WI v. Kyle Rittenhouse Trial Day 10 - Jury Instructions by Judge Bruce Schroeder

Jury Instructions & Closing Arguments
REMINDER of the judge's ruling in defense use of force expert testimony: Schroeder told the attorneys that Black wouldn’t be allowed to testify about what Rittenhouse was thinking when he pulled the trigger or whether he definitively acted in self-defense.
Assistant District Attorney Thomas Binger said if Schroeder allowed Black to testify only about the timeline of events that night he wouldn’t call his own expert to the stand. Defense attorney Mark Richards agreed to the deal.
Charges:
1. First Degree Reckless Homicide, Use of a Deadly Weapon (Joseph Rosenbaum)
2. First Degree Recklessly Endangering Safety, Use of a Deadly Weapon (Richard
McGinnis, reporter for Daily Caller, not injured but near Rosenbaum when Rittenhoue
fired)
3. First Degree Recklessly Endangering Safety, Use of a Deadly Weapon (unknown male)
4. First Degree Intentional Homicide, Use of a Deadly Weapon (Anthony Huber)
5. Attempt First Degree Intentional Homicide, Use of a Deadly Weapon (Gaige
Grosskreutz)
6. Possession of a Dangerous Weapon by a Person under the Age of 18 (JUDGE DISMISSED THIS COUNT ON THE DAY OF CLOSING ARGUMENTS)
7. DISMISSED AT THE END OF STATE”S CASE. Prosecution failed to put evidence in front of the jury that there was a lawful curfew in place (appears to be an oversight by prosecution) Defense moved to dismiss, judge agreed. Fail to Comply with Order of Local Government - Emergency Management Activity (citation, carries no penalty) - everyone present was breaking the 7pm curfew issued by the sheriff.
Possible Sentence: Max: Life in Prison Without Parole (WI does not have the DP)
JURY CHOSEN IN ONE DAY. 20 jurors have been selected in WI v. Kyle Rittenhouse. 9 men and 11 women. (8 are alternates)
Rittenhouse shot and killed Joseph Rosenbaum, 26, and Anthony Huber, 26, and injured Gaige Grosskreutz, 27. Prosecutors say that Rittenhouse, then 17 and from Illinois, was a vigilante looking for a fight. He, like other right-wingers, went to Kenosha, Wisconsin ostensibly to protect property. This happened as protests over police shooting local man Jacob Blake turned violent. Rittenhouse’s attorneys assert he was acting in self-defense. This case became a cause célèbre among conservatives.
Prosecutors have struggled in court, failing to introduce evidence of prior aggressive behavior. This included evidence showing him attacking a woman who was in an altercation with his sister. The other is that he was closely linked to the violent, far-right Proud Boys organization.
Kenosha County Judge Bruce Schroeder said an appellate court would reverse him if he allowed these in trial. The evidence was too prejudicial, he said. He left it up in the air whether he would allow footage showing someone identified as Rittenhouse discussing a Black man exiting a CVS pharmacy. Rittenhouse believed the man was shoplifting.

They read all the instructions through at first, but when the jury actually deliberates they proceed from the instructions which explain everything applicable in bite sized pieces again and again, so no, there's no pressure to mentally digest and completely assimilate each point at the outset. It's not as intimidating as it sounds because everything is explained very well with each consideration. It's prepared properly for easy comprehension.

FYI - there were numerous counts against the defendant. They are all very similar in description. He has to read each one out to the Jury. These were the counts:
First-degree reckless homicide, use of a dangerous weapon
First-degree recklessly endangering safety, use of a dangerous weapon
First-degree intentional homicide, use of a dangerous weapon
Attempted first-degree intentional homicide, use of a dangerous weapon
First-degree recklessly endangering safety, use of a dangerous weapon
Possession of a dangerous weapon by a person under 18
Failure to comply with an emergency order from state or local government
The state threw everything at this case, the last two counts were thrown out during the trial.

