      I think cops should all have to pay into an insurance pool, + the rates go up if you get sued or if your department gets sued. Out of that pool money the people get paid out that get their rights violated.

      That's not entirely true depending on the state you live in. Some states only require you ID if you've been lawfully arrested. However, the minimum constitutional standard is you've been detained with Reasonable Articulable Suspicion that you're involved in criminal activity.

      They could have just called for a wellness check. If your walking through the park super early, and see someone who isn't clearly homeless laying down on the ground, it's easy to assume the person is in some kind of danger or distress.
      Alot of people have the wrong impression that the Police will actually "help" people, like give a hobo a ride to a shelter or the like, not knowing that the Police are just the arm of the City and State that makes sure they meet their Prisoner Quotas to companies like Management and Training Corp (which currently has a $10 million lawsuit with Arizona for their private, for-profit prisons being at less than 90% capacity).

      I was witness to someone breaking into a construction site. I was sitting down nearby. A woman came up and asked if I had seen someone break in-- I said yes, gave her a full detailed description of the perp, and pointed toward where I saw him go.
      She looked at me with the nastiest "Yeaaahh, suuuuurree" face I've ever seen (like I was an accomplice to the crime) and then walked off.
      I was legitimately trying to help. Guilty until proven innocent-- that's the American way.

      All you would have to do is at the mediation say YOU WILL NEVER WAIVE THE RIGHT TO SUE THE COPS and they will not be covered in the settlement with the dept/ county. There is no qualified immunity in such a stupid case, their lawyers will try to settle so it won't go to trial and increase the payout.

      By not training officers about the law and people's rights, the city should be liable. They don't have enough time in cop school for studying constitutional rights so they should be put through classes before they start their official duties.

Then tie the ability to have insurance as a requirement to be a cop. to many law suits and the insurance company will either drop them or they can not afford it and then they are no longer a cop. Now cops know getting sued means losing their jobs , not just a finical hit.

    As someone that went to the Police academy. NO you do NOT have to ID yourself and anyone that is detained and arrested for NOT showing your ID, get an attorney immediately and sue the living crap out of the arresting officers!       thats not illegal in the US? But more important...the guy didnt get money because of the ID. Police just often settle things like this out of court with a lump sum. Because it would be more expensive to go through.
      Even though in cases like this. The police would most likely win that trial.
      Theres no law that demands you have an ID. AND you CAN decide not to show your ID if youre not suspected of a crime directly.
      HOWEVER....in that case....Police absolutely DO HAVE the right to demand you follow them to the Station to Prove your personage. (without you showing your id personally then obviously. But by Fingerprints, computer etc.)
      And also...could you imagine if that were not the case? Youd have to wait for any illegal to commit a second crime...before youd have the right as the USA to demand prove of Person and right of residence etc etc etc? Ridiculous...
      Pure logic should tell people in this comment section how dam the notion is they WRONGLY convince themselves of here.

Its about the Supreme Court's interpretation of the 4th Amendment in Terry v. Ohio, 392 U.S. 1 (1968). Again, law is not about what makes sense to YOU or seems right to YOU. And, in this case, the settlement was in fact due to the city not being likely to win given established applicable legal precedent.

    Those officers do not care whether the case was settled for $30k or $300k. The cost doesn’t affect them and the point was to impose authority. The charges don’t have to stick. The point is to make everyone comply through fear of being put into the system. Who wants to be arrested, jailed, arraigned and have to worry about court? Since there are no real repercussions to the arresting officers they have everything to gain and nothing to lose.

      I agree with you but to complicate the solution of more training. training is expensive. The department is paying for a trainee or officer to sit in a classroom drawing full pay and not out on the street.
      Also to say "know the law" oversimplifies. There are laws written in the various local, state and federal books, black letter law. Then on top of that is case law which is how courts through the years have interpreted and applied what is written.
      In the case of this video lets play "what If".
      What if the man had just murdered his wife and two kids with the police searching for him only to realize later the man on the bench was the murderer? Unlikely? Yes but possible.
      Remember Jeffery Dahmer? One of his victims escaped before becoming dinner and was stopped when running down the street. The guy told police what was happening then Dahmer arrived telling police the guy was his drunken boyfriend, everything was cool so the cops let Dahmer take him back when the guy became dinner.
      My point being the cops are paid to be a little suspicious and sometimes that can be inconvenient for the innocent but asking for ID, is that illegal?

    I am not a police officer but I am a security officer at a state hospital. Police only respond at our place if it's escalated or we request them otherwise we handle everything ourselves. Now that that's out of the way we had a call similar to this yesterday (time might be different so it would be yesterday from the day I post this comment) and a lady was sitting on a public bench, black woman with a dog, and people were complaining she was there for too long on a public bench outside of one of the adjacent buildings to the hospital. Staff over reacted and this is how the interaction went. I approached her and introduced myself and said that I was sent here by my dispatcher to do a wellness check, she looked confused and was very disoriented, she told me she was waiting for her ride to come get her and I said I kind of figured that was the case with you being near where a bus stop/taxi pickup area is. I told her if she needs anything like a water or whatever to come inside to the front desk and we would get her set straight. No PD no nothing. If someone is in a public area chilling we don't bother them. We had a person fall asleep on a bench in one of the courtyard's and we responded to a wellness check and just verified if they were alright and not dead, they apologized and we told them that they were fine to be there and just to make sure that they stay hydrated because it was 99 degrees outside. Not hard

So state workers and teachers would be nailed. I think a batter solution is to make them car liability insurance and then make it a requirement to be a cop. Now losing a law suit can cost them money and their job .

      As someone living in a developed country, watching US cops and their behavior is like watching a fantasy movie.
      If it were that easy to sue them and get hold of police officers with a god complex, I would stop working, I would call the police myself every few days and report such blatant crimes as ‘someone is lying on a bench’ and wait until they arrest me without justification.

      Suing a police department is very difficult so cops bully, lie and wrongfully arrest people because they know their police department has their back and they will get away with it.
      These rules were made to protect cops but they abuse the rules so a lot of people want to stop qualified immunity.

      Besides, a higher settlement payout would encourage better educated & trained police officers.
