The key difference in the argument is a rando making those accusations isn’t the same as a content creator with a platform making those accusations, which is also different from a journalist making those accusations. The potential for genuine defamatory harm to occur is massively different in each of these scenarios.

12:20 USA defamation laws are notoriously weak. For example, you can blantily lie about public figures because the Supreme Court ruled that it's within the interest of the public. Thus, you can lie because people care that the lie might be true. Literally, you can only be sued if you knowing lie without doubt and has effect

The alex jones defamation did not need actual malice. Since Alex jones was defaming regular people, and not public figures. The parents of the children that sued him would not count for public figures.

Journalists are generally extremely careful about making actionable statements, Jones is not because he's insane and believes in vampires, goblins, demons, that the government bought thousands of "military grade guillotines" in like 2012, that the government controls the weather, etc. you can't just walk back years of active defamation when you get sued... But he certainly would have done better if he cooperated with the court, didn't actively perjure himself multiple times, if his lawyer didn't accidentally prove his active perjury, and if he actually attended the trial. No normal person could get away with what he's done

The key difference in the argument is a rando making those accusations isn’t the same as a content creator with a platform making those accusations, which is also different from a journalist making those accusations. The potential for genuine defamatory harm to occur is massively different in each of these scenarios.

What I don’t understand is the bravado that Doc had talking about the issue at the start. I remember him saying things like “we finally found out why, and we’re going after them!” You’d think he’d be afraid of “going after” twitch when they have all the chat logs. So weird.
I don't think it'd be legal for Twitch to release private logs and he was aware of it. Also Twitch clearly didn't want people to know that they can read private DMs.

There was a release right before docs tweet that laid it out in plain english that after the bathroom incident, people at twitch hated his guts, I'm assuming because he doesn't really fit the politically correctness that twitch embraced, and had it out for him and were watching him like a hawk digging any way they could desperate to get rid of him. They found the chat logs between him and said minor where he she was inquiring about branding and platform growth. He had a company that deals with these subjects so it's not all that unusual. He was unaware of her age and it got flirty. I think it said the chat logs were from 2017 and they found them internally while digging and banned him in 2020. That, along with a ton more, was released in a huge email just prior to his tweet and in my opinion it's the only thing that makes it all make sense. I feel like I saw the email once and then not a single person has talked about it since.

I think Dan is correct. There was something very "telling", the dm's that showed Doc had the intent to meet up with the minor at Twitchcon. I think at this point that something happened: Doc was alerted that "they" (Twitch) knew about the DM's. What people don't realize is that, that the burden of evidence is quite high to take this to court. Twitch would have been obligated to inform law enforcement. Hence why there was a stalemate, Doc got banned and no legal action was taken..
.. .however... Doc (and everyone involved) should be pressured to release the dm's. Don't support his streams until then.