He was immaturely using bad judgment to be there in the first place with a gun at his age , but , with that said , he had a right to defend himself. There are LAWS for self defense no matter what Situation a person is in.
Kyle was doing what he could for his community, while rioters and arsonists descended on Kenosha from out of state.
The world is better due to his actions.
Huh? Very confusing.
If our 17 year old son dressed himself like GI Joe, complete with loaded NR15 loaded, strapped on rifle to attend a protest, I would think we had done something wrong in our parenting.
But that's just me.
True
Kyle on the other hand. He was there to protect Kenosha from such dissipation. He did the job of medical staff, the fire department, the police, and that of a good citizen all in one night. First. It's sad that you can't see that. Second. You don't have a shred of courage compared to this boy. Spineless people like you are the reason Kyle was there. You weren't there to help. You weren't there to stop lawlessness. You are a coward.

You are so uninformed and wrong. Your original comment shows you have no clue.
1. He wasn't dressed up like a GI Joe.
2. Kyle didn't have an "NR15"
3. Kyle didn't "attend a protest"
He was there after 2 days of violent rioting, looting, arson, murders going on in the community he worked. He was there to prevent more harm to local people and local businesses. He was there because you weren't. You couldn't stand up in the face of outright lawlessness and try to make a difference. There is so much proof he wasn't there to shoot people. He only shot the people that tried to kill him. Period. 100% of th people that didn't assault, attempt to harm, or attempt to murder kyle are all alive right now. He was there stopping people from breaking the law an to stop more harm and people tried to kill him for it. Here's a question. How many of the violet rioters have you complained about?
If Kyle walks it won't be because of the judge. It will be because everything I've stated is factual and the prosecution couldn't prove otherwise
Long live Kyle with his freedom
Why was he there at a protest with an AR15 across state lines with ( an extremely lethal firearm ) He was looking for a fight
@@robertdove807 because not everybody was sitting on their hands while our cities and communities were being set ablaze and looted by rioters and arsonists. Kyle was one of the few who took an active role in responding to what was happening. If you're going to "defund the police", then citizens will need to be able to defend themselves and their communities. If an angry mob chases someone down, it's likely with ill intent, and they can't be too surprised if people defend themselves. The basic lessons here: don't chase people down, and don't burn down the neighborhood or loot businesses. Simple.

Prosecutor not interested in justice or truth: Rioters were Heros? Those who tried to kill Rittenhouse were interested in stopping him from hurting others?
They watched him gun down a man then run away from the scene. Rittenhouse was an active shooter who Huber and Grosskreutz tried to stop. They are heroes.
Bringing a powerful, provocative weapon like that to a protest event was a completely blatant and unacceptable threat of violence in and of itself. Combine that with the certainty of some unbalanced demonstrators on edge and you get this kind of tragedy. In no way should Kyle walk away unpunished.
No. You can carry a weapon. Whether you think it's scary or not doesn't matter.

Taking an assault weapon to the streets is reckless and escalation of danger. He is not even of age to own it. He obviously intented to kill shooting several times in one victim. He could of shot to the leg not chest. He could of shot to the air. He is guilty!!!
You are not as smart as you think you are.
In case you are not aware, knowingly and willing shooting someone in the leg as a "self defense" claim can get you jail time for maiming... just saying
Your argument is based on anyone taking a gun onto the streets being reckless and escalation of danger, so you should be fighting for the gun laws to change, that is a very different argument to self-defence, after all, the individual who got injured was pointing a Glock handgun at Rittenhouse's head, whilst the other two tried to take Rittenhouse's gun from him, which he was not pointing at anyone.
.I happen to agree with you that taking a gun onto the streets is reckless and escalation of danger, however, I live in the UK, and that act is aggression, so self-defence would be very hard to prove, as it's not a right of UK Citizens to carry arms in public, in the USA, it is different, they have a right to be armed.

If Kyle was our son, he'd get punishment from us just for going there. And worst of all, he went there at 17 and with a dangerous weapon. If he had to defend himself, that's one thing.
