Its also worth noting that originally, protections for intellectual property were only supposed to last about 5-10 years. It was corporations (mostly Disney) who lobbied for extending their duration over and over.
One of those companies that led the charge was disney who kept fighting to keep mickey under their watch for years till recenly where the court finally had enough of it.
"Why is nobody attacking the patent system?" Because everyone with the ability to do so has no reason to do so, and it is a massive task. Assuming you even came up with a reasonable change, everyone who could potentially lose money in the short term will happily throw their money at politicians to stop you. Most businesses that lobby only care about their quarterly reports, they don't care if the business/industry burns to the ground.
4:57 its actually more horrible when you realize that in their patent, they deliberately choose not to use the word "ball" in the language of their claim: The phrase they used was "throwing an item to catch a monster", which is an even broader definition and thus, more egregious, because it transforms the definition to mean anything that can be thrown. Which in turn, can be used to include projectiles... Like bullets, or if they remake the capturing mechanism of the game like making the pal sphere a projectile, the creators might still run into the same issue with the same language in the patent.
This is why I hate Trademark and Copyright law in general. Alongside lobbied legal regulations put in place by the government on behalf of corporations, these things effectively allow corporations tooperate like monopolies, making competition extremely difficult to nigh-impossible. I would like to add that this is an expressly ANTI-Capitalist practice. The foundational concept of Capitalism is the free and open market, and anything that stifles the free and open market goes against the core principals of Capitalism. So many people fail to understand that many of the problems they have with Capitalism are actually a result of Capitalism not being allowed to function properly, because anti-capitalist/anti-competition systems are implemented by the government to protect the corporations which lobby and back career politicians. You wouldn't say that officials of Communist regimes enriching themselves with the wealth of their people adheres to Communist ideology and concepts. Powerful entities subverting an economic system for their own enrichment does not mean that the economic system is at fault, they are expressly worming their way around the system and/or using their power to alter the system in ways which are antithetical to the core concept of that system. If the government didn't stick their nose into the economy by allowing corporations to legally patent these things, or implement regulations to stifle competition, then other companies would be capable of competing and forcing the big corporations to be more consumer friendly in order to remain competative. Of course, some regulation is necessary to ensure that corporations don't just assimilate or collaberate with all of their competitors to maintain an effective monopoly, but the government absolutely shouldn't allow for corporations to directly influence policy regarding the free market. That's the biggest issue with how corporations have so much power. The government cannot appropriately regulate corporations while simultaneously being influenced by those very corporations. It's anti-capitalist policies and systems that are preventing our economic system to function as it's supposed to.
There's nothing more reliant on govt intervention than intellectual property rights Most anti-competitive, anti-capitalist and anti-consumer practices exist because of them
I get the anger towards trademarks because companies abuse them but they are still important to protect intellectual property. If I had a company with certain branding and iconography, I would also want to protect that. Having everything just be freely available could easily damage the business.
The flawed Intellectual Property system has encouraged me to just do it myself, and, if someone wants something, we'll just trade informal favors. Because patents don't extend to gifts. And copyrights don't go for everyday conversations. Sh*t world we live in.
Back in the day, when corporations weren't treated like persons, it was kinda aight. But now, corporations are juridical entities that exist without boundaries. How do you regulate something you can't touch or catch, when they can run off to another country so easily or rebrand or declare bankruptcy only to start anew in another company.
okay, trademark law is insane, but, there is nuance; eg you can't say "you're fired!" for _commercial media use_ is different from a blanket restriction. it really means that you can't print shirts with a pic of trump-esque businessman saying "you're fired" or claim that you invented it.
@@aziouss2863 you may think so, but if you are in business then you must be licensed by the govt who granted the copy/tm so if you violate it, they will eff with you.
Don't worry, most of this stuff isn't valid outside the US, so we can safely ignore all this nonsense. I remember back in the day a certain Swedish pirating site would get a lot cease and desist mail from the lawyers of movie corporations and stuff, and they'd all say the contents of the mail was copyrighted. But the pirate sites own lawyer would write them back hilarious replies telling them why they're stupid then post it all online explaining why copy writing an email is not valid according to Swedish law so they could publish it as much as they wanted. They had a whole archive just of posts like that. It's the same for this kind of thing, it's too generic for the trademark to be legal. Just keep in mind, these evil corpos eventually framed all the people working on that site as well as bribed the police into raiding their servers, eventually landing them in prison on fake charges. So that's what happens if you fight back.
This is honestly depressing. Just to see the state of our world. Having already powerful corporations putting their shitty little stamp on everything they can.
Oh just wait until someone makes a video describing how apps exist for all “competitors” in a town or area can sets minimum prices together and raise each year together. Most commonly affecting rent and price of living
no one is fighting the patent system because most people will have trouble understanding whats going on in the first place, and anyone else has a hundred other things to do that are more important
It's worth pointing out that this is not exclusively an American problem (although the unique national culture of the US does enable the problem to flourish easier than would be normal). This isn't even a Capitalist problem. This is a human problem. No matter what country, no matter what legal system, no matter what economic system, no matter the morals, values or ideals held by a society, there will *always* be people looking to exploit the system in order to gain power over others. You can't escape it, you can only try to mitigate the damage their actions cause. The best you can do is secure your own sphere of influence and make sure anyone it touches is helped by its presence instead of hindered.
The problem isn't capitalism, the problem is America's steady march towards socialism that is the problem. Right now, America is at the Corporatism stage of this transition, and hopefully it can be stopped before it gets further.

lobbied = legalized bribery
I remember the time that a certain YT channel tried to Patent "React"... that was hilarious
The fine brothers

Plenty of competition amongst grocery stores here, and depending on where you live ISP's as well

Sh*t world we live in.
Paws need to trademark Paws so she can have dominance over every brand with paws in it.
If Fine Brothers successfully trademarked the word "react" Paws wouldn't be here right now 😂
Can I leave planet earth? I wanna leave planet earth, its crazy here...
Actually, there is absolutely nothing that is right with corporations
Back in the day, when corporations weren't treated like persons, it was kinda aight.

The best business, isn't one that provides the better service, it is the one that makes sure it is the only service.

Yes i can and there is nothing they can do about it.
Don't believe their bs.

QUICK, SOMEBODY PATENT "GYATT"
no one is fighting the patent system because most people will have trouble understanding whats going on in the first place, and anyone else has a hundred other things to do that are more important
There is nothing wrong with corporate America. It's functioning as intended.
The same power of the IRS is also that of trademarks and patents. It's a get-rich-quick scheme. Got to rake in that passive income.
It's worth pointing out that this is not exclusively an American problem (although the unique national culture of the US does enable the problem to flourish easier than would be normal). This isn't even a Capitalist problem.

2:42 ... Yes Ma'am
Strange system here you can only patent something before mass production starts if you don't get efd

Woaw
She has hands
Unusual
I mean the U.S. military's motto is:" If you ain't cheating you ain't trying"
