  • In this Direct interview, John is joined by renowned American legal scholar Richard A. Epstein for a discussion about American society in the wake of the overturn of Roe vs. Wade by the Supreme Court. Professor Epstein traces major changes in American legal theory and governance from independence through to the present, highlighting the shift in legislative power from the local to the national level and increasing activism by and politicisation of the Supreme Court. He blasts the recent loss of moral purpose and unity in the US, laying some blame on President Biden and his style of leadership and law-making.
    Richard A. Epstein, the Peter and Kirsten Bedford Senior Fellow at the Hoover Institution, is the Laurence A. Tisch Professor of Law, New York University Law School, and a senior lecturer at the University of Chicago. Epstein researches and writes in a broad range of constitutional, economic, historical, and philosophical subjects. He has taught administrative law, antitrust law, communications law, constitutional law, corporation criminal law, employment discrimination law, environmental law, food and drug law, health law, labor law, Roman law, real estate development and finance, and individual and corporate taxation.

      Nothing was so unprecedented about Trump as was the response TO him by the left-leaning establishment. That is what really destabilized the system.

    A very good discussion. I too am a constitutional lawyer, and I agree with almost everything Richard Epstein says. (I differ from him only in one respect: the ultimate significance of Dobbs is not on stare decisis, but on federalism and the separation of powers - but perhaps I misheard him on that point; I'll listen again.) The US should be that shining city on the hill, but has badly lost its way, and the politicisation of the DoJ and FBI is now so thorough that I don't know if the institutional damage can be undone.

    He was such a joy to listen to. I only wish the interview were longer. About the US, I think most Americans can sense that things aren’t good. But I still have hope that something will change, something will give, to steer this ship and turn us around. I do worry for my kids though. I think one of the worst things that happened to society was the invention of social media. The fact that more kids want to be “influencer’s” instead of doctors highlights a real lack of morality nowadays.

      And yes John, we can only press on as best we can for as long as we can for the sake of the next generation and they are a very worthy cause as is this mighty country we are fortunate enough to live in.

    When presented in such a condensed and lucid manner the situation does indeed look dire and it is difficult to be optimistic. However, some details were off, so maybe the picture is somewhat exaggerated. The US spends 3.6% of GDP on military, not under 2 as stated. It is indeed far less than during Cold War and the decline took place mainly under Obama administration. The trend was reversed under Trump and the percentage is still increasing, so maybe it is an issue that Biden administration overlooked. As far as trade agreements, it was not that Trump did not understand their importance, but he believed the terms were unfavorable to the US. Briefly, US markets were being opened to foreign trade, but our trade partners were (and still are not) as forthcoming. EU is a perfect example.

      It's called the profit motive, capitalism (profit at all cost). Everyone only cares about their own agenda and self interest. The orange clown has no understanding of economics. He is a narcissist! It is a global economy, it can't be unwound. It's called profit. Understand that then you can filter out the noise.

    Thank you, John. Another informative interview. As an American, I think Richard is spot on about the state of both the USA and the West in general. Sad to say that this is exactly where the Left wants us. I look at Conservatives and Republicans (not quite mutually exclusive but getting close) in the USA and I see no reason for hope. I listened to an interview with William Barr yesterday and I came away with the same sick feeling in my gut. Frankly, it is easy to see the USA splitting in the near future. There is simply no common political ground to be seen and the Left has thrown the rule of law under the bus both nationally and in every state and city they run. They show no signs of learning from the disasters they have created. If anything, they are doubling down. It is now even illegal to defend yourself in New York City if you are facing an attacker using deadly force. Apparently, your only options are to die or defend yourself and go to jail. Responsible citizens cannot live under such a system.

      BOB, Stop blaming the left. Look at your representative on the right calling for Christian nationalism. You are buying into propaganda if you think it is illegal to defend yourself in NYC. I read good Samaritans stopping crime and I do not see them going to jail. What should be happening is BLM should be helping out their own culture stop committing crimes. But then I would be called a racist.

    Why do people constantly site poll data as if it reflects reality? About no one I know has ever taken a poll nor likely would if asked. Stating what the US population believes based on polls and representing that as reality is not well. Do the people citing them spend their whole life answering poll questions in real time? How many times have people stating poll data even been included in the poll being cited to support what they believe people believe on the subject?
    Talking heads, media, and politicians use them all the time but no average person I know of believe polls are useful.
    I read a Supreme Court Justice say that they Justices should be swayed by popular opinion so the court isn't negatively viewed and keeps its legitimacy. As if they actually know what popular opinion actually is.

    Great guy, the only thing I wonder is if he really believed the ACB seat shouldn't get filled (not because of any legal or moral reason, but for the court's future).
    Also props for him for calling out the power gap correlating with the age gap. Not nearly enough talk about this. The XY gens don't have any capital because it's all in boomer hands (and older).

    Professor Epstein was correct on the US domestic issues, but I believe totally wrong on international problems. The world SHOULD, as he advocates for state vs federal power in America, have the right to make their own decisions about their countries. We've been needling far too long for decades. Let's take care of our own country, while infrastructure is collapsing.

    He knows a lot the constitution but his understand of modern. Military problems are wrong. It is becoming to expensive to police the trade. If you take the British and Japanese and add it to ours were are 15 times greater than the rest of the world. It is apparent now that we could inflict 1000 to 1 casualties on Russia in the European theater. The way you fight China is stop the import of fuel. China is so sensitive to energy inputs you could expect the death of 500 million people in the first year without shooting a shot. They don't have ships that can make it to the gulf without refueling so anyplace that allowed refueling would no longer exist.
