Would be g2k Successfully trying to sue each other but something is happening today doesn't super build the case about why people years ago would be afraid of getting sued as if it would be happening
The key difference in the argument is a rando making those accusations isn’t the same as a content creator with a platform making those accusations, which is also different from a journalist making those accusations. The potential for genuine defamatory harm to occur is massively different in each of these scenarios.
It’s just crazy to me still how this all stayed a secret for almost 7 years. Like if doc was messaging tons of people and none of them leak. Especially hearing how many people in the streaming/youtube space that knew about this yet didn’t say anything until some random loser used this secret and leaked it to sell more tickets to his show. If I was Doc, here is what I would have done: Back in 2020, when he was notified that he would be perma-banned, in that last stream, I would have said something extremely transphobic. And then the day after, I would tell my community that woke Twitch banned me because of 'hate speech'. And then just shut the eff up and don't mess up again. There you go.
i was thinking you were aiming for "plant the seeds" for a HARD alt right radicalization or his fans to the point where when this came out he would literally lose no one.
What I don’t understand is the bravado that Doc had talking about the issue at the start. I remember him saying things like “we finally found out why, and we’re going after them!” You’d think he’d be afraid of “going after” twitch when they have all the chat logs. So weird.
I don't think it'd be legal for Twitch to release private logs and he was aware of it. Also Twitch clearly didn't want people to know that they can read private DMs.
@@simtelefon Any company you do anything on can access your information at any time. You literally agree to it when you sign up for the services. There was a release right before docs tweet that laid it out in plain english that after the bathroom incident, people at twitch hated his guts, I'm assuming because he doesn't really fit the politically correctness that twitch embraced, and had it out for him and were watching him like a hawk digging any way they could desperate to get rid of him. They found the chat logs between him and said minor where he she was inquiring about branding and platform growth. He had a company that deals with these subjects so it's not all that unusual. He was unaware of her age and it got flirty. I think it said the chat logs were from 2017 and they found them internally while digging and banned him in 2020. That, along with a ton more, was released in a huge email just prior to his tweet and in my opinion it's the only thing that makes it all make sense. I feel like I saw the email once and then not a single person has talked about it since.

Destiny totally contradicted himself at 4:00 regarding speaking to minors. “If you know they’re a minor why would he be messaging them in the first place”. I remember him arguing with abba that it’s fine for a grown men to hang out with minors in certain circumstances
I mean those don't contradict tho? It's probably not a good idea, as a public figure, to be messaging someone you know is a minor even if you aren't saying anything inappropriate because it could get weird without you intending it to or it could just look really bad. But there are also absolutely times where it's appropriate for anyone in general to be privately talking to a minor depending on the circumstances (obvious examples are teachers, but other examples exist outside of that type of thing too)
Yeah he also defended adam22 sleeping with 16 year olds because they met through common interests (skateboarding). Something about possible red flags but not necessarily wrong.
My college buddy reviewed dm's on a camsite like a decade ago so I've always assumed the sites have access to everything done on them. Why would they not?
Destiny not understanding AM standard is really disturbing. Spend 30 mins reading up on it bro, he's a public figure, it's a really hard to prove, but it's the standard
you mean like posts of the guy advertising "will reveal if show sells out" doesn't meet the actual malice standard? Its a very decent arguement that it could. the fact this guy wasnt nuked from orbit with a defamation suit means one thing: the discovery phase would RUIN Dr. Disrespect. Because in America, truth is an absolute defense against a defamation claim. He didn't even get a cease and desist.
I think Dan is correct. There was something very "telling", the dm's that showed Doc had the intent to meet up with the minor at Twitchcon. I think at this point that something happened: Doc was alerted that "they" (Twitch) knew about the DM's. What people don't realize is that, that the burden of evidence is quite high to take this to court. Twitch would have been obligated to inform law enforcement. Hence why there was a stalemate, Doc got banned and no legal action was taken.. .. .however... Doc (and everyone involved) should be pressured to release the dm's. Don't support his streams until then.
She was 17, not 7. Can we stop acting like what he did was abnormal in any part of the world EXCEPT the degenerate one that puts dresses on little boys and calls it "progress"?
10:00 Lawyer here, Dan is completely wrong about the legal definition of actual malice. Actual malice means making a factual statement that you EITHER know is false OR with reckless disregard for whether it's true or not. So if you make a statement without doing any research about whether it's true, that's actual malice. Actual malice is the defamation standard that is applied to public persons.
Got a question. Is the second part not also the one which is followed with sayings such as "no reasonable person would believe this to be true."? Or is that used in a different context?
Huh? Drake was far worse. So far, Doc hasn’t been charged or any evidence he paid out anything. Doc was still paid out. Doc was probably creeping but let’s not pretend he was as bad as Drake (with what we know)

