or Private lawyers sole goal is to make money thus he will do everything in his power to have as good of a reputation as he can and do quality job so people recommend him while a public defender gets his pay whatever he does and he really doesnt give a shit if you win or lose
Asked a public defender once why he didn’t have a private practice, since they make so much money. He said they have so much more overhead cost to include malpractice insurance and that it was so easy to ruin their careers that in the end you made more money and had a more secure job as a public defender.

Cheap Lawyer: "your honor shut up you weren't even there"
The case that "you don't have to pay for a public defender because they're free" is actually not totally correct. In 18 states, the state can charge you an upfront fee just to apply for a public defender, and in 42 states and DC, the public defender can bill you for hours if they win your case.
I used a public defender because that was all that was available to me. That was for actual crimes. I have represented myself in traffic court and landlord Tennent court half a dozen times and won every time. I do my research where most people just stand their with their tongue hanging out confused. Turns out that you can cross examine the cop who pulled you over. If they don't bother to show up for court it usually gets dismissed. Of the four traffic cases I was involved in two of the cops never bothered to show up. The other two I cross examined them and one could not logically explain how he determined my speed and the other could not present evidence that the radar gun was properly calibrated. I obtained the manufacturer user manual for his model of radar gun and found that it was supposed to be calibrated at certain intervals and they were supposed to maintain a record of calibration for the courts. He could not produce the record of calibration nor could he describe for the court how the calibration was to be completed and could not say when the last time the radar gun was calibrated. I then produced the manual and gave a detailed description on how the radar guy was to be calibrated. Then I presented photos of my tire marks with a tape measure indicating how long they were and how if I hit the brakes like the cop said the skid marks would have been almost twice as long for that make and model. The judge stopped me before I presented the rest of my evidence and dismissed the case and scolded the cop and suggest the department hire me to teach calibration.
public is fine... problem is they are overworked and that is what makes it hard... becuase they might no have time to speak with you to get the info they need. and this combined with working on let's say 6 other cases makes a diffrence. yes some could say that a private is better.... but i mean education is the same for both diffrence is the time they have for your case... so really i a public lawyer is more then fine (atleast with me, might be, because i dont do stuff that is sueable :D)
My mom was brutally attacked by a man.My mom was innocent and the public defender was trying to convince my mom to take time in jail. Some public defenders are corrupted. One of the perks of having a private attorney is that he is more likely to DO HIS JOB…. More effectively anyway.
Public lawyers are swamped. And most do the minimum, but every once in a while there’s a good one OR your case was just an easy case to win, and the public lawyer does well.
One thing to remember about the perks. They aren't free. You get charged for those snacks and drinks. They actually wind up itemized on your bill.

BUSTY
Dave?! What are you doing here, go back to Dustbowl!
Ay who knows? It might work. It's possible for the opponent's laywer to get "distracted" and lose their focus.
So you should take a public lawyer for this case
to be honest, i kinda wish they make it a requirement of private lawyers to take a public defender case every few months.
It's already like that in some states. My daughter had to.
A lot of firms make their attorneys take on pro bono cases
what would be the point in that? genuinely asking
What's the point of being an independent lawyer then?
Yeah, we're all asking, why? No point in being a private lawyer if you have to publicly serve. Like imagine working as a private maid and one day they just say "ok you'll be a janitor at a High School for no pay today". Kinda ridiculous to ask.

Public Defenders are the only advocacy some people have. Instead of shaming them with a dusty suit and saying how they won't care about your case: you should be using your platform to bring more attention and hopefully have counties give them a fraction of the budget they give the police force.

Well said ….
instructions unclear: i bribed the opposing lawyer to work for me instead
Also, most private lawyers rarely see a trial compared to a PD. A PD knows the prosecutor well and can work a deal if that’s what you want/need. Or has the experience with the judge and jury pool with dozens if not hundreds of jury trials to try an excellent case.

Most crimes are pretty avoidable and common sense though
@@khayyamaurelius912 OK? So why can we not defend ourselfs in court if it's just "common sense" also I'm not quite sure if you realize how common False incarcerations actually happen. Not only that but It works both ways and the guilty go free all the time too.. And most times this all depends on how good of a lawyer you have which boils down to how good of a lawyer you can afford. You Can try to deny this and act like we have a flawless or even close to flawless justice system, but it's the furthest thing from the truth And many people have experienced that first hand.

private lawyers should be mandatory to serve some amount of time as a public defender before able to renew their license.
Private law firms are obligated to take on a certain amount of pro-bono cases each year.
@@mastersimmons9001I know this is unrelated but I think it’s the same with hospitals too. Although that may be a tax write off/ PR thing tho.
That wouldn't work because not all lawyers practice criminal law. In fact, most lawyers are not litigators, so don't even go to court.
We get it you're a socialist
You do occasionally see that happen (pro bono), but it's not as common as we'd like it to be. But I agree.
Few things not mentioned:
We know all of this. Who's paying.

Justice for the rich, injustice for the rest.
The old saying of “if you can’t do the time, don’t do the crime,” should be changed to “if you can’t afford the time, don’t do the crime.”
One of my biggest frustrations is that some jurisdictions allow you to pay off your community service in lieu of actually working it. Defeats the purpose and unfairly favors wealthy defendants.
It’s still injustice for the rich if the lawyer was to successfully defend a crime they actually did.

A public defender might objectively be a better option - financially as well as efficacy.
favorable outcomes stats might be cuz obviously-innocent ppl won't hire private lawyers

@@hello855Pretty much this. People are more inclined to hire a private lawyer if they are being charged with a serious crime. Just stating the raw stats if the percentage of successful cases is terrible practice if you care about getting to anything resembling the truth
