      Jared this is a little bit of a rant, but thought you maybe see this under your thread and maybe give your opinion? Thank you Sir for everything!
      Hopefully Texas wins the standing argument, and chops suppressors from the NFA. The NFA registry has 3.1-3.2 million registered suppressors so by Caetano standards they are in common use by citizens for lawful purposes, and if they are in common use then they can’t be dangerous AND unusual. If they get standing, the case will probably end up at SCOTUS by the ATF requesting Cert. At the district it could go either way, but either whoever takes the L is gonna appeal it to the 5th Circuit where I believe Texas will win. Based upon no interstate commerce, they need to address they are in common use, and should be a W. The ATF will appeal to SCOTUS, and it will be granted cert because they always seem to get their cases heard. With that said if SCOTUS follows their precedent in Heller, Caetano, and Bruen then suppressors should be removed from the NFA.
      I’m hoping the same thing happens for the pistol brace rule. The ATF in their brief to the 5th Circuit on those cases basically said pistol braced firearms were illegal SBRs the ENTIRE time so they can’t be used towards common use because they were illegal from the beginning🙄. They seem to forget they said for over a decade they weren’t SBRs even if they were shouldered. Now the shouldering they flip flopped a couple times, but if I remember correctly before this stupid rule came out shouldering was permitted again. Also they said they offered a “amnesty” window and whoever ignored it is basically a felon. If I remember right they gave 90-120 days for 3.5-7 million pistol braced firearms that they recognize as in circulation, but when they made “street sweepers” an NFA item as an AOW it involved like 10k weapons and they had 7 YEARS to register them. Either the NFA registry for SBRs has 600+k on file which under Caetano is common use. If you add the pistol braced firearms which the ATF doesn’t want counted in the number it’s over 4-7.5 million by the ATF figures.
      I’m hoping both issues go to SCOTUS, and they follow their presence they set. Rule both suppressors and SBRs are in common use so they can’t be dangerous AND unusual and remove them under the regulations of the NFA. 🙏 I love to see the ATF get their teeth kicked in on a court decision that they started by their overreaching “rules” on items they said weren’t SBRs for over a decade, and now they were actually illegal SBRs the entire time with their owners being felons for possessing them. Can’t make that shit up! Another ATF thing just made on the fly.

      Suppressors should be mandatory based on the 1990 amendments to the clean air act, which added noise pollution. The right way to get suppressors off the NFA would be to sue EPA to enforce clean air act amendments. EPA would then have to allow the states to decide how to implement suppressor use via SIPS.

      It’s absolutely a health issue. Imagine if it had to be argued in the courts for automobile owners to put mufflers on vehicles. Not being able to put a muffler on a firearm without government permission is just as absurd.

      ​@@Shadow__133truly hearing safe suppressors are all held secret under national security patent processes. That or if you don't patent they just seize it. I believe the ATF has you submit your plans if you try to make one under the NFA. Most patents that are seized under national security are either energy or military applications.

    I'm a little confused because I thought in Murdoch versus Pennsylvania 1943 you cannot tax a right.
    So therefore the NFA is in violation of that ruling as well as in violation of the Second Amendment.

It's flagrantly unconstitutional, and it was actually illegally pushed off the floor by Charlie Rangel after a first vote of 297 nays to 124 yeas. He held a second voice vote and called it passed after refusing a second recorded vote. We should have been pushing back against this as soon as it was passed, and we need to continually be pushing back against it no matter what congress or the president does. There should be legislation passed with massive community support every single congress.

    Until such time as there is a ratified change to the Shall not be infringed clause, Congress has no authority, and has never had the authority to enact firearms legislation. Per Marbury v Madison, all such laws are void. Per the Shuttleworth decision they may be violated with impunity.

      @@stevewoodsideI used to think that, but then hearing of Jeremy Kettler and Shane Cox being convicted under the NFA in Kansas with their “Made in Kansas” loss in 2019, which the Supreme Court refused to hear, I realize it’s a lost cause at the state level.

      @@snappyaj9053Technically it’s not a lost cause, the difference being the federal government is authoritarian and decides to pick/choose what they want to enforce. You have blue states openly ignoring numerous federal laws yet if a state like Texas wants to remove their grip on gun control they immediately clamp down because it will impact the disarmament agenda. That’s how you know that this country will collapse soon.

    This should ALL fall under the totally ABSURD idea that government is not INFRINGING when it regulates minor aspects of firearms. Barrel lengths, furniture, muzzle devices -- and all similar things have POSITIVELY NO LEGITIMATE GOVERNMENT INTEREST. This nonsense has to end. They should all be challenged in a single case: if a firearm is legal then any modification which doesn't substantially change its function should be legal.

    I'd love to read their briefings. I'd argue that Texas has the authority, under the 2nd and 10th Amendments, to choose what weapons it militia should have, not the feds, so the entire NFA is unconstitutional on those grounds.