Off the top of my head: Karl Jobst, currently being sued by that Billy Mitchell dude who lies about his gaming world records.
Would be g2k Successfully trying to sue each other but something is happening today doesn't super build the case about why people years ago would be afraid of getting sued as if it would be happening
Chances are, it will settle out of court. USA defamation laws a notoriously weak
This whole situation and the time it took for it to come out is just wild to me.
Because they all have deep things they are trying to hide. If they start leaking things about others who's gonna say they won't leak things about them also
Is it even confirmed it was more than one?

If I was Doc, here is what I would have done: Back in 2020, when he was notified that he would be perma-banned, in that last stream, I would have said something extremely transphobic. And then the day after, I would tell my community that woke Twitch banned me because of 'hate speech'.
And then just shut the eff up and don't mess up again. There you go.
It would have leaked eventually and he made plenty of money since he got twitch banned doing what he did anyway.
i was thinking you were aiming for "plant the seeds" for a HARD alt right radicalization or his fans to the point where when this came out he would literally lose no one.

@@simtelefonI don't get what people find so surprising about twitch can read your dm's. In fact this proves they actively don't, since they didn't read doc's dm's until 3 years later when it was reported. If someone reports you said sth against TOS in the dm's, of course they will check. These two knuckleheads are so clueless about this case it's painful to watch.
@@simtelefon If someone assumes a company can't read messages on their own platform without the company specifying everything is secret, then that person is a moron. Of course the company can see everything going through its servers. This is obvious to anyone who knows how the internet works.

I have to say the set podcast set up looks good.
Dan looked so much better with his hat off on the mic stream, I assumed he was balding or something but it makes him look way younger just having normal guy hair
I'd agree for a regular person, but it kinda works for his persona. It makes the persistant 4chan grin more tolerable. Rounds it all up nicely. Less basement-dweller, more experienced know-it-all.
Tism + hats & Lesbians + hats make for weird combos
Is there anyone shocked that the company can read the whisper messages on thier site?

Has anyone on RUclips ever sued someone for something they've said about someone? Let me introduce you to Billy Mitchell 😂😂😂
Yes, cause if you want a fair hearing you go to the court of public opinion.
People gonna support whoever they want this comment isn’t stopping anyone
She was 17, not 7. Can we stop acting like what he did was abnormal in any part of the world EXCEPT the degenerate one that puts dresses on little boys and calls it "progress"?
Dan, the king of all dorks.
Destiny being completely wrong about the law with such confidence. Dork.
Because the law is subjective to progressives. It's their big push to topple capitalism.
Timestamp?
10:00 Lawyer here, Dan is completely wrong about the legal definition of actual malice. Actual malice means making a factual statement that you EITHER know is false OR with reckless disregard for whether it's true or not. So if you make a statement without doing any research about whether it's true, that's actual malice. Actual malice is the defamation standard that is applied to public persons.
Got a question. Is the second part not also the one which is followed with sayings such as "no reasonable person would believe this to be true."? Or is that used in a different context?
