  • Here I am explaining what defamation is according to the black letter law. Don’t google defamation because it is wrong. Google only gives a general definition of it.

    Thank you! I am in my first year of law school, and we are now currently going over defamation. Well explained. I wish I could have found one that broke down the approach when writing on the constitutional defamation under the first amendment, but this was very helpful. Thank you.

    Hi. If someone secretly records another and post the video on social media to harm their reputation, can legal action for defamation be taken?

      In your analysis, it will be libel because it is a recording, which is a more permanent form of the defamatory statement. In the case of libel, damages are presumed.

    Can you sue someone who forwarded a defaming WhatsApp message which they also received as forwarded?
    Do l Sue the forwarder or the writer?

      What lm trying to say is, should l write the statement to be sued or can l be sued even if l forwarded the already written message ie whatsapp message

      @@SammyNdlovu1212 If the statement is false and defamatory, both individuals will be liable under defamation as the original defendant and also as republishers.

      @@Lawbysam but how would the republisher have known that the statement is false for example
      The write writes “I hear John has relocated to the UK permanently”.
      Myself and John are in business together with 2 others and John owes us money.
      I then receive this circulating WhatsApp message and forward it to the other 2 partners including John.
      Am l guilty of forwarding that statement or the writer is? And do l have a right to share the information of the person who forwarded the message to me seeing that it was a WhatsApp circulating message?
